Dear Ms. Garvey and Ms. Karoly,
On behalf of The Rocketts, we are requesting authorization from the USACE to use NWP 29 for
the placement of fill into 0.15 acres of jurisdictional wetlands for the construction of the proposed
project. A copy of this PCN has also been provided directly to Ms. Joanne Steenhuis in the
Wilmington Field Office.
The site is located north of the intersection Holden Beach Road and Hazelnut Trail, in Supply,
Brunswick County. The project is approximately X18.1 acres in size and is located in the Lumber
River basin. The wetland delineation was reviewed and approved by Ms. Kim Garvey with the
Corps of Engineers (AID #SAW-2006-41796). A copy of the signed JD Survey has been
provided as an Appendix to the enclosed PCN.
The current request is for 0.15 acres of impacts to jurisdictional wetlands (see the attached

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be usefiil to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these desigh options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during conshuction to reduce impacts.
Updated 11/1/2005
The proposed site plan has avoided and minimized wetland impacts to the greatest extent
possible. Wetland. impacts have been minimized to only those impacts needed to construct the
access road and a level spreader for the stormwater pond outfall. The proposed road is needed to
provide iiuier-development connectivity between the northern and southern portions of the
project, as well as providing_multiple access points to meet Brunswick Cottnty EmergencX
Services requirements. Wetland imRacts were fiirther minimized b~desi n~in~ the access road
alignment to cross the wetlands in the existing location of an old farm road. The road ROW has
been designed at a 60' width, which meets the minimum width allowable by Brunswick Count
Wetland impacts will also occur as a result of construction of the level spreader, which is
required by the DWQ Stormwater Permit (Permit #SW8 070714). The western stormwater pond
has been designed to outfall into an existing ditch within the wetlands. The level spreader is
necessary to dissipate the energy of discharged water, preventinP erosion and sedimentation of
downstream waters. No wetland impacts will occur as a result of construction of the proposed
lots.
The post-development wetlands will be preserved b iy ncorporatin~ a restrictive covenant into the
HOA documents. The Restrictive Covenant will provide assurance against future impacts to the
preserved wetlands. A copy of the proposed Restrictive Covenant language and Wetland
Conservation Exhibit has been provided as Appendix 2.
VIII. Mitigation
DWQ - In accordance with I SA NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
fiulctions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NC>JEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strm~;ide hhnl.

of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
The proposed mitigation for the 0.15 acres of wetland impacts will consist of the preservation
of the 4.49 acres of wetlands remaininP in the post development condition, as well as the
purchase of 0.25 acres of wetland mitigation from EEP. A copy of EEP Letter of
Reservation has been provided as Appendix 3.
2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement
Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at
(919) 715-0476 to determine availability, and written approval from the NCEEP indicating
that they are will to accept payment for the mitigation must be attached to this form. For
additional information regarding the application process for the NCEEP, check the NCEEP

DEED RESTRICTIONS AND PROTECTIVE COVENANTS
In accordance with Title 15 NCAC 2H.3000, the Coastal Stormwater Management Regulations, deed
restrictions and protective covenants are required for High Density Residential Subdivisions where
lots will be subdivided and sold and runoff will be treated in an engineered stormwater control facility.
Deed restrictions and protective covenants are necessary to ensure that the development maintains a
built-upon area consistent with the design criteria used to size the stormwater control facility.
f, Frank Richard Atkinson President of The Rocketts. Inc., acknowledge, affirm and agree by my
signature below, that I will cause the following deed restrictions and covenants to be recorded error to
the sale of any lot:
1. The following covenants are intended to ensure ongoing compliance with State Stormwater
Management Permit Number SW8 , as issued by the Division of Water Quality under
NCAC 2H.1000.
2. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to
maintain compliance with the Stormwater management permit.
3. These covenants are to run with the land and be binding on alt persons and parties claiming
under them.
4, The covenants pertaining to stormwater may not be altered or rescinded without fhe express
written consent of the State of North Carolina, Division of Water Quality.
5. Alteration of the drainage as shown on the approved plan may not take place without the
concurrence of the Division of Water Quality.
6. The maximum allowable built-upon area per lot is 3.000 square feet for a total of sixty-four (64)
lots. [If you have town homes fist the number of town homes and the total BUA for ail
town homes.] This allotted amount includes any built-upon area constructed within the lot
property boundaries, and that portion of the right-of-way between the front tot line and the edge
of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete,
gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood
decking, ar the water surtace of swimming pools.
7. Ail runoff from the built-upon areas on the tot must drain into the permitted system. This may be
accomplished tf~rough a variety of means including roof drain gutters, which drain to the street,
grading the lotto dram toward the street, or grading perimeter swales to collect the lot runoff
and~directing them into a component of the stormwater collection system. Lots that will naturally
~~ drain into the system are not required to provide these additional measures.
8. Placement of dredged or fill material, or development within waters of the US and/or wetlands,
requires notification to the Division of Water Quality Stormwater and the 401 Wetlands Section.
