application and supplemental information requesting written concurrence from the U S Army Corps of
Engineers (USACE) and the N C Division of Water Resources (NCDWR) that the activities proposed below
may proceed under Nationwide Permits 14 & 39, and corresponding General Water Quality Certifications
3886 & 3890
It's important to note that a pre - application meeting was held on September 5, 2014 with representatives
from the USACE, NCDWR, and Wake County, and an onsite meeting was held on September 11, 2014 with
the USACE Additionally, a NCDWR onsite meeting was held with former NCDWR staff member, Lauren
Witherpsoon on May 31, 2012 At the pre - application meeting, site plans were presented and proposed
impacts were discussed At the 2014 onsite meeting with the USACE, time was spent evaluating the stream
quality at Impact Area A -3, at the 2012 onsite meeting with NCDWR, the feature at Impact Area A -1 was
evaluated utilizing the NCDWR Stream Evaluation methods To date we feel that we have taken the time to
address any concerns of all three agencies and have prepared a complete application for your review and

Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application The existing conditions on site are wooded with the existing Biogen facility to the south The site is bounded
by NC 147 to the east, Davis Drive to the west, and Kit Creek Road to the south Three (3) perennial /important stream
systems bisect the property, with additional interm►ttenbun►mportant (and isolated) streams flowing into these main
tributaries The site is located within Wake County, with a small portion to the north located in Durham County The
general land use in the vicinity of the project is predominantly industrial with an influx of residential

Biogen Is expanding its operations in North Carolina which will require new road infrastructure and an expansion of the
manufacturing facility The proposed manufacturing expansion will include new buildings, warehouse, storage, QA/QC
and electrical infrastructure facilities The new facilities will require major utility relocations, including water, sewer, gas,
electric, telephone and communications, building modifications, parking and roadway Infrastructure The purpose of the
proposed impacts are to construct a new road (i a Loop Road) that will connect the existing Phil Sharpe Drive to Davis
Drive which will provide access to the northern portions of the property and new access off Davis Drive, extending the
existing Wally Gilbert Drive which will provide Internal access within the South Campus and will dually act as a
construction access while the facility is under construction, and an expansion of the manufacturing facility to support the
product market

The overall project consists of three (3) roadway impacts, one of which is a proposed bridge, and lot fill associated

According to the project engineer, the road crossings on the south side of the property were done in two steps, 1)
Kenneth Murray (access from Kit Creek closest to Davis Drive) was done in the late 1990's (1998 -2000) and 2) the
second entrance was done in 2005 -2007 when the parking structure was built. At the time, both crossings were approved
as bottomless arch culverts so no impacts were applied for or needed.

Impact Justification and Mitigation

Avoidance and Minimization

Specifically describe measures taken to avoid or minimize the proposed impacts in designing project
S &EC completed a wetland delineation and Jordan Watershed Buffer evaluation for the entire property in order to
identify natural resources so that the project engineer could design a site plan that would minimize impacts to the
maximum extent practicable. The parcel of land Is bisected by three (3) important/perennial stream systems and
multiple tributaries flowing into these main streams The project is proposing three (3) impact areas, one of which
will be temporary Impacts associated with the construction of a bridge therefore avoiding permanent impacts to the
jurisdictional stream. The project entails the construction of a new road (i a Loop Road) that will connect the
existing Phil Sharp Drive to Davis Drive The connection points for the Loop Road are set (i.e existing
Development Drive on the northwest side of the property and the existing stub at rotary on south side of property)
In addition, a facility expansion Is proposed within the South Campus. Impact Area Al is a road crossing
proposing permanent impacts to 176 linear feet intermittent/unimportant stream and 0 04 acres of wetlands This
stream and wetland area was previously Impacted by the NCDOT Davis Drive Road Widening project, this segment
of stream was relocated and lined with nprap This road crossing has been designed to cross the stream and
wetland area at a 900 angle, therefore minimizing impacts to the stream Impact Area A2 is abridge crossing
proposing temporary Impacts to 198 linear feet a perennial /important stream The proposed stream crossing will be
constructed as a bridge but because of steep topography, along with the distance of the proposed bridge location In
relation to the existing access to the site, the temporary impacts are necessary for construction activities This
proposed stream impact was minimized by crossing the stream below the confluence of the two tributaries and
designed to cross the stream at a 90° angle, therefore minimizing impacts to the stream The temporary stream
impacts will be restored by stabilizing the banks and bnng►ng the stream bed back to Its pre - existing elevation Impact
Area A3 is a road crossing and lot fill, proposing permanent impacts to 130 linear feet of perennial /important
stream, and 120 linear feet of intermittent/unimportant stream The road crossing is necessary for the Wally Gilbert
Drive extension, which will provide internal access within the South Campus and will dually act as construction access
while the facility is under construction Headwalls have been utilized to minimize Impacts to the stream The lot till Is
necessary for the manufacturing facility expansion. Bogen has worked diligently with their civil engineer, transportation
engineers and architectural firm to design a master plan of the South Campus, utilizing land and minimizing Impacts to the
streams to the maximum extent practicable To summarize this process and to provide different layouts reviewed by
Bogen and their team, the project engineer has provided a document that outlines five (5) different conceptual plans
(Options A -E) of the South Campus and the reasons why each option is or Is not feasible Please see attached `B►ogen
Idec - Infrastructure Site Design "document provided by Peak Engineenng & Design
Furthermore, the applicant Is aware of the regional conditions associated with the Nationwide Permits 39 and 14
With respect to commercial /industrial development conditions (NWP 39- Regional Conditions section 4 0) the
applicant does not anticipate any impacts to streams or wetlands associated with stormwater facilities, there are no
impact associated with single- family recreation facilities, there are no permanent wetland or stream fills proposed
within the floodway /floodplain and the stream classification for this project is WS -V, NSW (I a not Outstanding
Resource Waters, High Quality Waters, Coastal Wetlands or wetland adjacent to these waters) With respect to
linear transportation crossings conditions (NWP 14- Regional Conditions section 4 0) this project is not proposing a
stream relocation, bank -full flows will be accommodated through the existing bank -full channel cross sectional area,
the proposed crossing is a bridge, this permit is not being used in conjunction with a NWP 18 to create an upland
area

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and
Isolated Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version
21 The draft states that many private developments are unlikely to cause cumulative impacts, including projects
such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural and
s►ivicultural operations The Biogen ldec Infrastructure Project will be the construction of a road and facility
expansion within the highly developed Research Triangle Park. Additionally, the project is located within the Wake
County's jurisdiction, therefore the adjacent properties that have potential for development will have the following
regulations to protect downstream waters. 1) the Phase 11 NPDES Stormwater Permit Program, this program
includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post -
construction stormwater management requirements, 2) Jordan Lake Watershed Riparian Buffer Protection
regulations, these regulations require limited development within the riparian buffer area in addition to "diffuse flow"
requirements at a minimum and could require Best Management Practices that control nitrogen if diffuse flow
cannot be achieved, and 3) the Water Supply, Watershed Protection Program which limits development densities
as well as requires protective riparian buffers We anticipate that the NCDWR will advise us if any additional
information is needed.

within a 2 -mile radius On August 8, 2011, the US Fish & Wildlife Service was sent a letter requesting comments or
concerns regarding the Bingen project The US Fish & Wildlife Services provided a response back on August 25,
2011 indicating the proposed project is not likely to adversely affect any federally - listed endangered or threatened
species, their formally designated critical habitat, or species currently proposed for listing under the Act, please see
attached letter

The Biogen Loop Road project proposes the construction of a new bridge, a paved sidewalk and associated fill within
the Federal Emergency Management Agency (FEMA) designated floodplain and floodway. As such the effect of
the proposed construction on flood water surface elevations, and the floodplain and floodway widths needed to be
evaluated through hydraulic analysis in the form of a flood study Various alignment options (including a series of
crossing alternatives) were evaluated for hydraulic effect and resultant water surface elevations It was determined
that a "no- rise" or `no- impact" condition was not achievable and as such a Conditional Letter of Map Revision
(CLOMR) application with supporting documentation was prepared and submitted to FEMA for review, see

If your project contains suitable habitat for any of the federally - listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect ,those species. As such, we recommend that surveys be conducted to ,determine
the species' presence or absence Within-the project area. The,use of North Carolina Natural
Heritage program data, should not he substituted for,actual field' surveys.
If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
`to adversely affect) a federally- protected,species, you should,notify this office with your
determination, the results, of your surveys, survey methodologies, and an analysis.of the effects
of the, action on .listed species, including consideration of direct, indirect, and cumulative effects,,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no 'benef cial �or adverse, direct or indirect effect) on federally
,fisted species, then you are not required to contact our office,for, concurrence,(unless an
Environmental Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps, leading to your determination of effect, the qualified, personnel
conducting the assessment, habitat conditions, site photographs, and any other related articles.
With regard to, the above - referenced project, we offer the following remarks. Our comments are
submitted pursuant to, and in accordance with, provisions of the Endangered Species Act.
Based on the information provided and other information available, it appears,that the proposed'
action is not likely to adversely affect any federally - listed endangered or threatened species, their
formally designated critical habitat, or species currently proposed for listing under the Act at
these sites. We believe that the requirements of section 7(a)(2) of-the Act have been satisfied for
your project. Please remember,that obligations under section 7 consultation must be
reconsidered if.. (1) new information reveals impacts of this identified action that may affect
listed species or critical habitat in a manner not previously considered; (2) this action is
subsequently modified in a manner,that was not considered.in this review; or, (3)� a new species
is listed, or critical habitat determined that may be affected by the identified action.
However, the Service is concerned, about the potential impacts the, proposed action might, have
on aquatic species. Aquatic resources are highly susceptible to sedimentation. Therefore, we
recommend that all practicable measures be taken to avoid adverse impacts to aquatic species,
including implementing directional boring methods and stringent sediment and erosion control
measures. An erosion and,sedimentation control plan should be,submitted to and approved by
the North,Carolina Division of Land Resources, Land Quality Section prior to construction.
Erosion and sedimentation controls should be installed and maintained between,the construction
site and any nearby down - gradient surfacewaters. In addition, we recommend maintaining
natural, vegetated buffers on all streams and creeks adjacent to the project site.
The North Carolina Wildlife Resources Commission,has developed a Guidance Memorandum (a,
copy can be found �on our, websiteaat (http: / /www,.�fws.gov /raleigh) to address.and mitigate
secondary and cumulative impacts to aquatic and terrestrial wildlife resources and water quality.
We recommend that you consider this document in the development of your projects and in
completing an initiation package for consultation (if necessary).

To determine the changes in flood hazards that will be caused by the proposed project, we compared the hydraulic modeling reflecting the proposed
project (referred to as the proposed conditions model) to the hydraulic modelmg,used to prepare,the Flood Insurance Study (FIS)'(referred to,as the
effective model). If the effectivelmodel does not provide enough detail to evaluate the effects of the proposed project, an existing conditions model must

Pursuant to our meeting with the NC Division of Water Resources and US Army Corps of
Engineers concerning the aforementioned project, I have attached, a number of the original concept plans
for the new office, manufacturing, warehouse, utilities, parking and other expansion options for the
property. These sketches were produced using the interior operations of the manufacturing facilities, size
of the warehouse and other site amenities (utility areas) as the guide for the layouts
Summary:
Biogen Idec 'is expanding their operations in North Carolina and the ability to manufacture additional
products in this market is a priority- for Biogen Idec. The proposed manufacturing, expansion on the 160+
acre property includes state -of -the -art manufacturing; warehouse, storage, QA /QC and electrical
'infrastructure facilities. The new facilities will require major'utility relocations; including water, sewer,
gas, electric, telephone and communications; building adjustment and modifeations; and roadway
infrastructure.
The following,five exhibits show the different options which were explored and refined to minimize
environmental impacts, improve efficiency within the manufacturing, storage and shipping operations,
reduce the overall site footprint and provide for the long -term viability of the RTP site as a world -class
operation for the company. We feel that we have settled on the best layout for,the site which avoided a
majority of the jurisdictional wet] andslarid streams on the 160+ acre property and minimized. impacts in.the
areas,which were unavoidable

OPTION A
Option A is the final layout that was agreed to by Biogen Idec and the design team for a number reasons:
- Minimization of impacts to Feature `Q' by a reduction in the loading area NE of the manufacturing
building
- Manufacturing building interior configuration adjusted to "narrow" the building, therefore reducing
impacts to Feature `Q'
- Grouping of the electrical infrastructure (two red buildings) NE of manufacturing with no
environmental impacts
Excellent access from the existing Biogen Idec on -site infrastructure north of the shipping and
receiving areas with no impact to environmental areas
- Direct connection (interior) from the shipping & receiving area to warehouse /cold storage and the
construction of a main "spine" from manufacturing to QA /QC with no impacts
- No environmental impacts with the future parking deck construction east of the utility areas
- Future lab (QA /QC) building within the "courtyard concept" associated with non - manufacturing
functions on the property
- One long -term electrical infrastructure location with no environmental impacts
- Storm water BMP locations shown north of the parking and utility area — good locations to capture
a majority of the property
** All other layouts will reference OPTION A to explain why this is the best option for the site,
environmental and building aspects.

Option B is one of the interim layouts created to assess the multiple utility yard concept and was rejected
for a number of reasons:
The impact to Feature `Q' was increased by 25' NE of the manufacturing building
The roadway was swung farther north to allow the long, narrow manufacturing building to settle
into the area encompassing Feature `Q'
The connection from the manufacturing area was not shown on this layout — requiring a 20' shift
NE to accommodate the internal employee movement — pushing the access road further NE,
requiring additional impacts to Feature `Q'
This option would require a larger outdoor area NE of the manufacturing building for storage and
access locations.
Having two separate utility service areas was rejected due to the amount of secondary utility
coordination and the larger access are needed NW of the manufacturing building for utility services
and maintenance (although none of the options would require impacts for the utility yards)
- The layout still has excellent access to the manufacturing, shipping & receiving and warehouse /cold
storage areas
- The future parking deck east of utility area is shown with no environmental impacts for construction
- Future lab (QA /QC) building within the future "courtyard" area associated with non - manufacturing
functions on the property
- Storm water BMPs shown in good locations to treat a majority of the impervious areas for the
new projects

OPTION C
Option C was completed using the original building — wider than the final configuration (Option A):
- This layout showed the widest building for the manufacturing facilities. This building pushes the
NE corner further into Feature `Q'.
- The roadway was swung farther north to allow the wider manufacturing building to still have access
to the service road
- The connection from the manufacturing area was not shown on this layout — requiring a 20' shift
NE to accommodate the internal employee movement — pushing the access road further NE and
creating additional Feature `Q' impacts.
- Having two separate utility service areas was rejected due to the amount of secondary utility
coordination and the larger access are needed NW of the manufacturing building for utility services
and maintenance

Option D utilized a portion of the existing surface parking lot wedged between utilities, QA /QC and
manufacturing:
- This layout rotated the manufacturing building 90 degrees to Option A. This layout attempted to
salvage the existing utility yard (located between manufacturing and the surface parking area). The
access road shifted further NE to increase impacts on Feature `Q'.
- The access road was swung farther north to provide clearance around the NE corner of the
manufacturing building
- Saving a small portion of the existing surface parking lot would not cover the need for a future
parking structure for employees and contractors to the site
- The manufacturing is completely separated from QA /QC and the new utility yards — unacceptable
to Biogen Idec and the manufacturing process.
- Having two separate utility service areas was rejected due to the amount of secondary utility
coordination
- The layout still has excellent access to the manufacturing, shipping & receiving and warehouse /cold
storage areas
- Future lab (QA /QC) building within the future "courtyard" area associated with non - manufacturing
functions on the property (but are now completely disconnected)
- Storm water BMPs are still shown in good locations to treat a majority of the impervious areas for
the new projects

OPTION E
Option E went completely outside the box to look at alternate locations for manufacturing:
Although this layout would reduce — not eliminate — environmental impacts to Feature `Q', the SE
shift in manufacturing would create new impacts in the NW corner of manufacturing to Feature `1',
an important/perennial stream and one of the major environmental areas on the property.
Avoidance of Feature `1' has always been a paramount concern for the environmental planning for
the property. Avoidance of this channel is clear in the current Loop Road designs which avoid
Feature `I' completely and all attempts should be made to continue with this avoidance.
This layout attempted to coordinate the manufacturing with QA /QC while cutting if off from
warehouse /shipping/storage. Unacceptable to Biogen Idec.
- No roadway connection is made between the warehouse facility (blue) and the QA /QC and
contractor area east of the large manufacturing building. Again unacceptable.
- The access road was pulled closer to the utility yard and terminated at that yard. No access is
shown on the north side of manufacturing — not fully representing the impacts to the Feature `1' and
the buffers.
- Future parking deck east of manufacturing is shown with no environmental impacts for construction
- A single large utility area is important to Biogen Idec, but not so important as to separate
manufacturing from shipping & receiving and warehouse & cold storage areas
- The layout still has excellent access to the manufacturing, shipping & receiving and warehouse /cold
storage areas for deliveries from the site.
- Storm water BMPs are shown but some movement will be required to avoid large cuts or fills,
retaining walls and other structure devices.
