I am writing in response to your inquiries regarding the limits set forth in the
draft NPDES permit for Teledyne Allvac. On November 14, 1989, you met with
members of my staff to discuss the possibility of using a different stream flow
for this facility's wasteload allocation. You emphasized that Teledyne Allvac's
discharge is based on rainfall and does not discharge during low flow condi-
tions. However, North Carolina Administrative Code Section 15 NCAC 2B.0206
(a)(2) states "toxic substance standards to protect aquatic life from chronic
toxicity will be protected using the 7Q10 flow". The use of alternative flow
strategies are not provided for in the case of the discharge of toxic sub-
stances.
During this meeting it also came to light that the United States Geological Sur-
vey (USGS) used a different methodology for estimating the 7Q10 for the City of
Monroe's discharge to Richardson Creek, approximately 2.5 miles downstream of
Teledyne Allvac's discharge. The USGS flow estimates for the location where
Teledyne discharges give a drainage area of 53 square miles with a 7Q10 equal to
0.15 cfs, therefore producing a yield 7Q10 flow estimate of 0.003 cfs runoff per
square mile. The USGS flow estimates for the location where Monroe discharges
give a drainage area of 71.7 square miles with a 7Q10 equal to 0.43 cfs.
Consequently, the 7Q10 yield flow estimate at this location is 0.006 cfs runoff
per square mile. The flow estimates for the USGS station at Monroe's discharge
location were developed from a partial record gaging station downstream of the
treatment plant. Flows measured at this site include the effluent flow from
Monroe's discharge which generates the higher 7Q10 yield. The yield flow on

Richardson Creek where the Monroe Plant discharges should equal the yield flow
on Richardson Creek where Teledyne Allvac discharges since there are no major
tributaries entering the stream between the two sites. The difference in yield
flows promoted concern that Teledyne Allvac was not being treated equally in the
analysis to develop water quality limits. You felt that Teledyne Allvac's
wasteload allocation should be based on the same yield estimate as the alloca-
tion for the City of Monroe. USGS agreed to comply with your suggestion that
the flow estimates at the Teledyne Allvac discharge location change to reflect
the higher yield estimates at the Monroe discharge. Therefore, the 7Q10 at
Teledyne Allvac's discharge point was changed to 0.32 cfs.
Subsequent discussions between USGS and DEM staff revealed that considerable
uncertainty remains regarding actual 7Q10 conditions in Richardson Creek. In
light of this uncertainty, DEM will proceed to Permit Teledyne's discharge using
a 7Q10 of 0.32 cfs. However, instream flow studies will be required of the com-
pany in order to more accurately establish a design streamflow for use in the
wasteload allocation: Accordingly your NPDES permit limitation will revised as
follows:

Monthly effluent monitoring for Copper & Zinc.
The discharge shall not cause the receiving water's temperature to exceed
2.8 degrees Celsius above background and in no case cause it to exceed 32
degrees Celsius.
Instream monitoring for Nickel will be required above and below the outfall
location on Richardson Creek. The upstream monitoring location shall be 100
feet above the discharge outfall (or nearby accessible location) and the
downstream monitoring location shall be at some point upstream of State
Route 1751 (- 0.3 mile below outfall) and below the outfall on Richardson
Creek. The instream measurements shall be taken on a monthly basis during
the winter months (November through May) and weekly during the summer months
(June through October).
A special condition will be included in the permit to read as follows:
Due to the presence of an impoundment structure which has no minimum release
requirement upstream of the permittee's discharge outfall, both the Division
of Environmental Management (DEM) and the USGS Office in North Carolina are
uncertain about actual low flow conditions that partially dictate water
quality in the receiving stream. Therefore, the permitteeshallproceed to
develop a partial flow record at an appropriate location upstream of their
discharge outfall to provide data for verification of low flow statistics.
The permittee shall submit a plan to the Technical Support Branch of DEM for
approval within 90 days of the date of permit issuance detailing the methods
and schedule for flow measurement. The methods shall be consistent with
guidance detailed in the DEM document, "Procedures for Projecting Low Flow
Statistics At An Ungaged Site". Based upon the results of these flow
studies, DEM reserves the right to modify, or revoke and reissue, the sub-
ject NPDES permit to incorporate revised limitations and or monitoring
requirements if deemed necessary to protect the subject water quality in the
receiving stream. (See attached flow study procedures and final draft permit
requirements.)
Given that the impoundment above Teledyne Allvac's discharge location regulates
the flow in Richardson Creek, frequent flow measurements will be needed to accu-
rately characterize low flow conditions. Therefore, it is recommended that your
study plan contain provisions for weekly flow measurements (instantaneous) taken
throughout the summer months (June through October) of 1990. The need for
measurement beyond this tisne'scale shall be.based on the outcome of these ini-
tial measurements.
I hope that this letter adequately addresses your concerns. However, if the
above decisions are unacceptable to you, you have the right to an adjudicatory
hearing upon written request within thirty (30) days following receipt of this
letter. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office
of Administrative Hearings, Post Office Drawer 11666, Raleigh, North Carolina
27604. Unless such a request is made, this decision is final and binding.

Dear Ms. Harris:
This letter and attachments are a follow—up to our telephone conversations
of the last several days. During our meeting on Tuesday, November 14,
1989, and subsequent to that time, we have obtained additional information
which I believe should be considered. It was very interesting to learn
from Ms. Carla Sanderson that the recent renewal of the City of Monroe's
permit was based on an appreciably higher flow estimate than our draft has
been upon. We recognize that this discharge is downstream of us, but the
distance is not that significant. It is our opinion that it is reasonable
to expect that the same methodology should be used in estimating our
stream flow as was used for Monroe but recognizing that the estimate should
be reduced proportional to our reduced drainage basin.
Based on Ms. Sanderson's information, it is our understanding that
Monroe's waste load allocation was based on an estimated 7Q10 of .006 cfs/
square mile or .43 cfs for their 71.7 square mile drainage area. If we
are to be evaluated with equivalent consideration, it is reasonable to
expect that our estimated 7Q10 should be .32 cfs for our 53 square mile
drainage area (.006 cfs/square mile x 53 square miles).
This would certainly seem to be supported as being at least conservative
based on the attached publication ''Water —Supply Characteristics of North
Carolina Streams by G.C. Goddard, Jr., Geological Survey Water —Supply
Paper 1761." Please note on page 203 that the estimated 7Q10 on
Richardson Creek at site No. 2A1251.81 is .005 cfs/square mile and that
this site is well upstream of our location with a drainage area of only
33.5 square miles.
Further, it is interesting to note the discrepancy between the estimated
7Q10 for site No. 2A1253.1 established in this publication versus the
estimate used in determining our waste load allocation. The estimate used
in our case was .005 cfs/square mile which is considerably less than the
published value of .008 cfs/square mile for the identical location. Why
should there be such a discrepancy when it appears the same flow measure—
ments were utilized?

We ask that you recognize that we are only asking for equal consideration
and that the published data supports the use of a conservative estimate of
.006 cfs/square mile for our location (.32 cfs).
Also, I trust that at our meeting the information (flow reports, etc.)
presented adequately explained that, by the nature of our facilities, we
do not discharge under 7Q10 conditions or for that matter anything close
to drought conditions. In fact, during periods of drought we can not
recycle sufficient water from our ponds to meet our evaporative losses
(evaporation from contact and non —contact cooling of superheated metal)
and must augment our needs with city water.
Therefore, it is not reasonable to base our limitations on a highest
monthly average discharge versus lowest stream flow conditions. If we
must be evaluated based on 7Q10 conditions, then surely we should use a
more realistic discharge flow. We could argue that it is more realistic
to use the minimum monthly average flow since this would be the closest to
representing discharge rates at 7Q10 conditions. We would be content to
use a conservative evaluation using the monthly average flow. Based on the
attached summary, this would be .0492 MGD or .076 cfs.
As noted in the first paragraph of the second page of the director's let—
ter dated October 30, 1989, it is clearly within the discretion of the
Division to use "other established modeling techniques and corresponding
flow criteria for the determination of waste load allocations for toxic
substances...if it can be shown to the satisfaction of the director that
such action provides appropriate protection of aquatic life."
We ask that you consider that the information provided clearly satisfies
this requirement and should allow a more reasonable but still conservative
procedure whereby we are evaluated using an estimated 7Q10 flow of .32 cfs
and an average monthly discharge of .0492 MGD. As such, our limitation
for nickel should be:
Ni = (.32 cfs + .076 cfs) X .088 mq/L Ni = .459 mg/L
.076 cfs
Please review this information with Mr. Overcash, Mr. Stockton, Ms. Sanderson
and any others as appropriate. Please understand that we are not asking
for special treatment as much as we are asking for reasonable and equal
treatment.
Whereas the director's letter requires our official response by the first
of December, we ask that you do everything possible to help us resolve
this matter quickly or, if that is not possible, extend the time we have
been allowed. I am sure that you will agree that it is to everyone's best
interest to resolve this matter without an adjudicatory hearing if this is
at all possible.

ments concerning the new limitations for the draft permits are addressed below
by facility:
1) NC0004642 - Bakers Plant
A wasteload allocation analysis performed in December, 1988, for the
renewal of the Teledyne Allvac-Bakers Plant NPDES Permit considered two
new sources of wasteflow. Contact cooling water and crucible cleaning
water were added to the existing non -contact cooling water discharge.
These two new types of wastewater required new limitations and monitoring
requirements in addition to the limitations for non -contact cooling water.
Since Teledyne Allvac proposes to eliminate the two new sources of
wastewater from their discharge, the NPDES permit will be drafted with
limitations for non -contact cooling water.
2) NC0045993 - Monroe Plant
A wasteload allocation analysis performed in February, 1989, for the
renewal of Teledyne Alvac-Monroe Plant's NPDES permit produced new, more
stringent effluent limitations for nickel and fluoride. The limits for
nickel and fluoride reflected an instream analysis using the 7Q10 (7-day
low flow in 10 years). The limits in the existing permit reflected limits
from an instream analysis using the 30Q2 (30-day low flow in 2 years). In
accordance with regulation 15NCAC 2B .0206 (a) (3), the flow criterion when
determining wasteload allocations for toxic substances shall be the 7Q10.

This regulation also states that "other established modelling techniques and
corresponding flow criteria for the determination of wasteload allocations
for toxic substances may be approved if it can be shown to the satisfaction
of the director that such action provides appropriate protection of aquatic
life".
The Division of Environmental Management (DEM) appreciates your company's
concern with the new limitations for nickel and fluoride. However, DEM
will not at this time reallocate these limits using the average stream
flow as you have requested. Although you contend that your discharge is
influenced by rainfall and during drought conditions (or 7Q10) there is
essentially no discharge, the Monroe plant's effluent data (from April, 1988
to April, 1989) indicate that a discharge occurs almost everyday. Unless
you can correlate the design stream flow with your own effluent design flow
and show that the discharge only occurs during certain stream flow periods,
we cannot use a different flow criteria for the determination of your permit
limits. Please contact Mr. Trevor Clements of my water quality staff should
you decide to further pursue this matter. However, effective October 1, of
this year a revised stream standard of 88 ug/1 for nickel applies to class C
streams. In light of the new standard, your effluent limit for nickel will
be revised to 157 ug/1 as the maximum allowable daily concentration.
I hope that this letter adequately addresses your concerns. However, if the
above decisions are unacceptable to you, you have the right to an adjudicatory

Dear Arthur:
In my letter to you dated April 10, 1989, I requested time to assess
conditions at the subject facilities before proceeding with permit
issuance. During this time, I have reviewed our situation and would
like to present the following observations and request for modifications
to the draft permits:
1) NC0004642 — Bakers Plant
a. The current draft permit would require considerably more moni—
toring and would add effluent limitations which are not required
in our existing permit. The existing permit requirements were
less stringent, primarily due to the fact that our wastewater
consisted of cooling tower blowdown, non —contact cooling water
and filter backwash. The filters remove debris from water being
recirculated from the cooling pond as non —contact cooling water
and do not employ any chemical or biological treatment
processes.
With the application for renewal, we noted that in addition to
the above, we had two (2) additional sources of wastewater....
contact cooling water and crucible cleaning water with the
"addition" of these sources, our wastewater ceased to be consid—
ered as applicable to the standard effluent limitations and mon—
itoring requirements for cooling water dischargers.
To remedy this, we propose to eliminate these sources of waste—
water from our discharge. This can be accomplished rather eas—
ily by making minor modifications to existing pipes, etc. to
reuse this low volume of water in the makeup of other plant

processes which have no discharge to surface waters. These mod-
ifications will be completed such that the contact cooling water
and crucible cleaning water will be eliminated from the cooling
pond by no later than June 20, 198(J.
With this accomplished, the nature of our wastewater will be the
same as it was when previously permitted and should be consid-
ered as subject to the effluent limitations and monitoring
requirements for cooling water dischargers. The significance of
this change is an obvious benefit to us in that it. should
result in an annual savings in monitoring costs (lab costs, man-
power, etc.) of approximately $5,000.
We believe that this effort is in everyone's best interest in
that it is an obvious economic benefit to us while, at the same
time, it eliminates the source of possible pollutants that were
of concern.
In recognition of our commitment to remove these wastewater
sources by June 20, 1989, we request that the subject permit be
issued with the standard requirements for cooling water
dischargers and thus eliminate the proposal monitoring require-
ments and limitations for nickel, fluoride, oil and grease,
iron, zinc and chronic toxicity.
2) NC0045993 - Monroe Plant
The proposed new effluent limitations for nickel and fluoride
are considerably more stringent than those contained in our
existing permit. 0f particular concern is the proposed limit
for nickel. Attachment 'A' is a summary of our in-house sam-
pling results for nickel and fluoride in our effluent. Please
note that these tests were performed by our own laboratory and
although we are confident of their accuracy, our lab is not
certified. We share this with you for your information only.
As can be seen from these results, although our nickel concentra-
tions are relatively low, we would expect to have difficulty
complying with the proposed nickel limit. Because of this, we
request that you reconsider the appropriateness of this
limitation.
The proposed limitation is based on modeling our discharge into
Richardson Creek at USGS projected 7Q10 low flow conditions.
Although this is the normal procedure for developing limits, we
believe it is unreasonably restrictive for our particular
discharge. �w
Our wastewater treatment facilities are essentially two (2)', '
large (several acres) cooling ponds in series. We recycle a
large volume of water from the ponds as cooling water. The

nature of our business is such that it demands considerable vol-
umes of cooling water. During drought conditions, when there is
insufficient water in the ponds to meet this demand, we must
augment this supply with water purchased from the City. Under
these drought conditions, there is no overflow from the ponds
and thus, no discharge to surface waters.
Discharge from the ponds occurs during conditions of ground
saturation which correspond to wet weather conditions. The
overflow/discharge very closely corresponds to rainfall
conditions. When there is a significant rainfall, the overflow
increases. When rainfall is non-existent, overflow greatly
.decreases. When there are drought conditions, our overflow
ceases.
As such, we can not discharge to the receiving stream under 7Q10
conditions. As described in the preceding paragraph, our dis-
charge occurs under normal or average climatological conditions.
As such, the condition of the receiving stream when receiving
our discharge should likewise be average.
In recognition of this, we request that you modify the proposed
limitations in the draft permit either by assigning limits for
nickel and fluoride based on average stream flow conditions or
eliminate these limitations entirely. This request is made in
keeping with the provisions of NCAC Title 15, chapter 2, sub-
chapter 2B, section .0206 (a) (3) which provides that other flow
criteria may be used in instances which maintain adequate pro-
tection for aquatic life, etc.
To assist you in your review, I have enclosed copies of our past
monitoring reports which should help in understanding how our
discharge, or lack thereof, corresponds to weather conditions.

Flow meter installed 4/26/88
Flow meter down for repair 6/17-21/88 and 4/1-3/89 — No readings taken
During period of 4/26/88 — 4/30/89, there were 351 days when flow
measurements we•'e taken. During this period there were 36 days when
no flow was discharged. This is 10% of the time no discharge
occurred.
During this 12 months, there were periods of no discharge occurring
during five (5) of the months. Four (4) times there were periods of
no discharge for five (5) or more consecutive days.
The meter was repaired in April '89 (4/1-3/89). Since this time there
have been 66 days of no reported flow out of a total of 184 days when
flow was measured (period of 5/1-10/31/89. This is 36% of the time no
discharge occurred. During this period, there were six (6) occasions
when there were periods of no discharge for five (5) or more consecu—
tive days.
