Dear Mr. Coyle:
In accordance with your application for discharge permit received on March 10, 1997 by the
Division, we are forwarding herewith the subject permit to discharge under the subject state - NPDES
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1
and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection
Agency dated December 6, 1983 and as subsequently amended.
Summarized changes to the permit are:
• The Supplement to Cover page description of treatment units was updated.
• Requirements for BOD5, Total Suspended Solids, NH3, Fecal Coliform, Temperature, and pH
were changed per updated .0500 regulations regarding minimum monitoring frequencies for all
facilities throughout North Carolina.
• A Total Residual Chlorine footnote was added to monitor for chlorine only if it is used and the
limit was changed from 53.0 to 28 µg/1 to protect for acute toxicity in the receiving stream.
Per this permits requirement to continually evaluate alternatives to wastewater discharges (Part III,
D.) the Division hereby requests that the facility submit a report evaluating the cost effectiveness of
operating the present system versus connecting to the proposed Glens at Grandfather sewer system. A
guidance document is enclosed. Please submit the report in triplicate within 180 days of receipt of this
permit. The report should be mailed to Mr. David Goodrich at the address below. Also, as previously
requested of you by Mr. Joseph Yoder of Glens at Grandfather, please submit (in writing) your intention to
connect to the proposed system.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this letter. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, Post Office Drawer 27447, Raleigh, North Carolina 2761 1-7447. Unless such demand is
made, this decision shall be final and binding.
Please take notice that this permit is not transferable except after notice to the Division of Water
Quality. Part II, E.4. addresses the requirements to be followed in case of change in ownership or
control of this discharge. The Division of Water Quality may require modification or revocation and
reissuance of the permit.

by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area

In compliance with the provision of North Carolina General Statute 143-215.1,
other lawful standards and regulations promulgated and adopted by the North Carolina
Environmental Management Commission, and the Federal Water Pollution Control Act, as

is hereby authorized to discharge wastewater from a facility located at
Adams Apple Racquet Club
NC Highway 105
southeast of Banner Elk
Avery County
to receiving waters designated as the Watauga River in the Watauga River Basin
in accordance with effluent limitations, monitoring requirements, and other conditions set forth in
Parts I, II, III, and IV hereof.
This permit shall become effective November 1, 1997.
This permit and authorization to discharge shall expire at midnight on September 30, 2002.

SUPPLEMENT TO PERMIT COVER SHEET
Adams Apple Homeowners Association
is hereby authorized to:
1. Continue to operate an existing 0.020 MGD wastewater treatment package plant consisting of a
bar screen, aeration basin, clarifier with sludge return, tablet chlorinator, contact basin,
dechlorination, flow meter and cascade aerator located at Adams Apple Racquet Club, NC
Highway 105, southeast of Banner Elk, Avery County (See Part III of this Permit), and
2. Discharge from said treatment works at the location specified on the attached map into the
Watauga River which is classified Class B-Trout HQW waters in the Watauga River Basin.

The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units and shall be monitored weekly at the effluent by grab

SR 12/3/92 Facility was proposing to install effluent dechlor and a recording and totalizing meter.
Existing permit requests an ATC be submitted for them. No ATC in files, but facility has
listed on their application that they are installed. Plans were to be submitted to ARO by 1/1/95
Updated the Sup to Cover sheet.
Added TRC monitoring footnote to effluent limits page.
Instream monitoring and effluent DO monitoring are not required per WLA.
Recommend renewal of NPDES permit with the above changes.
