This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983 and as subsequently amended. Summarized changes to the permit are: • The Supplement to Cover page description of treatment units was updated. • Requirements for BOD5, Total Suspended Solids, NH3, Fecal Coliform, Temperature, and pH were changed per updated .0500 regulations regarding minimum monitoring frequencies for all facilities throughout North Carolina. • A Total Residual Chlorine footnote was added to monitor for chlorine only if it is used and the limit was changed from 53.0 to 28 µg/1 to protect for acute toxicity in the receiving stream. Per this permits requirement to continually evaluate alternatives to wastewater discharges (Part III, D.) the Division hereby requests that the facility submit a report evaluating the cost effectiveness of operating the present system versus connecting to the proposed Glens at Grandfather sewer system. A guidance document is enclosed. Please submit the report in triplicate within 180 days of receipt of this permit. The report should be mailed to Mr. David Goodrich at the address below. Also, as previously requested of you by Mr. Joseph Yoder of Glens at Grandfather, please submit (in writing) your intention to connect to the proposed system. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 2761 1-7447. Unless such demand is made, this decision shall be final and binding. Please take notice that this permit is not transferable except after notice to the Division of Water Quality. Part II, E.4. addresses the requirements to be followed in case of change in ownership or control of this discharge.
