As discussed in the pre -application meeting, the Division acknowledges that the application was submitted as incomplete. To enable us to complete our review in accordance with 15A NCAC 02H .1206, we hereby request the following additional or revised information: 1. Mountaire Compliance: The Division requests that Mountaire be put under a compliance schedule or a consent order and provide a timeline for when that will be enacted. Mountaire must identify the causes of the non-compliance and provide to the Town and the Division a list of actions that they will take to address the identified issues, with a firm timeline. Additionally, the Division requests a firm timeline, which does not exceed the timeline provided in the issued permit, for when the Town will be undertaking the interim actions for Mountaire's compliance as stated in the application, including for the proposed pretreatment permit modification. 2. Water Treatment Plant Compliance: The Division requests that the Town secure a rental agreement or purchase sludge handling equipment to ensure that the solids at the plant can be adequately removed and disposed of when land application is not an option until the permanent sludge handling solution can be constructed. Please provide a timeline for the acquisition and set-up of the portable sludge handling equipment. Additionally, the application stated that the sludge removal frequency would be increasing. Please provide the current frequency of sludge removal and the new increased frequency of sludge removal. Wastewater Treatment Plant Compliance: The Division requests a firm timeline for when the Town will be setting up the portable belt press and when the additional aeration equipment will be installed, along with the exact number of new aerators being added to the plant and the estimated cost of the new equipment. 4. I&I Reduction: Please provide the funding source for the Main Interceptor Replacement Project that was stated in the application. Additionally, the Division requests that the Town provide an estimated timeline for the Interceptor Replacement and Blood Run Pump Station Relocation Project. 5. Independent Evaluation Report: The Division requests, as part of the application, a complete report prepared by an independent professional with expertise in wastewater treatment. This report must include all of the items detailed in Section V of the SOC application. 6. Funding Sources: Please provide a summary table documenting all funding sources the Town is receiving and which projects/improvements the funds will be allocated to. In addition, this letter serves to acknowledge receipt of your application for a Special Order by Consent (SOC), accompanied by your check number 029980 in the amount of $400.00. These items were received in our office on September 14, 2022. If no response is received within 60 calendar days [per 15A NCAC 02H .1206 (a) (4)] regarding the requested information detailed above, the application will be returned and the Division's review discontinued. A new application would need to be submitted, revised to address the deficiencies noted above, with a new processing fee to renew the request for an Order.
