A review of the June 2022 and May 2022 Non -Discharge Monitoring Reports (NDMR) for the subject facility
revealed the violation(s) indicated below:

Turbidity value of 15.41 NTUS was entered in three consecutive NDMRs for the same day, April, May and June 7. MRO
Staff addressed the April 7, 2022, BIMS violation as "No Action, BPJ — Reclaimed Water System. Flow is diverted to 5-day
pond for retreatment when Turbidity is >10 NTU." However, the three repeats indicate a potential data reporting issue that
warrants investigation.
The Mooresville Regional Office was not properly notified in accordance with Permit condition IV.11.d., which requires
Non -Compliance Notification as soon as possible..."Any time self -monitoring indicates the facilities permitted herein have
gone out of compliance with the limitations contained in this permit."
Remedial actions, if not already implemented, should be taken to correct any noted problems. The Division of
Water Resources may pursue enforcement actions for this and any additional violations. If the violations are of a
continuing nature, not related to operation and/or maintenance problems, and you anticipate remedial
construction activities, then you may wish to consider applying for a Special Order by Consent (SOC).
A written response is requested by October 17th, 2022, with an explanation of replicated Turbidity
data, steps taken to correct exceedances, missing parameters and reporting of future
Non -Compliance issues. The response should also include corrected NDMRs and supporting
laboratory or computer collected data.
