Hi Kelsey,
Thank you again for all the help! Below I have provided all the
information you requested in our previous phone conversation.
I met with Joshua Brigham with the state prior to moving the house on
the lot. I had a plot plan with the house on it however there were no
decks/porches on the plot plan. I built the side deck (the one that's
potentially encroaching) 4'x8' with treated lumber. The deck only goes
into the riparian buffer roughly 4 to 6 square feet.

Dear Mr. Parrish:
On 8/17/22, the Division of Water Resources (Division)
received your application requesting a Buffer
Authorization from the Division for the subject
project. The Division has determined that your
application is incomplete and cannot be processed. The
application is on -hold until all of the following
information is received:
1. In the Proposed Activity section of the
application, please provide a purpose
statement for the side porch in the riparian
buffer and the materials used/ nature of the
deck. For example, is it covered? You may
also provide photographs to supplement
the purpose statement.

2. The Impacts Table in Section C (Proposed
Impacts Inventory) does not include the
Zone 2 impacts of the section of the side
porch shown on the survey map. Please
calculate the square footage of the porch in
the buffer zone and include it in the buffer
impact table.
3. Please include more information in the
project description (Section 3) about why
this activity was submitted for a buffer
authorization after -the -fact.
4. Please provide a copy of the stream
determination in Section 5b.
5. Aerial imagery of the property appears to
show a retaining wall within the buffer. Are
there any buffer impacts not accounted for
in this application?
Pursuant to Title 15A NCAC 02B .0611, the applicant
shall furnish all of the above requested information for
the proper consideration of the application. Please
respond via email within 30 calendar days with a copy
of all of the above requested information.
If all of the requested information is not received within
30 calendar days of receipt of this email, the Division
will be unable to approve the application and it will be
denied as incomplete. The denial of this project will
necessitate reapplication to the Division for approval,
including a complete application package.
Please be aware that you have no authorization under
the Rules for this activity and any work done within
waters of the state or the regulated riparian buffer may
be a violation of North Carolina General Statutes and
Administrative Code.
