HomeMy WebLinkAbout20140928 Ver 1_Meeting to discuss transferring 401 permits_20141103Meeting to discuss transferring 401 permits from NCDOT to Town of Granite Quarry October 23, 2014 Attendees: Amy Euliss -NCDOT Derek Goddard -BREC PA Scott Shelton -Rowan Works (EDC) Bill Feather - Granit Quarry Justin Price - Granite Quarry Stephanie Braquet -NCDOT Michael Hedrick -NCDOT Sue Homewood- NCDWR Dave Wanucha -NCDWR Amy Chapman -NCDWR The meeting started off with discussions regarding transferring the 404 from NCDOT to Granite Quarry. Both Amy Euliss and Derek Goddard have talked with John Thomas with the Corps. Granite Quarry will need to submit a letter to the Corps to request that the permit is transferred. Granite Quarry will need to discuss mitigation requirements with the Corps directly. Sue Homewood asked why Granite Quarry may not be required to pay mitigation. NCDOT was required to pay mitigation, because the Corps looks at DOT impacts cumulatively for the state. Since Granite Quarry will be a different applicant, the mitigation may not be required. Amy Euliss will contact EEP directly and see if the mitigation has already been paid, and if the money can get reimbursed to the DOT. The discussion moved onto stormwater requirements. Sue Homewood asked if Granite Quarry or Rowan County was reviewing stormwater plans under the Phase II requirements. Bill Feather said that DENR (DEMLR) is reviewing the Phase II plans. Sue Homewood asked if the stormwater for the Gildan development had been reviewed by DEMLR. The consensus was yes. Derek Goddard has talked with Mike Randall, DEMLR, regarding the Phase II requirements for the access road. Derek Goddard reported that Mike Randall said that linear transportation projects could utilize NCDOT's stormwater BMP manual. Sue Homewood also spoke with Mike Randall. There was a lot of discussion about whether the project was considered a linear transportation project. The project as presented is access to a private development. Sue Homewood advised that Granite Quarry discuss with Mike Randall whether the project is a linear transportation project or an access for the Gildan development to determine if Granite Quarry can use NCDOTs BMP manual to meet the stormwater requirements for Phase II. Sue Homewood advised Granite Quarry that the purpose and need needs to be the same for the 401 and the stormwater review. If the purpose and need changes, the permit application will need to be revised. Derek Goddard will coordinate with Mike Randall regarding the stormwater review and requirements. Once an approved stormwater plan is received, Granite Quarry will need to notify Sue Homewood of the changes for compliance with the 401. Amy Euliss noted that there were specific conditions to NCDOT in the 401 that will need to be modified. Sue Homewood said that the conditions will need to be called out to be changed when Granite Quarry submits the request to transfer ownership and permit modification. Amy Euliss stressed that NCDOT wanted to be removed of all responsibilities of the permit. She also asked if Granite Quarry understood the responsibility of complying with the conditions of the 404 /401 /stormwater permits in perpetuity. Bill Feather said that yes they understood the requirements. There was discussion about the approval of the erosion control plan. Amy Euliss spoke with Phil Suggs, NCDOT Roadside Environmental earlier in the week. If NCDOT is acting as the contractor, DOT believes that DEMLR needs to approve the erosion control plan. Derek Goddard had spoken with Patrick Grogan, DENR, earlier in the week. Derek plans to submit the plans to the DEMLR express review. Project timeline was discussed. Derek Goddard stated that he has concerns with waiting until after the winter to begin construction. Granite Quarry and RowanWorks seemed to share the concerns. Amy Euliss reiterated NCDOTs concerns with starting the work in the winter, and concerns about increased costs to the project with maintaining the erosion control measures in the winter. Derek Goddard asked Sue Homewood if she had a preference with the type of pipe used at permit site 1. The original pipe proposed was an aluminum arch pipe. The project has been redesigned to include 3 pipes, with one low flow and two floodplain pipes. Amy Euliss stated that NCDOT had concerns with installation and maintenance of the pipe and procuring the pipe. Derek Goddard stated that they preferred the aluminum pipes. Sue Homewood said she didn't have an issue with either design as long as floodplains were provided to prevent stream overwidening. Action items: Amy Euliss to follow up with EEP regarding mitigation payment Derek Goddard will proceed with discussing the stormwater issue with DEMLR. He will also proceed with taking the necessary steps to get the permit transferred from NCDOT to Granite Quarry.
