Skvarla, III Governor Director Secretary To: Doug Huggett, Major Permit Coordinator, Division of Coastal Management Through: Amy Adams, Assistant Supervisor Water Quality Section, Washington Regional Officeo From: Anthony Scarbraugh, Environmental Senior Specialist A Subject: Objection to Modification request of DWR Project No. 12-1020 (LAMA Major Permit No.11-13) Duck Creek Dock Project Date: October 14, 2013 On November 16, 2012, Foster's Seafood was issued a 401 Certification and Tar-Pamlico Buffer Authorization under DWR No. 12-1020 for the construction of 3-100 foot long piers, 100 foot breakwater, bulkhead replacement, and installation of 8' by 290' boardwalk to be used as a staging area for crabbing operations. This Office received a request from Mr. Ernest F. Foster of Forest's Seafood to modification the 401 Certification and Buffer Authorization as follows: 1. Extend the existing 8' wide boardwalk 24' to the southern side of the existing boat ramp. 2. Cover the proposed and existing 8' wide overland dock with a roof measuring 12' wide by 42' Inna 3. Construct a 7' wide by 42' long access deck situated perpendicular to the existing overland dock. 4. Beaufort County Duck Creek On 16 January 2013 Fosters Seafood was issued CAMA Major Permit No. I I-13 for the construction of a bulkhead, three piers, upland dock/boardwalk, driveway maintenance and repair of an existing boat ramp located off SR 1358 at 70 Captain Tom Drive near the City of Washington in Beaufort County. Mr. E. Floyd Foster has requested that the permit be modified as follows: 1. Extend the existing 8' wide boardwalk 24' to the southern side of the existing boat ramp. 2. Cover the proposed and existing 8' wide overland dock with a roof measuring 12' wide by 42' long. 3. Construct a 7' wide by 42' long access deck situated perpendicular to existing overland dock. 4. Park 2 semi van trailers (8' by 46') on southern end of dock for holding crabs as well as storage. 5. Construct a 7' by 36' deck next to van trailers for access. 6. Construct a 7' by 36' deck for a future building. All of the development is proposed within the N.C. Division of Water Resources 50' Tar-Pamlico Riparian Buffer. Additionally, no development is proposed within Public Trust Area of Duck Creek with the exception of the overhang of the dock roof. The upland development activities are within the Public Trust Shoreline Area of Environmental Concern. This office is routing this modification request to the US Army Corps of Engineers, NC Division of Water Quality, Wildlife Resources Commission and the Fisheries Resources Specialist in DCM. Please provide comments back to Doug Huggett, Major Permit Coordinator in the Morehead City Headquarters by I I September 2013.
