Rt.1, Box 270 Banner Elk, North Carolina 28604 Dear Mr. Schwebke: 77PciriA �EHNFi September 29, 1997 Subject: NPDES Permit Issuance Permit No. NC0062961 Shoppes of Tynecastle WWTP Avery County In accordance with your application for discharge permit received on March 20, 1997 by the Division, we are forwarding herewith the subject permit to discharge under the subject state - NPDES permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983 and as subsequently amended. Summarized changes to the permit are: • The Supplement to Cover page description of treatment units was updated. • Requirements for BOD5, Total Suspended Solids, NH3, Fecal Coliform, Temperature, pH and Total Residual Chlorine were changed per updated .0500 regulations regarding minimum monitoring frequencies for all facilities throughout North Carolina. Per this permits requirement to continually evaluate alternatives to wastewater discharges (Part III, D.) the Division hereby requests that the facility submit a report evaluating the cost effectiveness of operating the present system versus connecting to the regional sewer system. A guidance document is enclosed. Please submit the report, in triplicate, within 180 days of the effective date of the permit to Mr. David Goodrich at the address below. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding. Please take notice that this permit is not transferable except after notice to the Division of Water Quality. Part II, E.4. addresses the requirements to be followed in case of change in ownership or control of this discharge. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required.
