Dear Mr. Cottom:
The Division of Water Quality (the Division or DWQ) hereby issues the attached NPDES permit for the subject
facility. We issue this permit pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated
October 15, 2007, or as subsequently amended.
The Division understands you have made no relevant changes in your facility since last renewal. We have
therefore updated the permit considering your monthly discharge monitoring reports (DMRs) and compliance
history, and have updated your facility description and site map. We have also added parameters codes to
Sections A. (1.) for your convenience.
If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable, you
have the right to an adjudicatory hearing, upon written request submitted within thirty (30) days after receiving
this letter. Your request must take the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes, and you must file it with the office of Administrative Hearings, 6714 Mail Service
Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made, this permit shall be final and
binding.
This permit is not transferable except after notifying the Division of Water Quality. The Division may require
permit modification, or revocation and re -issuance. Please note that this permit does not affect your legal
obligation to obtain other permits required by the Division of Water Quality, the Division of Land Resources,
the Coastal Area Management Act, or other federal or local governments.

to receiving waters designated as Valley Creek in the Watauga River Basin in accordance with effluent
limitations, monitoring requirements, and other conditions set forth in Parts I, II, III and IV hereof.
This permit shall become effective, January 1, 2013.
This permit and authorization to discharge shall expire at midnight on September 30, 2017.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this issuance, any previously issued permit bearing this number is no longer effective.
Therefore, the exclusive authority to operate and discharge from this facility arises under the permit
conditions, requirements, terms, and provisions included herein.
Hawksnest Utilities, Inc.
is hereby authorized to:
1. continue to operate an existing 0.01 MGD wastewater treatment system utilizing:
• influent holding tank
♦ bar screen
♦ aeration basin
♦ clarifier with sludge return
+ aerated sludge holding tank
• tablet chlorinator with chlorine -contact chamber
♦ dechlorination
• re -aeration chamber
these facilities located at the Valley Creek WWTP offNCSR 1151 near Foscoe in Watauga County.
2. after receiving an Authorization to Construct (ATC) permit from the Division of Water Quality,
including the Division's approval of the Permittee's justification for the need to expand the plant to
0.900 MGD, and upon receiving Authorization to Operate from the Division of Water Quality,
3. discharge from said treatment works via Outfall 001, a location specified on the attached map,
into Valley Creek [Stream Segment 8-4], a waterbody currently classified C-Trout waters within
subbasin 04-02-01 of the Watauga River Basin.
