This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated December 6, 1983. The following items must be addressed within the time frame specified below: • Plans and specifications and a request for an Authorization to Construct for the installation of a suitable flow measuring device must be submitted within 90 days. The new flow meter must be installed within 180 days after permit reissuance. Plans and specifications and a request for an Authorization to Construct for the installation of a pumping system and relocation of the wastewater influent holding tank must be submitted within 90 days of permit reissuance. The wastewater influent holding tank must be relocated and the new piping and/or pumps must be installed within 180 days after permit reissuance. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding. Please take notice this permit is not transferable. Part II, E.4. addresses the requirements to be followed in case of change in ownership or control of this discharge. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other Federal or Local governmental permit that may be required. (3) . Authorization to Construct Requirement The Permittee must get an authorization to construct from the Division of Water Quality prior to upgrading the treatment facility to 0.90 MGD. DIVISION OF WATER QUALITY April 15, 1997 MEMORANDUM TO: File FROM: Jeff Myhra DATE: April 15, 1997 SUBJECT: Permit file review for Hawksnest Utilities, Inc. (NC0058891) Facility Information: Qw = 0.01 MGD Valley Creek 04-02-01 Stream Class: Valley Creek Class: C-TR Date: 7-1-73 Index No. 8-4 Facility is currently permitted for a maximum plant capacity of 0.01 MGD. The facility has requested an expansion to 0.9 MGD, but to date an authorization to construct has not been issued for this expansion. DMR Data Review (1997, 1996, and 1995 DMR data was reviewed). It appears that the facility is currently operating within the specifications of the permit except for the violations identified below: • BOD violation January 1997. Monthly average reported was 48.10 mg/1 (limit is 30.0 mg/1) BOD violation January 1996. Monthly average reported was 37.10 mg/1 (limit is 30.0 mg/1) • Compliance sampling inspection was performed by Beth Morton and Jenny Rankin on February 20, 1997. Results confirmed that the facility was in compliance except for the following issues (Region recommends that the following issues be addresses at the time of permit renewal): • The flow meter is broken. A portable meter was on site which has a broken flow recorder chart. Plans and specification and a request for an A to C review for the installation of a suitable flow measuring device must be submitted within 90 days of permit renewal. The flow meter must be installed within 180 days after permit renewal. • A notice of deficiency (NOD) was sent out in reference to the existing operation of the wastewater influent holding tank (see staff report for more details). Plans and specification and a request for an A to C review for the installation of a pumping system and relocation of the wastewater influent holding tanks must be submitted within 90 days of permit renewal. (NC0058891) Page 2 of 2 wastewater influent holding tank must be relocated and new piping and/or pumps to prevent freezing must be installed within 180 days after permit renewal. • Staff report was prepared by Beth Morton on 4-7-97. • The current treatment capacity is 0.01 MGD. The existing system consists of a wastewater influent holding tank, bar screen, aeration basin, clarifier with sludge return, aeration sludge holding, tablet chlorinator, chlorine contact chamber and reaeration. • The Region requests that the requirement to monitor for oil and grease be dropped in the permit renewal. DMR data indicates that this parameter is not a problem. • Region stated that Jackie Nowell recommended that when Valley Creek expands to 0.035 MGD (Although file review did not reveal any information in reference to expansion to 0.035 MGD), the permit should allow the permittee a choice of ammonia limits of 5 mg/1 (summer) and 14 mg/1 (winter) or a chronic toxicity limit of 18%. The current permit does not address these issues. Permit renewal has ammonia limits developed from mass balance calculation for both flow of 0.01 MGD and 0.09 MGD. • Facility is classified as a Class 11 facility. • Most recent WLA was prepared on 1-23-89 by Jackie Nowell. • Request to expand the treatment facility to 0.9 MGD was denied. Letter dated June 30, 1989 stated after public hearing held on May 25, 1989, it was determined that request will be denied because of the temperature increase in the receiving stream due to the increased discharge flow. • Memo prepared by Ruth Clarkgdated June 7, 1989 states that the discharge of 0.9 MGD has a high probability that it will change the instream temperature by more than 0.5°C at 7Q10 conditions. This facility has not been built either. WSRO took Watauga County from Asheville Regional Office in 1992. Our records are not complete regarding the events prior to 1992. The facility chooses ammonia rather than toxicity testing. The facility will need a compliance schedule to meet ammonia Hidden Valley, Inc. Special monitoring or limitations (including toxicity) requests: We request that the oil and grease monitoring be removed from the permit. The analyses for oil and grease indicate no problems. Per our files, Jackie Nowell recommended that when Valley Creek expands to 0.035 MGD, the permit should allow the permittee a choice of NH3-N limits of 5 mg/1(Summer) and 14 mg/1(Winter) or a chronic toxicity limit of 18%. (7Q10 flow =0.3) The current permit does not include or address these limits. 3. Important SOC, JOC or Compliance Schedule dates: (Please indicate). None 4. Other Special Items: NONE PART IV - EVALUATION AND RECOMMENDATIONS The last compliance sampling inspection found several deficiencies that need to be addressed by the new permit. 1) The flow meter is broken. A portable meter was on site, which had a flow recorder chart that was broken. Plans and Specifications and a request for Authorization to Construct for the installation of a suitable flow measuring device must be submitted within 90 days of reissuance. The new flow meter must be installed within 180 days after reissuance. 2) The wastewater influent holding tank must pump the wastewater a considerable distance to the treatment plant. The current system consists of an old underground storage tank with pumps exposed to the elements located on top of the tank. In the winter, the pumps freeze and surges of wastewater are discharged to the plant which are septic. The Permittee has responded to our Notice of Deficiency (NOD) by proposing to move the holding tank to the wastewater plant and to install new pumps/piping to prevent freezing. Plans and Specifications and a request for Authorization to Construct for the installation of a pumping system and relocation of the wastewater influent holding tank must be submitted within 90 days of permit reissuance. The wastewater influent holding tank must be relocated and new piping and/or pumps must be installed within 180 days after permit reissuance.
