In no case shall the temperature of the effluent cause the ambient water temperature to exceed 32°C. Page 3 of 8 Permit NC0035904 A. (2.) CHRONIC TOXICITY PERMIT LIMIT (Quarterly) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 67 %. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised December 2010, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised- December 2010) or subsequent versions. The tests will be performed during the months of January, April, July and October. These months signify the first month of each three-month toxicity testing quarter assigned to the facility. Effluent sampling for this testing must be obtained during representative effluent discharge and shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -December 2010) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B. for the pass/fail results and TIIP3B for the Chronic Value. Additionally, DWR Form AT-3 (original) is to be sent to the following address: Attention: North Carolina Division of Water Resources Water Sciences Section/Aquatic Toxicology Branch 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Water Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Water Sciences Section at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Assessment of toxicity compliance is based on the toxicity testing quarter, which is the three month time interval that begins on the first day of the month in which toxicity testing is required by this permit and continues until the final day of the third month. Page 4 of 8 Permit NC0035904 A. (2.) CHRONIC TOXICITY PERMIT LIMIT (Quarterly), continued Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Resources indicate potential impacts to the receiving stream, this permit may be re- opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. A(3.) MERCURY MINIMIZATION PLAN (MMP). The permittee shall develop and implement a mercury minimization plan during this permit term. The MMP shall be developed within 180 days of the NPDES Permit Effective Date, and shall be available for inspection on -site. A sample MMP was developed through a stakeholder review process and has been placed on the Division website for guidance (http://portal.ncdenr.orweb/wq/swp/ps/npdes, under Model Mercury Minimization Plan). The MMP should place emphasis on identification of mercury contributors and goals for reduction. Results shall be summarized and submitted with the next permit renewal. Page 5 of 8 Permit NC0035904 A. (4.) ELECTRONIC REPORTING OF DISCHARGE MONITORING REPORTS Proposed federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and specify that, if a state does not establish a system to receive such submittals, then permittees must submit DMRs electronically to the Environmental Protection Agency (EPA). The Division anticipates that these regulations will be adopted and is beginning implementation in late 2013. NOTE: This special condition supplements or supersedes the following sections within Part II of this permit (Standard Conditions for NPDES Permits): • Section B. (11.) • Section D. (2.) • Section D. (6.) • Section E. (5.) Signatory Requirements Reporting Records Retention Monitoring Reports 1. Reporting [Supersedes Section D. (2.) and Section E. (5.) (a)l Beginning no later than 270 days from the effective date of this permit, the permittee shall begin reporting discharge monitoring data electronically using the NC DWR's Electronic Discharge Monitoring Report (eDMR) internet application. Monitoring results obtained during the previous month(s) shall be summarized for each month and submitted electronically using eDMR. The eDMR system allows permitted facilities to enter monitoring data and submit DMRs electronically using the internet. Until such time that the state's eDMR application is compliant with EPA's Cross -Media Electronic Reporting Regulation (CROMERR), permittees will be required to submit all discharge monitoring data to the state electronically using eDMR and will be required to complete the eDMR submission by printing, signing, and submitting one signed original and a copy of the computer printed eDMR to the following address: NC DENR / DWR / Information Processing Unit A l'I ENTION: Central Files / eDMR 1617 Mail Service Center Raleigh, North Carolina 27699-1617 If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility being physically located in an area where less than 10 percent of the households have broadband access, then a temporary waiver from the NPDES electronic reporting requirements may be granted and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1.1, 2, 3) or alternative forms approved by the Director. Duplicate signed copies shall be submitted to the mailing address above. Requests for temporary waivers from the NPDES electronic reporting requirements must be submitted in writing to the Division for written approval at least sixty (60) days prior to the date the facility would be required under this permit to begin using eDMR. Temporary waivers shall be valid for twelve (12) months and shall thereupon expire. At such time, DMRs shall be submitted electronically to the Division unless the permittee re -applies for and is granted a new temporary waiver by the Division. Page 6 of 8 Permit NC0035904 A. (4.) ELECTRONIC REPORTING OF DISCHARGE MONITORING REPORTS, continued Information on eDMR and application for a temporary waiver from the NPDES electronic reporting requirements is found on the following web page: http://portal.ncdenr.org/web/wq/admin/bog/ipu/edmr Regardless of the submission method, the first DMR is due on the last day of the month following the issuance of the permit or in the case of a new facility, on the last day of the month following the commencement of discharge. 2. Signatory Requirements 1Supplements Section B. (11.) (b) and supersedes Section B. (11.) (d)1 All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part II, Section B. (11.)(a) or by a duly authorized representative of that person as described in Part II, Section B. (11.)(b). A person, and not a position, must be delegated signatory authority for eDMR reporting purposes. For eDMR submissions, the person signing and submitting the DMR must obtain an eDMR user account and login credentials to access the eDMR system. For more information on North Carolina's eDMR system, registering for eDMR and obtaining an eDMR user account, please visit the following web page: http://portal.ncdenr.org/web/wq/admin/bog/ipu/edmr Certification. Expedited permits are generally simple 100% domestics (e.g., schools, mobile home parks, etc) that can be administratively renewed with minor changes, but can include facilities with more complex issues (Special Conditions, 303(d) listed water, toxicity testing, instream monitoring, compliance concerns). Yes; see attached summary Does permit have Special Conditions? Added eDMR condition Does permit have instream monitoring? Yes Is the stream impaired (on 303(d) list)? No Any obvious compliance concerns? No Any permit mods since last permit? No Current expiration date 7/31/2014 New expiration date 7/31/2019 Comments received on Draft Permit? No When the permit was originally issued, it had 5 outfalls (domestic, filter backwash, cooling water, boiler blowdown and oil storage). Around 1990 the outfalls were combined into one, larger outfall. It is unclear if effluent monitoring for conductivity and instream monitoring for conductivity and fecal coliform are holdovers from that time. However, current policies typically do not call for instream monitoring for fecal unless the discharge is to B waters or the receiving stream is impaired for fecal coliform (neither condition applies). Conductivity monitoring is seen more typically in industrial discharges. It is not required of our general permits for cooling water and boiler blowdown and it is not a part of the WTP permitting strategy except for RO and IE WTPs. McCain's is neither. Effluent conductivity is typically around 500 pmohs (higher than that monitored in streams within the basin, but typical of wastewater or drinking water). These parameters probably should have been removed before; they are removed from the draft. The permit has been given an annual average mercury limit per the current statewide TMDL permitting strategy. The final version has been updated to include a condition requiring a mercury minimization plan per the strategy. The facility doesn't fit neatly in the categories set in the strategy (it's neither municipal nor industrial), but since it's in the Lumber basin, had Hg monitoring, and circumstances require adding a WQBEL limit, the MMP seems like reasonable condition to add, and it shouldn't be a great burden on the facility. 7/25/14 WQS = 12 ng/L MERCURY WQBEL/TBEL EVALUATION V:2013-5 Facility Name: McCain Correctional Hospital FALSE No MMP Required Total Mercury 1631E PQL = 0.5 ng/L 7010s = 0.150 cfs Date Modifier Data Entry Value Permitted Flow = 0.200 WQBEL = 17,81 ng/L 47 ng/L 4/9/2009 7/7/2009 10/14/2009 1/26/2010 4/6/2010 7/7/2010 10/5/2010 3/9/2011 4/5/2011 7/6/2011 11/9/2011 1/11/2012 5/10/2012 7/12/2012 10/18/2012 2/14/2013 5/16/2013 8/22/2013 11/7/2013 2/6/2014 5/8/2014 7.99 57.7 54.6 34.7 16.9 13.9 40.3 62.3 9.98 62.2 9.76 16.3 4.86 4.2 5.2 1.95 6.33 4.06 6.25 10.3 3.99 7.99 57.7 54.6 34.7 16.9 13.9 40.3 62.3 9.98 62.2 9.76 16.3 4.86 4.2 5.2 1.95 6.33 4.06 6.25 10.3 3.99 WQBEL< 40.1 ng/L - Annual Average for 2009 WQBEL< 26.5 ng/L - Annual Average for 2010 WQBEL< 36.1 ng/L - Annual Average for 2011 7.6 ng/L - Annual Average for 2012 4.6 ng/L - Annual Average for 2013 7.1 ng/L - Annual Average for 2014 Whole Effluent Toxicity Testing and Self Monitoring Summary Corning Inc. -Midland Fiber Facility NC0086169/003 County: Cabarrus Region: MRO Basin: YAD12 Jan Apr Jul Oct SOC_JOC: Ceri7dPF Begin: 5/1/2014 chr lim: 1.0%; pf and NonComp: Single 7010: 30 PF: 0.107 IWC: 1.0 Freq: Q J F M A M l J A S 0 N D 2009 Pass * * Pass * * Pass * * Pass * 2010 Pass * * Pass * * Pass * * Pass * * 2011 Pass * * Pass * * Pass * * Pass * 2012 Pass • * Pass * * Pass * * Pass • * 2013 Pass * * Pass * * Pass * * Pass * 2014 Pass * Pass * * * * * • * Correc, Dept Of (Caledonia) NC0027626/001 County: Halifax Region: RRO Basin: ROAOB Jan Apr Jul Oct SOC_JOC: Fthd24PF Begin: 10/1/1997 24hr p/f ac lim: 90% f + NonComp: Single 7Q10: 1000 PF: 0.5 IWC: 0.08 Freq: Q J F M A M J J A S 0 N D 2009 Pass * * Pass * * Pass * * Pass * 2010 Pass * * Pass * * Pass * * Pass * 2011 Pass * * Pass * * Pass * * Pass * 2012 Pass * * Pass * * Pass * * Pass * 2013 Pass * * Pass * * Pass * * Pass * * 2014 Pass * * Pass * * * * * * * * Correc, Dept Of (McCain Hospital-001) NC0035904/001 County: Hoke Ceri7dPF Begin: 8/1/2009 chr lim: 67% NonComp: Single Region: FRO 7Q10: J 2009 Pass 2010 Pass 2011 Pass 2012 Pass 2013 Pass 2014 Pass 0.15 F • • • Basin: LUM50 Jan Apr Jul Oct PF: 0.20 IWC: 67.4 Freq: Q M A M J J A * Pass * * Pass * Pass * * Pass * * Pass * * Pass * * Pass * * Pass * * Pass * * Pass * * Pass * * * SOC_JOC: 0 Pass Pass Pass Pass Pass N D • * • » • • * Cousins Real Estate -Gateway Village NC0086517/001 County: Mecklenberg Region: MRO Basin: CTB34 Jan Apr Jul Oct SOC_JOC: Ceri7dPF Begin: 1/1/2012 chr lim: 90% NonComp: Single 7Q10: 0 PF: 0.050 IWC: 100 Freq: Q J F M A M J l A S 0 N D 2009 H * * H * * H * ' H * * 2010 H " * H * * * r H • * 2011 H * * H * * H * • H * * 2012 Pass * * Fail <45 <45 Fail <45 <45 Fail <45 <45 2013 Pass * * Pass * * Pass * * Fail >100 >100 2014 Pass * * Pass * * * * • * • • Page 34 of 145 AFFIDAVIT OF PUBLICATION NORTH CAROLINA Cumberland County Public Notice Ninth Carolina Environmental Management Commission/NPDES 11 rri 1617 Mail Service Canter Rnkigh. INSTREAM MONITORING POLICY Historical Approach. It has been the NPDES policy to generally include instream monitoring (i.e., upstream, downstream) for DO, Temperature, fecal coliform, and conductivity whenever modeling results indicated the potential for a discharge to reduce the minimum downstream dissolved oxygen levels to within 1.0 mg/I of the state water quality standard (6.0 mg/I for Trout or 5.0 mg/1 for non -Trout waters). Revised 1999 Policy for 100% Domestic Wastewater Dischargers. Authority is delegated to the NPDES Supervisor to add or delete any or all instream monitoring requirements. Instream monitoring for fecal coliform and conductivity may not be necessary for 100% domestic wastewater discharges. Conductivity is a parameter better suited for measuring the impact of inorganic wastes, and in many cases, instream fecal coliform data can be difficult or impossible to interpret. These instream monitoring parameters are also not required by EPA. Beginning in 1999, instream monitoring for fecal coliform and conductivity will not be included in NPDES permits for 100% domestic dischargers, unless the receiving stream is listed on the North Carolina 1998 303(d) list as an impaired waterbody for fecal coliform bacteria. Not for 100% domestic only for Muni w complex waste stream or Industrial users. Defining Instream Monitoring Locations. When reviewing results of a model, examine the dissolved oxygen (DO) levels in the stream profile. If the minimum DO concentration (DO sag) occurs elsewhere downstream than at the discharge point, and the predicted minimum DO concentration is within 1.0 mg/1 of the appropriate stream standard, instream monitoring is normally recommended. When recommending instream monitoring for a facility, downstream monitoring should be specified as close to the predicted DO sag as possible. Example 1: A discharge to a Trout stream is modeled and the following stream profile results. In this case, the DO sag occurs at the discharge point, and the stream assimilates the waste readily. Although about 100 feet downstream the DO is still within 1.0 mg/1 of the standard, no DO sag is apparent downstream, so no instream monitoring would be recommended. Those facilities that are required to collect instream data will submit the data as part of their monthly DMRs. This data is not available electronically and must be retrieved from Central Files. The permit writer should review this data during permit renewals, looking for any trends between the upstream and downstream stations. Some points to consider are: • Make sure the instream data looks reliable. Lack of variation in temperature and D.O. between summer and winter periods generally indicates that data are not being properly collected. Stream temperatures vary from the single digits in winter to upwards of 25 °C in summer, while DO values may range from double digits in winter to approximately 7 mg/l in summer. If data looks questionable, discuss with the Regional Office and note any potential monitoring problems in the permit cover letter to the permittee. • If data appears reasonable, compare DO levels between upstream and downstream stations to see if there are any trends indicating the discharge is depleting oxygen downstream. Special attention should be given to those facilities that are affecting the downstream DO to the point of causing instream DO violations. This indicates that the stream is over -allocated, and a more intensive examination of the limits given for oxygen -consuming wastes (BOD, NH3) should be made. In addition, a bigger picture evaluation of all dischargers within this stream segment may be warranted. • Since conductivity is a measure of inorganic pollution, this evaluation should be limited to looking for major trends. This same comparison should be made for fecal coliform data. Please note that it is not unusual to have fecal counts > 200/100 ml in an unimpacted stream. Also note that the water quality standard for fecal coliform is a geometric mean of at least five sampling events during a 30- consecutive day period. Therefore, one fecal value >200/100 ml is not a contravention of the standard. Wilson, Environmental Engineer NPDES Unit Subject: Guidance Regarding Conductivity and Fecal Coliform Monitoring INSTREAM CONDUCTIVITY AND FECAL COLIFORM MONITORING GUIDANCE Fecal coliform monitoring: Instream monitoring for fecal coliform may be removed from municipal or domestic wastewater permits (major or minor), unless the water body is impaired due to coliform or is a Class B waterbody. Conductivity monitoring: Instream monitoring for conductivity may be removed from all 100% domestic wastewater permits. Instream conductivity monitoring must remain for industrial discharges and domestic discharges that have a pretreatment program.
