Dear Mr. Evans:
This Office received a telephone call from you on January 19, 1999
concerning foam in Pole Cat Creek. Mr. Alan Johnson of this Office conducted a
complaint investigation on January 20, 1999. During the investigation Mr. Johnson
did observe "foam" in the creek. The foaming occurred as the water in the creek
passed through a section of "rapids", but dissipated soon thereafter. Given the fact
that the foaming in the stream was minimal and observed in other streams in the area,
it appears to be a natural occurrence.
Based on our investigation, no futher action is deemed necessary at this time.

It was observed that your lagoon had been breeched. Upon Mr. Johnson's review of the site, he
found no observable impact to the waters of the State. You may wish to contact your local Soil
and Water District representative to develop a plan to properly close out the lagoon.
Please be advised that North Carolina General Statutes provide for penalties of up to $10,000 per

REPORT:
On May 8, 1997, this Office received an anonymous complaint concerning a dam to a lagoon
which had breeched at Don Kerr's swine facility. It was not sure when this occurred or the
contents of the lagoon. The complaint was referred to Water Quality by Tom Ward of the Union
County Health Department.
Mr. Johnson contacted the Natural Resource Conservation Service concerning Mr. Kerr and was
informed that he had been out of business for some time. Mr. Johnson investigated the site on
May 12, 1997. Mr. Johnson did find the lagoon, and noted that it had been breeched. In speaking
to Mr. Kerr, the breeching was done under controlled measures over a year earlier. There was
some waste.still in the lagoon and an adjoining "pond". However, should any discharge occur, it
would stay within the confines of the immediate area. There was no observable potential for any
impact to a stream or other waters of the State.

This letter is in follow-up to an investigation conducted on
December 27, 1995, by Mr. Roberto L. Scheller of this Office.
The Investigation was in response to a complaint received on
December 11,.1995. According to the complaint, hogs had free
access to a creek, potentially creating a water quality problem.
An inspection of the subject creek found no evidence of hogs
in the creek.

REPORT: On December 27, 1995, Mr. Roberto L. SCheller.of this'
office conducted an investigation of an animal complaint located
off Hwy 84. The investigation was in response to a complaint
received in this Office on December 11, 1995. The complainant
reported that approximately 30 swine were in the creek creating a
water quality problem.
A thorough inspection of the swine pasture and the subject
creek found no swine 'in the creek or evidences of them being in
the creek. The pasture fence runs along the creek bank and
prevents the swine from entering the creek. Mr. Mike Watts was
present during the investigation and stated that they -are working
with Union County Soil Conservation Service (SCS) to implement
buffer zones along the subject creek. It was noted during the
investigation that beavers had dammed the subject creek and
raised the water level.

It was apparent from the investigation that Mr. Broome, the
owner, is striving to comply with the North Carolina
Administrative Code (NCAC) 2H .0200 regulations regarding animal
operations. No violation of the .0200 regulations was evident at
the time of the investigation. Therefore, no further action on
this subject is deemed necessary.

On July 18 and24, 1991 this O-ffice conducted an investigation
concerning the possible discharge of wastewater from your swine."
farms located on SR 1956 (Musselwhite Rd.) and SR 1955 (Nash Rd.).
The investigation revealed that no discharges wereoccurring at
the time of inspection. A waste management system has been approved
by the SCS District,.however, the funds for construction have not
been released because of the possibility that industrial waste had
been discharged into the lagoons. However, the Union County Health
Department advised that there was no proof that industrial waste
was deposited into the lagoons. A TCLP analysis, as reportedby
Phil Loudermilk, SCS District Conservationist, revealed that the
manure showed no Hazardous characteristics for metals (see
enclosure)-. You stated that the practice of transferring manure
from one swine farm to another byseptage hauler had been ceased.
Please note that any discharge of wastewater to the surface
waters of the state could result in the Designation of the subject"
animal operations as Concentrated Animal Feedlot Operations (CAFO).
Any discharge from a CAFO is a violation. of, G.S. 143-215.1.
Such violations could result in civil penalties of up to $10,000•
per violation.
In order to help assure that discharges will not occur, it is
recommended that atleast two (2) feetof freeboard be maintained
in, the lagoons..

REPORT:
On July 22, 1991 this office received a' complaint concerning
the possible discharge of animal waste from the Dennis Rape Swine
Farm located on SR 1955. Mr. Kim H. Colson investigated the
complaint on July 24, 1991.
The swine parlors that were in use were,connected to a lagoon
with a solid set irrigation system. The lagoon appeared to have
adequate freeboard to prevent a discharge from a storm event of
less severe than a 25 year, 24 hour storm.
Some minor spillage was noted adjacent to the sump. The
spillage appeared to have occurred when trash was pulled out of
sump. The previous owner of the farm had apparently dumped trash
into the sump.
The creek below the swine farm did not have any flow at the
time of inspection.
No further investigation by this Office should be necessary at
this time.

REPORT:
On July 16,-1991 this officereceived a complaint concerning
the possible discharge of animal waste from the Dennis Rape Swine
Farm located on SR 1956. Mr. Kim H. Colson investigated the
complaint on July 18, 1991.`
The lagoon appeared to haveoverflowed into a pasture.
However, it did not appear that any wastewater was reaching surface
waters. The creek below the pasture did not have any flow at the
time of inspection. Mr. Rape had not land applied any waste, thus
allowing the lagoon to overflow, because he was awaiting
construction of a solid set wastewater irrigation system.
The Soil Conservation District has not released cost share
funds for the system because industrial wastehadbeen rumored to
be deposited into the lagoon by -a septage hauler. According to the
Union County Health Department, the waste may have contained heavy
metals, but there was no proof any industrial waste had been
discharged into the lagoon.A TCLP analysis of the manure in the
lagoon, as reported by Mr. Phil Loudermilk, SCS District
Conservationist, did not reveal any Hazardous Waste characteristics
for metals. Mr. Rape stated that the practice of transferring swine
manure fromonefarm to another has been ceased.
Once the waste management facilities are constructed, the
operation should be able to adequately handle the animal waste.

REPORT: On February 23, 1996, Mr. Roberto L. Scheller of this
office conducted an investigation of an animal complaint located
off Hargette Road. The investigation was in response to a
complaint received in this Office on February 21, 1996. The
complainant reported that the water -in a nearby creek was pink.
An inspection of the subject creek found evidence of animal
waste being discharged into the creek. Further investigation
revealed that the discharge was coming from an animal waste
lagoon located off Hargette Road. The discharge was running
across a pasture area and into a ditch that flowed down gradient
into a unnamed tributary of Lanes Creek. -Mr. Broome, the owner,
was aware of the discharge and stated that piping will be
installed to irrigate a nearby pasture area with the wastewater.

Mr. Broome was advised that the discharge needed to be
stopped immediately.
The discharge is a violation of 15A NCAC (North Carolina
Administrative Code) 2H .0217, and a Notice of Violation will be
issued.
No significant impact on the aquatic environment was evident
at the time of the inspection. A follow-up investigation may be
necessary to confirm compliance.

You are hereby notified that your swine farm, Facility Number 90-48, which
has been deemed permitted to have a nondischarge permit for an animal waste
disposal system pursuant to 15A -NCAC 2H .0217, has been found to be in violation
of its 2H..0217 Permit.
An investigation of the subject facility found wastewater discharging from
the lagoon. The waste stream flowed from the lagoon across a pasture area and
into a ditch that continued down gradient. The discharge is a violation of the
Permit.
The Division of Environmental Management will proceed to revoke your
farms deemed permitted status unless the following measures are implemented:
1. Immediately eliminate the discharge of wastewater.
2. Make any modifications needed to ensure there will be no future
discharges.
It is requested that you respond in,writingto this Notice, indicating the
actions you have taken. Please address your response to Mr. Roberto L. Scheller
by no later then March 27, 1996.
Also, be advised that this.'notice does not prevent the Division of
Environment Management from taking enforcement actions for this violation or any
past or future violations.

Dear Mr. Ansite:
Enclosed is a copy of the complaint investigation report for the investigation
conducted on May 18, 1999 by Mr. Alan Johnson of this Office. The report should be
self-explanatory.
It appears that the dead fish are the result of natural causes and are not due to
animal waste applications. Mr. Johnson observed no evidence of any animal waste
having been applied on the adjoining property. Mr. Johnson also spoke with the
property owner. He informed Mr. Johnson that no application of animal waste or any
other chemical had recently been applied.
Regarding the water sample from the pond, you will be contacted as soon as the
analyis has been received. Also for your information, please find enclosed an excerpt
from the Field Manual for the Investigation of Fish Kills published by the US
Department of Interior.

covered with a thick coat of algae several weeks prior to contacting this office. On May
18, 1999 an investigation was conducted by this office. The investigator was informed
that the algae had been displaced by a heavy rain approximately two and one-half weeks
prior to the investigation. Shortly thereafter he noticed the dead fish.
Four groups of dead fish collected by the complainant were observed on the
banks of the pond. These groupings consisted of 15 to 20 large fish (12 - 20 in.) and
approximately 100 small fish. Numerous other small fish (approximately 6 in.) were
also observed dead in the pond. The complainant believed that the application of animal
waste was the cause of the dead fish. Inspection of the area and conversations with the
adjacent property owner revealed that no evidence of any waste had recently been
applied on the adjoining property. The drainage area of the adjoining property is the
"backyard" of two other residences. There is some cropland adjoining the complainant's
property, but it drains towards another pond. No further action is deemed necessary as
the kill probably resulted from an algal bloom, cause of which is unknown.

Enclosed is a copy of the lab analysis for the pond sample taken at your
residence during the investigation conducted on May 18, 1999. The "fecal" count
(highlighted) is indicative of manure, but as. stated earlier, there was no observed
evidence of any 'animal waste applicationsat the time of the investigation. The elevated
fecal reading may be due to the low pond level and low seasonal rainfall.
