Subject: Intermittent Streams/Land
Application of Animal Waste
Union County, NC
Your question concerning the application of wastewater across an inter-
mittent stream located at the Cox farm was refer back to Water Quality for a
response.
Pursuant to T15A: 02H .0217 (a)(1)(C), land application of wet waste is
__allowed as I.ng_as the -following conditions are met:
1) waste is applied at Tess than or equal to the -agronomic rate;
2) a vegetative buffer of at least 25 feet is maintained from a perennial
stream.
Also pursuant to Title 15A: 02H .0203, the definition of an animal waste
management system specifies that no discharge of pollutants by any means can
occur to waters of -the State except as the result of a rain event more'severe than a
25-year, 24-hour storm. Though the stream in question is degsignated as an
intermittent stream, it is still considered a water of the State. Thus, no discharge is
permitted.
Mr. Alan Johnson of this Office did visit the site a couple of months ago with
Joe Zimmerman of the Division of Soil and Water and Mr. Rick Pigg, NRCS.
