Director Division of Water Quality WATER QUALITY SECTION July 18, 2002 Jim Johnson 1403 Waxhaw Marvin Rd Marvin, NC 28173 Subject: Confined Feeding Operatons NCGS 143-215.1 Dear Mr. Johnson: North Carolina General Statute 143-215.10B states that feed lots and animal operations with 100 head of cattle that utilize a wet waste system are required to be permitted by the state. Wet system refers to animal operations such as dairies that use waste storage ponds or lagoons. Pasture operations do not fall under this statute. In contrast, EPA animal regulations establish the threshold number at 1000 head of cattle. Their rules also include a condition that no forage is produced by the operation.
