REPORT: On March 5, 1996, Mr. Roberto L. Scheller of this
office conducted an investigation of an animal complaint located
off Jim Parker Road. The investigation was in response to a
complaint received in this Office on February 29, 1996. The
complainant reported the possibility of chicken litter in a
nearby creek.
A thorough inspection of the subject chicken farm and creek
found no evidence of chicken manure in the creek. The field
where the chicken manure is applied is separated from the creek
by a wooded buffer. Mr. Steve Birmingham, the operator of the
chicken farm, stated that the chicken houses are cleaned out
every 2-3 months. The chicken litter is land applied to a nearby
field at agronomic rates.

The subject creek is an unnamed tributary to Twelve Mile

- Temperature 13° Celsius
- Dissolved Oxygen (DO) 8.5 mg/1
- pH 7.17 s.u.
- There was no evidence of chicken litter in or around
creek.
It was apparent from the investigation that Mr. Birmingham
is striving to comply with the North Carolina Administrative Code
(NCAC) 2H .0200 regulations regarding animal operations. No
violation of the .0200 regulations was evident at the time of the
investigation. Therefore, no further action on this subject is
deemed necessary.
