Klimek, P.E., Director Division of Water Qiality Coleen Sullins, Deputy Director Division of Water Qiality WATER QUALITY SECTION November 6, 2003 Subject: Compost Facility Waste Allegedly Entering Pond Union County, NC Ms. Teresa Bradford with the Division of Solid Waste notified this office of your concern that contaminants from a compost facility may be entering a pond on your property. In speaking with Ms. Bradford, she informed us that the stockpiled litter (used for composting) was in excess of 400 ft. from the pond and any runoff would flow through a pasture and a wooded area. The Division of Water Quality regulation's (15A 02I-1.0217 (a) (1) (B)) states that litter from poultry operation cannot be stockpiled any closer than 100 fl. to a perennial stream. The stockpiled manure at this facility far exceeds that distance. In addition, photos of the stockpiled litter at the facility showed no physical evidence (erosion, streaks of green grass, etc.) that runoff was occurring. Be advised that the aquatic vegetation in the pond can be due to other factors. Fertilizer applications and manure from cattle grazing in the surrounding pasture would also contribute to algae and other aquatic vegetative growth in the pond. Please contact your local Agricultural Extension Agent for recommendations to control aquatic growth in ponds. Finally, because the pond is a catchment basin for the surrounding topography, and there is neither a stream entering or leaving the pond, it would not meet our criteria of surface waters for regulatory purposes. Alan J. was well aware of Mr. Travek and in fact was in the process of writing a letter to him when I called. Mr. Travek's neighbors have a permitted composting facility. Staff with Solid Waste have inspected the operation in response to Mr. Travek's complaints. The operation is in compliance with their permit. The poultry waste stockpile is approximately 700 feet from Mr. Travek's pond according to the surveyor that Mr. Travek hired (minimum required is 400'). Ifs about 45 feet higher in elevation than the creek. Solid waste staff saw no evidence that the waste was impacting the pond or the creek although Mr. Travek claims that there is a "dried crust" that runs from the stockpile to his pond. Alan Johnson agreed to make a site visit the next time that it rains heavily enough to possibly have some runoff from the stockpile to the pond or creek. Mr. Travek has been talking with Mr. Ted Lyons of NC's Waste Division (919) 733-0692 ext 253 but I have, been unable to reach Mr. Lyons and it appears that he is out of the office until late this month.
