Dear Ms Higgins and Mr Lastinger
After reviewing the Nationwide Permit 14 application submitted to the US Army Corps of Engineers (USACE)
and the NC Division of Water Resources (NCDWR) on September 22, 2014, NCDWR identified that the
proposed stream and riparian buffer impact on stream S3 will require compensatory mitigation for the
riparian buffer impacts proposed On behalf of our client, the Town of Apex, Kimley -Horn is submitting the
attached revised buffer impact table and mitigation information for replacement in the previously submitted
PCN application (Pages 7 and 8 of the PCN), as well as associated revised figures and plan sheets
Compensatory mitigation credits have been secured as required by NCDWR for impacts to riparian buffers
from EBX- sponsored mitigation banks in the watershed Based on credit availability, EBX will provide credits
from the EBX Neuse Riparian Buffer Umbrella Mitigation Bank, the Forrest Creek Riparian Buffer Mitigation
Bank, or the EBX Upper Neuse Riparian Buffer Umbrella Bank The grading plan for the roadway project has
been revised as shown on the attached plan sheet in an effort to minimize riparian buffer impacts further
Additionally, NCDWR requested clarification on the stormwater approval process for the project The
stormwater management plan Is currently under review by the Town of Apex, pending approval of the
Section 404/401 permits Once approval from the Town has been secured, a copy of the approval
documentation will be submitted to NCDWR

D. Impact Justification and Mitigation
1. Avoidance and Minimization

The proposed roadway alignment was carefully selected to minimize impacts to jurisdictional waters and riparian buffers A
large S curve was added to the alignment to faaliate perpendicular crossings of three jurisdictional features, and the road
alignment was shifted as far south as feasible to avoid impacting S1 and S2 and their buffers S1, S2, and their buffers are
only minimally impacted by the proposed alignment at the extreme upslope end of the stream systems The proposed road
will tie into existing roadway stubs on both ends to minimize new road construction overall
lb Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques
Impacts to streams within the corridor will be minimized to the extent practical throughout the construction process by avoiding
stream features wherever possible Where feasible, staging and construction access will be located in upland areas
throughout the corridor, and silt fencing will be installed around the permitted limits of distrubance to ensure all equipment is
located within the project corridor at all times near stream areas Best Management Practices (BMP) and measures will be
used to reduce stormwater impacts to receiving waters and minimze runoff from the construction sites

6h Comments Per the Neuse River Basin riparian buffer rules, road crossings of subject streams that impact greater than 40
linear feet but equal to or less than 150 linear feet or 1 /3rd of an acre of riparian buffer are "allowable" As such, no
mitigation is required for the proposed riparian buffer impacts associated with the crossing of streams S1 and S2 While
the crossing of stream S3 impacts less than 150 linear feet, the crossing exceeds the 1 /3rd of an acre threshold, and
therefore buffer mitigation is required for this crossing

Re Project: Pine Plaza Drive Roadway Project
This document confirms that Town of Apex: (Applicant) for the Pine Plaza Drive Roadway
Project (Project) has expressed an interest to utilize 40,180 Square Feet of Riparian Buffer
Mitigation Credits from either of the EBX Neuse Riparian Buffer Umbrella Mitigation Bank
(Rudolph Site and Arrington Bridge II sites) Forrest Creek Riparian Buffer Mitigation Bank, EBX
Upper Neuse Riparian Buffer Umbrella Bank (Ezell, Hatley, Cedar Grove sites) all located in the
Neuse HUC 03020201. As the Bank Sponsor for all sites, EBX attests to the fact that mitigation
is available for transfer upon permit issuance at this time.
Banker will notify applicant if the 40,180 Square Feet of Riparian Buffer Mitigation become
considered "At Risk" of not being available prior to permit issuance. Credits are not considered
secured until payment in full is received from the applicant resulting in the issuance of a and
Affidavit of Sale by the bank acknowledging that the applicant has fully secured credits from the
bank and the Banker has accepted full responsibility for the mitigation obligation requiring the
credits /units.
The Banker will issue the Affidavit of Sale within three (3) days of receipt of the Purchase Price
Banker shall provide to Applicant with a copy of the Affidavit of Sale and a documented copy of
the debit of credits from the Bank Official Credit Ledger(s) showing the permit number and the
resource type secured by the applicant. A copy of the Affidavit of Sale, with an updated Official
Credit Ledger will also be sent to regulatory agencies showing the proper documentation.
