After review of the 9-13-22 modification submittal, NCWRC supports NCDMF's position that the
project can proceed. The removal of the floating dock in water depths less than -2' NLW to be
replaced by an 18' x 6' fixed stepdown in front of the existing platform (landward the USACE
setback) reduces the impacts to aquatic resources originally proposed in the permit application.

Given the updated drawings that I distributed (attached here as well) and the current approval
provided by NCDMF I still need comments from WRC and an authorization determination from DWR.
Floating dock has been removed and a fixed pier is proposed landward of setback.

Just spoke with Jonathan on this. The design proposed by Ben Brink is not sufficient and we do not
consider there to be any mitigative value associated with it.
At this point, once NCDMF provides their comments stating significant adverse we likely proceed
with the denial.

I need an extension for this one. Patrick and I are going to take water depths to figure out is the 2'
contour is within the established pier headline. As the application is proposed, it would be an
objection from me, so we are going to see if there is an option that USACE will still approve.
We were going out today, but conditions did not turn out well, we are scheduled for 8/8 at this time.
