Division personnel have reviewed and approved your application for renewal of the
subject permit. Accordingly, we are forwarding the attached NPDES discharge permit. This
permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1
and the Memorandum of Agreement between North Carolina and the U.S. Environmental
Protection Agency dated May 9, 1994 (or as subsequently amended).
There have been no significant changes to this permit from the draft noticed November
15, 2004. Please note that the weekly average fecal conform limit has been changed to a
daily maximum limit.
If any parts, measurement frequencies or sampling requirements contained in this
permit are unacceptable to you, you have the right to an adjudicatory hearing upon written
request within thirty (30) days following receipt of this letter. This request must be in the form
of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and
filed with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North
Carolina 27699-6714. Unless such a demand is made, this permit shall be final and binding.
Please take notice that this permit is not transferable. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality
or permits required by the Division of Land Resources, Coastal Area Management Act, or any
other Federal or Local governmental permits may be required.

In compliance with the provision of North Carolina General Statute 143-215.1, other lawful
standards and regulations promulgated and adopted by the North Carolina Environmental
Management Commission, and the Federal Water Pollution Control Act, as amended,

Buckeye Creek WWTP
Hwy 221 near Knob Road
West of Blowing Rock
Watauga County
to receiving waters designated as Thunderhole Creek in the Catawba River Basin in accordance
with effluent limitations, monitoring requirements, and other conditions set forth in Parts I, II,
III and IV hereof.
This permit shall become effective March 1, 2005.
This permit and authorization to discharge shall expire at midnight on February 28, 2010.

Thunderhol Creek and it tributaries are not listed on North Carolina's 2002 303(d)
The receivinstream liste inthe application, Thunderhole Creek, is a low flow
stream at the alternate locations shown in attachment 9. USGS has submitted info
on sites where the 3092 is > 0.05 cfs. NCAC 02B. 0206 (d) (1) dictates that if a
stream has 7910 =0, and if the 3092 is greater than or equal to 0.05 cfs. then tertiary
limits, BOD = 5 mg/1. N113 =2 m.g/1, and DO = 6 mg/1 can be applied to a new
discharge. The Buckeye reek project supposedly will discharge at the point where
the summer', 7910 = 0 an 3092 = 0.06 cfs. The NPDES Unit is requesting a map that
shows the discharge poix at the positive flow segment.

ENGINEERING ALTERNATIVES ANALYSIS:
There were two subnuttals of the EAA. The second was more complete but some
information had to be c1 ed. initial land costs in the EAA were extremely high
($245, 870 pier acre) basee on nearby properties. We told the engineer that that
value was extremely high. An actual appraisal of the Buckeye Creek property (65
acres) was finally submitt d on 9/ 1 /04. Land was appraised in. Nov. 2002 at $17,200
per acre, for ja total of $1, 0 0,000. WSRO staff indicated that for NC mountain
property with potential for development, $17,000/acre:. was not unreasonable.

100% domestic. The design capacity is 49, 680 GPD based on 138 units* 3 bedrooms
each* 120 gal/bedroom = 49680 gallons.
Project being constructed in 2 phases —Phase I — 86 units * 3 BR * 120 = 30,960 GPD
Phase II — 52 units * 3 BR * 120 = 18,720 GPD

This the second submittal of the project because of insufficient information submitted for
the initial EAA.
Application Review
The new Buckeye Creek project will be located in Watauga County, NC, west of
Blowing Rock. Source of ww — will be the 138 townhouse units, 3 bedrooms per unit,@
360 GPD per unit = 49,680 GPD. No map with application. Applicant submitted a
copy of map in the EAA however the map did not show the proposed discharge point.
Email was sent to the engineer requesting a map showing the discharge point be
submitted.
Receiving Stream
The receiving stream listed in the application, Thunderhole Creek, is a low flow stream at
the alternate locations shown in attachment 9. USGS has submitted info on sites where
the 30Q2 is > 0.05 cfs. DWQ procedure dictates that if a stream has 7Q10 =0, and if the
30Q2 is greater than or equal to 0.05 cfs, then tertiary limits can be applied to a new
discharge. The Buckeye Creek project supposedly will discharge at the point where the
7Q10 = 0 and 30Q2 = 0.06 cfs. The NPDES Unit is requesting a map that shows the
discharge point at the positive flow segment.
**Attachment 19 in the package states "The unnamed tributary that we propose to
use runs into Thunderhole Creek, which runs into the Johns River and later into the
Catawba River". The 7Q10 and 30Q2 flow estimates are for Thunderhole Creek
and not for unnamed tributaries toThunderhole Creek. We need to verify where
the discharge point is going to be. This is crucial to this project since the permittee
is indicating that all other alternatives are not feasible economically or physically.

provided by USGS with the estimated 7Q10 flows. In addition, please clearly indicate on attachment 13 ( the

I have been told that your department is undermanned and the workload is heavy. I have

On March 15, 2004 I came to Raleigh and met with Teresa Rodriguez and a coworker to discuss
the submittal of the permit application for Reed Williams, and the Buckeye Creek project.
They mentioned several things that needed to be changed. I went back and made the changes.
Teresa Rodriguez had taken a two -week vacation to Italy. I waited until she was due back.
She was sick on that day I brought in the application (hand carried to NCDENR on April
23rd, 2004).
A letter dated May 12th, 2004 was sent from Charles Weaver assigning the review to Jacquelyn
Nowell, who had no previous knowledge of this project.
I called Ms. Nowell on June 1, 2004 and she stated that she had not started the review of our
application.
Since June 11 `h, 2004 I have placed five (5) messages asking her to call me and that I was
checking on the status of a client's project.
When it takes from April23rd, 2004 to June 15th, 2004 to have someone look at an application
(and this is not the first submittal), something seems to be wrong with your system.

I do not know why your organization is doing this, but I would like to know what
the status of this project and when the review will be complete.
The price of steel for this sewage plant has increased $30,000 over the last several
months.

I received the fax location map showing the points where your two
discharge
measurements were obtained on September 12, 2003 (one on Thunderhole
Creek
and a second on a tributary). Looking at the map image shown in the
attached powerpoint file (initially sent to you via email on
2/14/2003), it
appears the measurements were just upstream of Alternate location #1
(drainage area 0.08 sqmi) on Thunderhole Creek.
A review of the low -flow file for these estimates on Thunderhole Creek
indicates that I sent you last February the write-up entitled
"Determination of low -flow statistics at an ungaged site in North
Carolina
using partial -record station data.". This is the write-up that I
referred
to during our phone conversation this past Monday, but I did not
remember
that I had already sent a copy. I now have a .pdf file of this
write-up,
but I did not attached it to this email because of its size (approx 3
MB) .
But if you need another copy, I'll be glad to provide it as an
attachment
to another email (or send a hardcopy via regular mail). When I sent
the
write-up, I also included the name of the engineer that you can contact
if
you wish to obtain information about collecting streamflow data for the
purposes of assessing low -flow characteristics. His name is Mr. John
Phillips with Diehl & Phillips engineering firm in Cary, NC (919
467-9972).
In considering the efforts required to collect streamflow data, a
source of
information that may be helpful to you is the standard methods
described in
USGS Water -Supply Paper 2175, Measurement and computation of streamflow
(http://water.usgs.gov/pubs/wsp/wsp2175/). The methods described in
this
report (consists of two volumes) are those used by the USGS in its
data -collection work. In particular, pages 303-305 in volume 2 discuss

In regards to the measurements that you made last September, please
keep in
mind that these particular discharges were probably not reflective of
true
baseflow conditions, even if it had not rained for over a week. The
amount
of rain that occurred across much of North Carolina last year resulted
in
above -normal flow conditions on an almost daily basis, particularly in
the
northwest parts of the state. In Boone, rainfall totals from September
2002 through September 2003 were over 15 inches above normal during the
13-month period.
As discussed, the lowest flows typically occur in the late summer and
early
fall seasons. And if you're attempting to collect streamflow data, one
of
the ways of helping to decide when measurements should be made is to
check
the flows at several nearby continuous -record gaging stations (via
real-time flows on the USGS online pages). True base -flow conditions
occur
when flows are below the 25th-percentile for the period of record, and
7Q10
conditions are equivalent to flows in the "less than loth percentile"
range. If flows at several nearby index stations are below the 25th
percentile, that would be a flag to you in knowing that baseflow
conditions
may be also occuring at your site of interest. There are several
gaging
stations with long-term records in vicinity of Thunderhole Creek that
would
probably be useful for monitoring flows in the area: Watuaga River near
Sugar Grove (west of Boone), Linville River near Nebo (Burke County),
South
Toe River near Celo (Yancey County), and/or Yadkin River at Patterson
(Wilkes County).

Follow-up to your question concerning the location on Thunderhole Creek
headwaters where the 7Q10 low -flow estimate would be 0.05 cfs, attached
is
another Powerpoint file that contains a slide showing the second
alternate
location where the flow estimate would be of this magnitude. It
corresponds to the intersection of the stream and the longitude line
corresponding to 81d 42m 30s identified at the top of the Globe quad
map.
Measured by a straight line distance, it is equivalent to about 1,900
feet
between the initial location and alternate location #2.
