Division personnel have reviewed and approved your application for modification of the
subject permit. Accordingly, we are forwarding the attached NPDES discharge permit. This
permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1
and the Memorandum of Agreement between North Carolina and the U.S. Environmental
Protection Agency dated May 9, 1994 (or as subsequently amended).
If any parts, measurement frequencies or sampling requirements contained in this
permit are unacceptable to you, you have the right to an adjudicatory hearing upon written
request within thirty (30) days following receipt of this letter. This request must be in the form
of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and
filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The
Division may require modification or revocation and reissuance of the permit. This permit
does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, the Coastal
Area Management Act or any other Federal or Local governmental permit that may be required.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
permit conditions, requirements, terms, and provisions included herein.
EavenBrice Partnership is hereby authorized to:
1. Continue to operate an existing 0.032 MGD wastewater treatment facility with
the following components:

This facility is located at 329 Emma Road northwest of Weaverville at the

2. After obtaining an Authorization to Construct from the Division of Water Quality,
construct and operate a 0.050 MGD wastewater treatment facility.
3. Discharge from said treatment works at the location specified on the attached
map into Flat Creek, classified C waters in the French Broad River Basin.

The limit for total residual chlorine shall become effective upon completion of the installation of a
disinfection system but no later than January 1, 2007. If a method different than

Good morning Roger I hope everything is going smoothly in Asheville.
When you get a chance please let the appropriate people in each county
know that letters from here will be going out shortly addressing the 80%
/90% rule and what is to expected from each site exceeding these
thresholds. I have attached an excel spread sheet identifying each of
the 8 entities which will be included on the mailing list. Data
received on the Dmrs was tabulated to reach these numbers and status.

Thanks for the help. Within the file for Northview MHP NC0067342 I came across a
1-21-05 letter sent from Teresa Rodriguez to Mr. James Rice, Eavenbrice
Partnership. The letter addresses the permit expansion re -submittal letter of 9-04
and stated the letter did not include all of the required elements for the
Department to evaluate the EAA. If you get a chance please find out if the
facility has received the latest letter and is going to resubmit the additional
requested information so we can move forward with the permit expansion request.

Summary: Northview Mobile Home Park proposes to expand their discharge from 0.032 MGD to
0.05 MGD to accommodate the addition of 50 houses to the development. An Engineering
Alternatives Analysis was submitted. The following options were evaluated: connection to MSD of
Buncombe County, subsurface systems, drip irrigation system, and expansion to the treatment
plant. The most economic environmentally feasible alternative is the expansion to the treatment
system.
Facility Description: The existing facility consists of aeration basin, two clarifiers, sludge holding
tank and chlorine contact chamber.
Basin Plan: Flat Creek is rated as supporting in the French Broad Basin Plan.
Waste Load allocation: A waste load allocation was done in 1991 for the Northview MHP WWTP
to determine the limits for the discharge of 0.032 MGD. A level B model was done to evaluate the
expansion to 0.05 MGD. The model predicts that the dissolved oxygen in the stream will remain
below the water quality standard of 5 mg/L with the additional flow.
Permit Limits development:
Changes to existing limits:
• A daily maximum limit of 28 pg/L for Total Residual Chlorine was added to the effluent
limitations for 0.035 MGD. According to Division Policy all permits will receive TRC limits upon
renewal and expansion. A schedule of compliance is included.
• A daily maximum limit of 35 mg/L for ammonia was included in the effluent limitations in
accordance with Division policy. All permits with monthly averages will receive weekly averages
or daily maximum limits upon renewal and expansion.

Proposed limits for 0.05 MGD include:
• BOD and TSS are secondary treatment standard limits.
• Fecal coliform limits of 200/100 ml for monthly average and 400/100 ml for daily maximum.
• A limit for ammonia of 15 mg/L monthly average and 35 mg/L daily maximum during the
summer months were given to protect for toxicity in the receiving stream.
• A limit of 28 pg/L for total residual chlorine was implemented to protect for toxicity in the
receiving stream.

The intangible with regard to construction of a new system is the fact that there is already an existing
32,000 gpd system in operation at the site. Implementation of the other alternatives would require

B. Northview Mobile Home Park presently has 212 trailer spaces. It is proposed to develop an
additional 50 lots for houses at the site. Design flow calculations for the proposed wastewater
treatment system are as follows:

C. The existing wastewater treatment system is designed for 32, 000 gpd. It is proposed to construct
an additional extended aeration treatment system to increase its capacity to 63,000 gpd. The existing
system consists of a 32,000 gallon aeration basin, a 5300 gallon rectangular clarifier and a 20,000
gallon circular clarifier, a 5000 gallon sludge holding tank, and a 800 gallon chlorine contact basin.
Figure 1 is a schematic diagram of the existing wastewater treatment system serving Northview
MHP.
D. The proposed addition is scheduled to be constructed as soon as possible. The existing facility
is at the permitted capacity of the wastewater treatment facility. There are presently 200 mobile
homes discharging to the system. The flowmeter shows that the peak flows are approximately
30,000 gpd. This represents approximately 150 gallons per unit. The additional treatment capacity
needs to be constructed to accommodate the increased flow as additional units are added to the
system and to allow for future expansion of the development.
II. DISPOSAL ALTERNATIVES
* Connecting to a Publically Owned Treatment Works - The MSD of Buncombe County has
sewer available approximately 1 mile out Hwy 25-70 near the Sonpress manufacturing facility . To
connect to this system would require a pumping station and approximately 12 mile of force main to
the sewer. The cost would be approximately $ 140,000.This is not a reasonable alternative since
there is an existing discharge at the site already and the cost is much less for increasing the capacity
of the existing treatment system. It may become economically feasible to connect to the sewer
system if the public sewer is extended out closer to the site.
* Connecting to privately owned treatment works - This alternative is the most economically
feasible alternative since there is an existing discharge at the site already. The existing facility is
approximately 30, 000 gpd with some peak flows up to 40,000 and more. The existing facility is
permitted for 32,000 gpd. It is proposed to increase this permitted capacity to 63,000 gpd.
* Feasibility of individual subsurface systems - The existing 200 mobile home sites are all
connected to the existing sewer collection system and treatment plant at the site. Sufficient land is
not available to install individual septic systems at the site. Individual septic systems and sufficient
repair areas for the existing 200 sites would require approximately 25 acres of land.
The Buncombe County Soil Survey Maps were evaluated for the site. A map is attached to this
document for review. The soils are classified as "Clifton Clay Loam", "Junaluska Brasstown
Complex", "Evard", and "Udorthents, loamy". These soils are suitable for land application.
However the amount of suitable land at the site is questionable. For this reason land application has
been determined not to be feasible for the site.
* Feasibility of community subsurface systems - This alternative would require approximately
25-30 acres of land. It is not economically feasible.
* Drip irrigating - both surface and subsurface - This alternative would require 15-20 acres of
land with suitable soil. It is not economically feasible.
* Spray irrigating - Spray irrigation would not be feasible due to the fact that there is not sufficient
land available that is buffered from surrounding property owners.

In accordance with Division policy, we must hereby return the attached Engineering Alternative
Analysis (and check #1899 for $215.00) received on July 1, 2004. After a preliminary review by the NPDES
staff, the Division has determined that the EAA package lacks the following items:
• Complete evaluation of discharge alternatives. The Division requires applicants for new and
expanding discharge permits to fully document all alternatives to surface water discharge (15A
NCAC 2H.0105 (c)(2)). Each discharge alternative should be thoroughly evaluated and each
conclusion should be substantiated by appropriate documents and itemized budgets. For
example, under item Feasibility of community subsurface systems you have stated "this
alternative would require approximately 25-30 acres of land. It is not economically feasible". You NOT part
need to submit calculations that show the amount of land needed, and an itemized budget that
includes the cost of land in the area and cost of construction and maintenance of such system.]
Please evaluate the feasibility of connecting to a privately owned treatment works. Under this
alternative you have to examine the option of connecting to other privately owned treatment 1/
systems that are located in the vicinity of future development.
• Topographical map. Please submit the map that clearly outlines the location of the future No
development and location of the Buncombe County sewer. Please indicate the area of land that
will be developed and submit information regarding the size of future development.
• Present value of costs calculations. Please submit maintenance costs for Alternative #3. —
If you wish to reapply for an NPDES permit, correct these items before resubmitting the EAA. Submit
the items listed above and the items returned to you in one package.
