No, you will still need written authorization from DWR because the buffer impacts trigger the thresholds
to require written authorization from DWR. Under the old DWR permits, this was called "written
authorization". Under the new 2022 DWR permits that corresponds to the 2022 reissued 404 Regional
General Permits 56 & 80, that language has changed to "Individual Water Quality Certification."
Individual Certifications require the application fee and a 30-day Public Notice. The fee was received
4/25/22, and the Public Notice period began 4/25/22. Per item b & c of the General Conditions of
USACE RGP 56 & 80, the use of the USACE RGP does not obviate the need to need to obtain other
federal, state, and local authorizations and all work authorized under the RGP must comply with the
terms and conditions of the applicable Clean Water Act Section 401 Water Quality Certification issued by
NC DWR. One agency not requiring written approval does not mean that both agencies do not require
written approval of impacts. You must check the applicable permits for both agencies. You can find a list

If proposed activities do not comply with the Conditions listed in RGP56 with the USACE and an
Individual Permit is required from them, then that requires a "True" Individual Permit from DWR. These
permits are typically reviewed by DWR's Central Office and may require resubmittal of the application.
You would have to show avoidance and minimization and explain why you could not reduce the size of
the dock and pier to comply with RGP 56.
Please provide an update on the revision of the plans to meet the requirements of RGP56 by Friday, May
13th

Ms. Cohn, According to Kyle, we have an excessive shading issue with the GRP56 permit for boat
dock. If we cannot overcome this then we will have to do a USACE individual permit plus the DWR
certification too. If we can get our pier and dock shading reduced then we will fall under the GRP56
and I assume will not need DWR certification just buffer approval. Does this sound about right?. We did
pay the $240 review fee. Please let me know if we are on the right track. Thanks John
