Based on the information provided, it appears that there are impacts to open waters for the bulkhead
installation that may require 401/404 permitting. This would most likely be under USACE (404) Regional
Permit 80. The corresponding DWR (401) permit would require an Individual Water Quality Certification
as there are buffer impacts that require a Buffer Authorization from the Division. This would require that
a fee be paid and would need to go out for a 30-day public notice. The USACE was visiting the site to
determine if there were impacts that would require 401/404 permitting.

Thank you, Ms. Cohen, for your response, and I am grateful to hear from you. However, I don't
understand what you are telling me when you say that the project may need to be resubmitted based

on his findings. This has really impacted my schedule for starting and is now driving up my cost if I have
to remobilize the contractor that's doing the work in the neighborhood.

Good afternoon Mr. Mills and Mr. Davis,
Apologies for the delayed response. I've been out of the office performing fieldwork and trying to catch
up on emails.
I've been corresponding with Kyle Barnes of the USACE about this project. I believe he was scheduled to
perform a site visit this week or next. Depending on his findings, this project may need to be
resubmitted. I'm planning to touch base with him early next week, and I should have a better idea of the
path forward after that.

Good morning Ms. Cohn, my name is Donald Mills and my wife, and I are building our retirement home
at the above referenced address. I have been following the email trail between Appian Engineering,
John Davis, and you. I wanted to make sure that you now have everything that you need to make a
decision on permitting our project. The contractor will be mobilizing all his equipment, and his barge in
the neighborhood at one of my neighbor's properties to start his bulkhead, boathouse, and dock. I am
trying not to have to bear the expense of an additional mobilization cost if I don't have too.
I know that you will make sure that we are compliant with all the state regulations, and I am grateful
that you will. I am just trying to make sure that the people I am paying is moving in a timely fashion to

get you all that you need. This process goes back to September of last year for us. Thank you for you
input and your response, if you have a timeline and could share that I would be thankful. We are just
