Stewart Subject: Authorization to Construct Linville Land Harbor POA Application Number ACA022756 PO Box 160 Linville Land Harbor Linville,NC 28646 Avery County Dear Mr. Stewart: A letter of request for an Authorization to Construct was received July 15, 1994 by the Division and final plans and specifications for the subject project have been reviewed and found to be satisfactory. Authorization is hereby granted for the construction of dual grit chambers with manual bar screens and flow proportioning weirs, 35,000 gallon aerated equalization basin,three new influent pumps rated at 200 gpm, 100 gpm and 40 gpm respectively, 50,000 gallon aerobic sludge digester with dual 75 gpm sludge pumps, waste sludge pumping station with dual 75 gpm pumps, Plant 2 effluent pump station with one pump rated at 25 gpm and one pump rated at 60 gpm, standby power generator and all related piping and appurtenances with discharge of treated wastewater into the Linville River. This Authorization to Construct is issued in accordance with Part III, Paragraph A of NPDES Permit No. NCO022756 issued December 7, 1989, and shall be subject to revocation unless the wastewater treatment facilities are constructed in accordance with the conditions and limitations specified in Permit No. NC0022756. The sludge generated from these treatment facilities must be disposed of in accordance with G.S. 143-215.1 and in a manner approved by the North Carolina Division of Environmental Management. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions,the Permittee shall take immediate corrective action,including those as may be required by this Division,such as the construction of additional or replacement wastewater treatment or disposal facilities. The Asheville Regional Office, telephone number 704/251-6208, shall be notified at least forty- eight (48) hours in advance of operation of the installed facilities so that an in-place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with the NPDES Permit, this Authorization to Construct and the approved plans and specifications. Mail the Certification to the Permits and Engineering Unit,P.O. Box 29535,Raleigh,NC 27626-0535. Upon classification of the facility by the Certification Commission, the Permittee shall employ a certified wastewater treatment plant operator to be in responsible charge(ORC)of the wastewater treatment facilities.The operator must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the wastewater treatment facilities by the Certification Commission. The ORC of the facility must visit each Class I facility at least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays, and must properly manage and document daily operation and maintenance of the facility and must comply with all other conditions of Title 15A,Chapter 8A,.0202. A copy of the approved plans and specifications shall be fhaintained on file by the Permittee for the life of the facility. The Operational Agreement between the Permittee and the Environmental Management Commission is incorporated herein by reference and is a condition of this Permit. Noncompliance with the terms of the Operational Agreement shall subject the Permittee to all sanctions provided by G. S. 143- 215.E for violation of or failure to act in accordance with the terms and conditions of this Permit. Failure to abide by the requirements contained in this Authorization to Construct may subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. The issuance of this Authorization to Construct does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies(local,state, and federal) which have jurisdiction. Other Special Items: Page 3 w l j PART IV - EVALUATION AND RECOMMENDATIONS Mr. James Stewart of Linville Land Harbor P.O.A. has requested renewal of NPDES Permit No. NCO022756 for the continued discharge of 0 . 225 MGD of domestic wastewater to the Linville River which is classified B-trout waters . The wastewater treatment facility operates in compliance most of the time except during periods of wet weather. The sewerage collection system was installed during the early 1970 ' s and is allowing excess amounts of I/I to enter the system which cause periodic overflows of, the wastewater treatment system. Land Harbor has ordered a camera equipment to be used to located leaks in the sewer system so they can be repaired. Also, the facility is proposing to install new sludge management equipment. A request for an authorization to construct has been submitted. No water quality problems have been noted as a result of this discharge and it is recommended that the permit be issued. C. 0032131. Please be advised that my staff has reviewed the existing information relative to your concerns. In your correspondence you indicated concern that Tweetsie Railroad would be allowed to discharge to waters recommended. for ORW classification. While our preliminary review of existing conditions does not appear to indicate ORW status, it is our intention to look in more detail at the situation. We previously had scheduled a biological evaluation of the Middle Fork of the New River for sometime in November. Our initial exami- nation included one sample on the South Fork and a review of land use in the area. Further sampling should verify.existing water quality conditions and appropriate classification of the Middle Fork. Until these evaluations are complete, permitting staff will withhold issuance of the authorization to construct. You will be provided a copy of the evaluation as soon as it is complete. In separate correspondence dated October 15, 1989, you remarked regar- ding the Linville Land Harbor's NPDES permit renewal and commented on flow contributions. Our data indicate that the stream segment to which this discharge flows is not biologically excellent. You yourself identify five dischargers to this segment.. It is probable that this segment will not be afforded the protection of ORW. Excellent water quality is present further downstream, however. Authorization is hereby granted for the construction of addi4pnal facilities which include a 65,000 GPD extended aeration package plant with bar screen, aeration, clarification and aerobic sludge digestion, a new gaseous chlorinator and a 4700 gallon chlorine contact chamber, and all associated piping and appurtenances to serve Linville Land Harbor Subdivision with discharge of treated wastewater into Linville River. This Authorization to Construct is issued in accordance with Part III paragraph B of the NPDES Permit No. NCO022756 issued September 17, 1987, and shall be subject to revocation unless the wastewater treatment facilities are constructed in accordance with the conditions and limitations specified in Permit No. NC0022756. The Permittee must employ a certified wastewater operator in accordance with Part III paragraph C of the referenced permit. The sludge generated from these treatment facilities must be disposed of in accordance with G.S. 143-215. 1 and in a manner approvable by the North Carolina Division of Environmental Management. The Asheville Regional Office, telephone number 704/251-6208 shall be notified at least twenty-four (24) hours in advance of operation of the facilities so that a final inspection may be conducted. Such notification to the Regional Supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. The Asheville Regional Office stands ready to assist Linville Land Harbor Property Owners Association in determining best sludge management practices. All existing chlorination facilities shall be abandoned upon completion and operation of the new chlorination facilities. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with the approved plans and specifications. Box 157 Linville, NC 28646 SUBJECT: Permit No. NCO022756 Authorization to Construct Linville Land Harbor Wastewater Treatment Facility Avery County Dear Mr. Huskins: A letter of request for Authorization to Construct was received February 19, 1987, by the Division and final plans and specifications for the subject project have been reviewed and found to be satisfactory. . Authorization is hereby granted for the construction of a 0.060 MGD wastewater treatment facility consisting of a grit removal chamber, a bar screen/comminutor unit, a 60,000 gallon aeration tank, two (2) 10,000 gallon clarifiers, a 6,843 gallon sludge holding tank, dual 231 CFM blowers, a 1,250 gallon chlorine contact chamber with hypochlorinator, 80 lineal feet of 10-inch gravity sewer, 215 lineal feet of 12-inch gravity sewer, And all associated piping and appurtenances. This Authorization to Construct is issued in accordance with Part III paragraph C of the NPDES Permit No. N0022756 issued January 4, 1985, and shall be subject to revocation unless the wastewater treatment facilities are constructed in accordance with the conditions and limitations specified in Permit No. NC0022756. The Permittee must employ a certified wastewater operator in accordance with Part III paragraph D of the referenced permit. The sludge generated from these treatment facilities must be disposed of in accordance with G.S. 143-215.1 and In a manner approvable by the North Caroling Division of Environmental Management. Such notification to the Regional Supervisor shall be made during the normal office hours from 8:00 a.m. to 5:00 p.m. on Monday through Friday, excluding State Holidays. In event the facilities fail to perform satisfactorily in meeting its NPDES permit effluent limits, the Permittee shall take such immediate corrective action as may be required by this Division, including the construction of additional wastewater treatment and disposal facilities. The wastewater flowrate discharged to and treated by these facilties shall not exceed 75,000 GPD until such time as NPDES Permit No. NC0022756 is modified to allow the discharge of up to 135,000 GPD of adequately treated wastewater. Prior to any rehabilitation to the 75,000 GPD wastewater treatment plant, the Permittee must secure an amendment for NPDES Permit No. NC0022756 from the Division of Environmental Management. Once the 60,000 plant becomes operational , no wastewater shall be discharged into the 75,000 GPD plant in excess of 15,000 GPD, until all permits have been secured and all modifications have been completed.
