It was great to meet you at Winston Pointe last week to walk the site. We are planning on closing on this property on June 1st, but we are required to have DWR and USACE permitting before we close. Do you foresee any issue with approving our project in the next 30 days or so to allow UASCE time to issue their permit too before June 1st? In regards to your previous email for Request for additional information, I have provided responses below: 1. Please provide the Division with a copy of the Complete Project History as requested by the USACE. S&EC will be providing this information shortly and will make sure to include DWR on the email. 2. The application states that the buffer impacts for Impact Area "C" are deemed allowable per 15A NCAC 02B .0714(11)(kk)(i), but on the Impact Map, it appears that the utility stream crossing is not a perpendicular crossing as defined in 15A NCAC 02B .0610(32). Please provide more information on this crossing. Please see attached updated impact area, updated wetland mitigation SOA as well as updated PCN form above. 3. In the Buffer Impact table, all three impacts (A, B, D) are listed as no buffer mitigation required. In Section E1, Avoidance and Minimization, the application states that buffer mitigation is proposed for impacts A, B, and D. In Section E 6, Buffer Mitigation, the mitigation table is only filled out for Impact B. Impact B is a non - perpendicular road crossing. Please clarify/confirm which impact buffer mitigation is proposed for. Buffer mitigation is proposed for Impact B, please see attached updated PCN above with more clarity. At this time, the application is incomplete and we will require additional information to begin review. S&EC and/or Stewart Proctor have been involved in permitting this development since the early 1990s. The development was formerly known as 'Sweetwater' and in the early 2000's became known as Winston Pointe. USACE Action ID SAW-1994-04978 (S&EC) authorized the use of Nationwide Permit (NWP) 26 to impact 4.94 acres, NWP 14 to impact 1.78 acres, NWP 18 to impact 0.1 acre, and NWP 12 to impact 9.33 acre. USACE Action ID SAW-2002-20830 (S&EC) authorized the use of NWP 12 to impact .569 acre USACE Action ID SAW-2013-01279 (Stewart Proctor) authorized the use of NWP 29 to impact 0.036 acre and 140 linear feet of stream. I have attached several associated project maps to illustrate project connectivity/overlap. The project status, and what (if any) impacts have occurred are unclear.
