This determination is final and binding unless, as detailed above, you ask for a hearing or appeal within sixty (60)
days.
The owner /future owners should notify the Division of Water Resources (including any other Local, State, and
Federal Agencies) of this decision concerning any future correspondences regarding the subject property (stated
above). This project may require a Section 404/401 Permit for the proposed activity. Any inquiries should be

Mr. and Mrs. Swain,
Per my visit to your house on October 20, 2014, please find attached a Minor Variance. This is
the application that would need to be completed and submitted to the Division of Water
Resources (DWR) to pursue obtaining a permit to building the proposed storage shed in Zone 2
(the outer 20') on the 50' buffer that is on your property.
• There is no fee to apply for this permit
• Three copies of the permit, three copies of the attached stream letter, and three copies of
your plat with the buffer drawn on it and the proposed footprint of the storage shed would
all need to be sent to:

• I have attached an example of what should be represented on the plat (current existing
structures, the 50' buffer (separated into the inner 30' and outer 20'), and the proposed
project). In the example, the project is a shed; yours of course would be the storage shed.
• As we discussed, you currently have a shed in Zone 2 (the outer 20') of the buffer; this is
an existing shed, so you can replace anything you wanted in the footprint of that shed
without a permit. So, if you wanted to add a bigger shed, you would only need our permit
for the additional square footage of the new shed.
