1.0 Introduction
The Britt & Hales Riparian Buffer Mitigation Site (Parcel) is located near Mount Olive, NC, in the
Upper Falling Creek watershed of the Neuse River Basin. The project site is approximately 6.5 miles
northwest of the Town of Mount Olive and 1.7 miles south of US Highway 13 on McArthur Pond
Road in Wayne County, NC (Figure 1). The Buffer Mitigation and Nutrient Offset Plan (Mitigation
Plan) is being submitted for review under the Britt & Hales Mitigation Banking Instrument (MBI)
between the North Carolina Division of Water Resources (NCDWR) and Eco Terra, the Bank
Sponsor (Sponsor). The Parcel is approximately 24.7 acres (ac) or 1,076,332 square feet (sf) of a
180-ac tract that encompasses a series of forked, interconnected ditches and unnamed tributaries
to Falling Creek. The project is located within the Neuse River Basin hydrological unit code (HUC)
03020201170010. The Mitigation Plan is being submitted for riparian buffer and nutrient offset
credit in the service area designated by Neuse River Basin HUC 03020201 (Figure 2). The Parcel
is located in the headwaters of three unnamed tributaries and three agricultural ditches that
converge and flow into an unnamed tributary to Falling Creek, approximately 1.8 miles
downstream of the project area, and subsequently into the Neuse River. The proposed project
will generate 337,656.784 riparian buffer credits (RBC) and 32,985.910 pounds (Ibs) of nitrogen
nutrient offset credits (NOC).
The Britt & Hales Riparian Buffer Mitigation Site will address agricultural runoff by reducing
sediment and nutrient loading into the unnamed tributaries and Falling Creek. Falling Creek is
classified as Water Supply (WS-IV) and Nutrient Sensitive Waters (NSW) by NCDWR with an
impairment for dissolved oxygen. The project area and surrounding areas are open agricultural
land, primarily farmed for row crops. The proposed project will improve terrestrial habitats along
the streams by establishing and preserving the riparian buffers and allowing the land to undergo
a natural succession to a forested community. The project will restore forested riparian buffers
and adjacent riparian areas to a maximum of approximately 200 feet from the streams and will
remove rotating crops and fertilizer inputs. The restored riparian buffer and adjacent riparian areas
will filter agricultural runoff from the surrounding farm fields and provide shading to reduce
stream temperatures and improve aquatic habitat. Invasive vegetation will be managed as needed
within the project area to promote native vegetation.
The proposed project will provide riparian buffer and nutrient offset mitigation in the Neuse River
Basin. The project involves the restoration and preservation of riparian buffers along three
unnamed tributaries and two ditches that flow to Falling Creek. Land disturbing activities include
site preparation for planting trees to enhance the vegetative buffer up to 200 feet from the
streams and ditches within the approximate 24.7-acre project easement. The project area and
surrounding areas are open agricultural land, primarily farmed for row crops. Historical land use
has been agriculture for the past 70 years according to historical USDA aerials. The project site
will be permanently protected and preserved with a conservation easement that will ultimately be
transferred to a land trust for long-term stewardship.

2.0 Mitigation Project Summary
2.1 Project Goals
The major goal of the proposed buffer and adjacent riparian area restoration is to improve water
quality through ecological enhancements within the Neuse River Basin. This will be accomplished
with specific goals to address agricultural runoff, including nutrients and sediment, restore
terrestrial habitat and protect the project parcel in perpetuity. Specific goals and objectives are
outlined in Table 1.

2.2 Existing Conditions
The Parcel will convert approximately 22.2 acres of agricultural row crop fields to forested buffers
along three unnamed tributaries (UT1, UT2 and UT3) and three agricultural ditches (Ditch Al, B1
and B2). Refer to Figure 3 and Appendix A for the Existing Conditions Map and site photographs,
respectively.
Ditch Al emerges from a farm road to the south of the project area, flows north within and along
the eastern border of the project area before turning west through the project area and
transitioning into UT1. UT1, an intermittent stream, continues to flow west, turns to the north
before its confluence with UT2 and then continues northward as UT3 to the project terminus.
Ditches B1 and B2 flow east and west, respectively, until the transition/confluence with UT2, an
intermittent stream. UT2 flows due west to the confluence with Ditch B2, turns north and then
flows northeast through the site until its confluence with UT1. Both the unnamed tributaries and

agricultural ditches are shown as water features on the 1974 Wayne County Soil Survey, however
are not depicted on the 2019 US Geological Survey's (USGS) Grantham NC 7.5-minute
Topographic Quadrangle as stream channels (Figure 4).
The Parcel is composed of and surrounded entirely by agricultural fields with the exception of two
small wetland areas with existing trees and vegetation to be preserved along UT1 and Ditch Al.
Historical aerials denote that land use, including configuration of the channels, at the project site
has been consistent since 1959 (see Appendix B). An area of dumped broken concrete exists
along the boundary of one of the tree preservation areas. The concrete and any other debris or
trash will be removed during the site preparation. Along UT2 and Ditch B1, there are three small
areas of bank erosion that will be stabilized as part of the buffer restoration. There is a 30-inch
reinforced concrete pipe culvert on UT3 within the Parcel near the project's downstream terminus.
This buried culvert provides access for the landowner and will remain in place.

2.3 Parcel Viability
NCDWR staff visited the project Parcel on March 4, 2022 to review features and determine
applicability to the Neuse River Basin Riparian Area Protection Rules, Title 15A NCAC 02B .0714.
NCDWR issued the official Stream Call Determination letter on April 19, 2022. On May 19, 2022,
NCDWR staff re -visited the site to determine the potential for riparian buffer mitigation and
nutrient offset within the proposed easement boundary per 15A NCAC 02B .0295 and 15A NCAC
02B .0703, respectively. NCDWR issued the official Site Viability letter on June 15, 2022. A copy
of both the "Applicability to the Neuse River Basin Buffer Rules" and "Site Viability for Buffer

2.4 Watershed Characterization
The Parcel is located within the Upper Falling Creek Subwatershed (HUC 030202011403) and
Neuse River Basin (HUC 03020201). All of the site's water conveyance features drain to UT3 which
flows to an unnamed tributary to Falling Creek. Falling Creek is classified as Water Supply (WS-
IV) and Nutrient Sensitive Waters (NSW) by NCDWR with an impairment for dissolved oxygen.
Falling Creek is approximately 1.8 miles downstream of the project area. WS-IV waters are used
as sources of water supply for drinking, culinary, or food processing purposes. They are protected
for Class C uses which include aquatic life propagation, survival and maintenance of biological
integrity, wildlife, secondary recreation and agriculture. The NSW designation is for waters
needing nutrient management due to excessive growth of microscopic or macroscopic vegetation.
Drainage areas were delineated for the project area's stream (UT1, UT2 and UT3) and viable ditch
(Al, B1 and B2) features utilizing Wayne County's 2-foot Light Detection and Ranging (LiDAR)
data (Figure 5). According to the 2019 USGS National Land Cover Database (NLCD), the drainage
area is primarily agricultural use with limited residential use. Table 4 summarizes the drainage
areas and current land use.

2.5 Soils and Geology
The project area's soils, as mapped by the 1974 Soil Survey of Wayne County, are loamy sand, and
consist of the Norfolk, Wagram and Weston series (Figure 6). The Weston (We) soils comprise the
majority of the soils underlying the Parcel at 78 percent. UT1 and UT2 are depicted as streams on
the 1974 USDA Soil Survey map sheet 35. A description of the site's soils is provided in Table 5.

Geologically, the Parcel is located within the Rolling Coastal Plain of the Middle and Upper Coastal
Plains physiographic province. Broad, flat terraces, adjacent to low -gradient stream channels,
characterize both the Middle and Upper Coastal Plains.
2.6 Vegetation
Vegetative communities within the project area consist of active row crops of cotton and peanuts
and early successional, herbaceous and woody vegetation along the streams and ditches that are
mowed and maintained.
2.7 Threatened and Endangered Species
The US Fish and Wildlife Service (USFWS) Information for Planning and Consultation (IPaC)
database and NC Natural Heritage Program (NCNHP) database were utilized to identify federally
threatened and endangered species in the project area. In a letter dated June 6, 2022, the USFWS

identified four federally threatened and endangered species under the Endangered Species Act
and one species under the Migratory Bird Treaty Act as potentially occurring in the project vicinity.
According to the USFWS, there are no critical habitats within the project area. A review of the NC
Natural Heritage Program (NCNHP) data dated May 26, 2022 did not identify any known
occurrences of federally listed species within one mile of the project site; however, a Managed
Area is within a 1-mile radius. The area, associated with the Falling Creek Mitigation Parcel, is
managed by Unique Places to Save. Multiple site visits have occurred over the past 18 months
observing site conditions, habitat, and potential presence of species. No species, suitable habitat,
or critical habitats were observed within the project boundaries resulting in a "no effect"
determination for subject species. Additionally, no eagles, eagle nests, nor American kestrels were
observed, and construction activities will occur outside the window for the potential presence of
the migrating American Kestrel and breeding time for local birds. The USFWS Self -Certification
Letter, dated June 10, 2022, has been submitted to the Raleigh Field Office requesting comment
from USFWS. A response was not received from the USFWS within the 45-day response period.
All of the letters and responses have been included in the Appendix D. Table 6 summarizes the
threatened and endangered species evaluation.

2.8 Cultural Resources
The National Historic Preservation Act declares a national policy of historic preservation to protect,
rehabilitate, restore, and reuse districts, sites, buildings, structures and objects significant in
American architecture, history, archaeology and culture. Section 106 mandates that federal
agencies take into account the effect that a project may have on a property that is included in or
is eligible for inclusion in the National Register of Historic Places.
The NC State Historic Preservation Office's (SHPO) online mapping resource was reviewed to
determine the presence of known historic resources at or near the project site. According to the
database, there are no known historical resources within the project site. The Littleton House
(WY0384) is the closest resource which is located 2.3 miles from the project site. The Littleton
House is classified as a "Survey Only" site and will not be disturbed for the proposed project. A
letter was submitted to SHPO on May 19, 2022, requesting review and comment. SHPO
responded on June 15, 2022 indicating that they were not aware of any historic resources that
would be affected by the project. Both letters are included in the Appendix D.

2.9 FEMA Floodplain and Permitting Compliance
The Parcel is not located within the 100-year floodplain and will not require FEMA coordination
nor a floodplain development permit. Neither grading activities nor hydraulic modeling are
proposed for this project. The project will not encroach on the NCDOT right-of-way along
McArthur Pond Road. There are no other known easements at or near the project site that would
prevent project implementation.
2.10 Parcel Constraints and Access
The Parcel can be accessed via a driveway off McArthur Pond Road and a farm field path for long-
term access and site maintenance and monitoring. There is a 30-inch reinforced concrete pipe
culvert on UT3 within the Parcel near the project's downstream terminus. This buried culvert
provides the landowner with access to cross the stream and will remain in place. There are no
other known constraints on the proposed project Parcel.
2.11 Other Environmental Conditions
A site assessment was conducted by Environmental Data Resources (EDR) to comply with
standards set forth by EPA, ASTM and other environmental due diligence requests to evaluate
environmental risk for the Parcel. The EDR report, May 24, 2022, determined the site was not
located in any Federal, State or Tribal environmental databases and there were no known,
potentially hazardous, waste sites within or immediately adjacent to the project site. The EDR
report is provided in Appendix E.
3.0 Site Protection Instrument and Long-term
Management
The land required to plant and restore the riparian buffer, access the conservation easement, and
manage the mitigation project includes 24.7 acres of the Parcel listed in Table 7. The Parcel will
remain in private ownership, protected in its entirety by an approved NCDWR long-term
stewardship entity, and will be managed under the terms detailed in an approved NCDWR
conservation easement. The long-term trustee and manager will be responsible for the periodic
inspection of the Parcel to ensure the conservation easement is upheld and the land is protected
in perpetuity.

4.0 Mitigation Work Plan
The proposed project will restore high quality riparian buffers along three ditches (Ditch Al, B1
and B2) and three unnamed tributaries (UT1, UT2 and UT3) that flow to an unnamed tributary to
Falling Creek. The project will not have any adverse impacts to existing stream and water
conveyances.
4.1 Parcel Preparation
The land proposed for buffer restoration is currently in agricultural row crop production,
therefore the site preparation will require minimal soil disturbance. Soil fertility will be assessed
to determine any site soil deficiencies prior to plant establishment. Planting will occur using
mechanical and manual methods. Soil ripping will occur in the mechanically planted rows to
break up plow pans and compacted soils. Additional site preparation such as ripping and
disking will occur within farm paths proposed for planting.
Appropriate pre -emergent herbicide will be applied by a licensed NC pesticide applicator in the
tree rows to control potential herbaceous weed competition. Additional herbicide will be applied
within the planting rows during the post -planting phase for at least the first three years as needed
and approved by NCDWR. Any invasive plants will be controlled mechanically and chemically. The
fields within the project area contain limited number of invasive plants and herbicide will only be
sprayed in areas where there is an existing population of non-native invasive plant species.
Areas immediately adjacent to the top of streambanks will not be ripped to prevent soil erosion
and runoff from entering the surface water. Non-native invasive species are present and will be
removed during planting to minimize potential for competition with target vegetative
communities. As noted in the NCDWR Site Viability Assessment letter, there is an area of concrete
debris that exists along the forested area to be preserved that will be removed and stabilized.
Planting rows will be approximately aligned to follow the existing contours to impede overland
flow and prevent erosion. Sediment and erosion control measures may be utilized, if necessary,
in all areas with existing rills and unstable banks, as well as areas prone to erosion, to prevent
stormwater runoff from entering surface waters during construction. Minor bank/riparian
stabilization and grading will be provided where erosional rills, sink holes and gullies are observed.
No DEMLR nor local County permits are anticipated for stabilizing compromised areas. An
appropriate temporary seed mix will be applied, as necessary, to provide temporary ground cover
for soil stabilization and reduction of sediment loss during rain events in areas without existing
herbaceous cover.
4.2 Restoration Activities
The planting plan for the buffer restoration area includes restoring native tree species with bare
root seedlings and seeding to convert the active farming area to a vegetated riparian corridor.
Trees will be planted with a density sufficient to meet the performance standards outlined in the
Rule 15A NCAC 02B .0295 of 260 trees per acre at the end of five years. Initial planting densities
will be between approximately 726 trees per acre (6-foot by 10-foot spacing). At least four
tree/shrub species will be planted within each planting zone. All species will be well mixed to

ensure adequate distribution across the planting areas. The Parcel's buffer areas will be re -
vegetated with species consistent of those identified during the reference survey and additional
species suggested by Schafale (2012) for the Mesic Mixed Forest and Coastal Plain Small Stream
Swamp (blackwater subtype) Forest communities. Target community tree species are shown in
Table 8. An appropriate permanent seed mixture will be planted that may include species
beneficial to pollinators or species that act as larval hosts for pollinators such as butterflies (e.g.
big bluestem). Seeding will not be applied to areas with an existing native herbaceous layer.
Planting will occur in the dormant season between November 15 and March 15.

4.3 NCDWR As -Built Evaluation
Within 30 calendar days after completing the establishment of the buffer and nutrient offset areas,
the Sponsor will submit written notification to NCDWR documenting that all buffer mitigation and
nutrient offset activities have been completed. Failure to submit written notification within 30
days may result in a modified credit release schedule or a delay in the issuance of credit releases.
An as -built report will be submitted to NCDWR, following the restoration planting, to document
the mitigation work plan to date.
5.0 Maintenance and Monitoring Plan
The maintenance and monitoring plan has been developed to demonstrate required performance
standards and success criteria are met and project goals and objectives are achieved.
5.1 Performance Standards
The performance standards for the proposed project follow approved criteria presented in the
Consolidated Buffer Rule (15A NCAC 02B .0295). Annual monitoring and semi-annual site visits
will be conducted to assess the condition of the finished project. Performance standards will be
evaluated throughout the five-year post -construction monitoring period and summarized
annually in a monitoring report. This annual report shall provide project data and chronicle issues
that arise during the five-year monitoring period. The Sponsor shall submit annual monitoring
reports to NCDWR by December 31st of each year for at least 5 consecutive years until project
close-out and will follow the terms and conditions of the Britt & Hales MBI.
5.2 Monitoring
Permanent vegetation monitoring plots will be established and assessed within the buffer
restoration areas to document the survival and vigor of the planted trees. A total of 18 plots that
are 10 meters by 10 meters each will be randomly established within the planted restoration areas
to document tree survival (Figure 7). The number of plots represent two percent of the total
mitigation area. The Consolidated Buffer Rule (15A NCAC 02B .0295) requires survival of at least
260 stems per acre at the end of the five-year monitoring period. Vegetation monitoring will
follow the Carolina Vegetation Survey (CVS) — NC Ecosystem Enhancement Program (EEP) Protocol
for Recording Vegetation (2008).
The vegetation plots will be photographed each year with an additional seven photographs (25
total) taken to document project condition and easement integrity. All photos will be taken at the
same location and orientation each year. Plots will be demarcated with durable PVC or metal
markers and flagging during the monitoring period.
Visual assessments will be performed twice a year during the five-year monitoring period. Areas
of concern, low stem density, invasive species or easement encroachment, will be mapped,
photographed and described in the monitoring report. Problem areas will be re-evaluated during
subsequent site visits. Table 9 summarizes the proposed monitoring plan components associated
with this project.

The first growing period will be documented in the first annual report to be completed at least 5
months after planting has occurred and no earlier than the fall season. Species composition,
height and survival rates will be assessed for each monitoring plot and included in the annual
report. Upon NCDWR approval, desirable native volunteer species may be included in the overall
tree density for the Parcel to meet performance standards and success criteria.
5.3 Parcel Maintenance
Actions will be taken to correct issues identified in the annual monitoring reports that jeopardize
the success of the project such as tree survival and easement encroachment. Parcel maintenance
activities will be included in annual reports. As noted in the Parcel Preparation section, effective
herbicide application is critical to success of restoration areas, primarily historical agricultural land.
Herbicides approved for aquatic environments will be applied as necessary and in accordance with
the NCDA rules and regulations by a qualified NC licensed pesticide/herbicide applicator. Prior
approval from NCDWR is required if mowing within Zones 1 and 2 of the Neuse River basin buffers
is deemed necessary.
5.4 Parcel Boundary Maintenance
Conservation easement boundaries will be clearly marked with fencing, posts, paint or other
permanent material and will include appropriate contact information on the boundaries.
Established boundaries between the easement and the remaining parcel in agriculture will ensure
project protection and prevent encroachment. Boundary installation will occur immediately after
planting is completed and prior to the as -built survey. Boundary markers incidentally destroyed,
damaged or disturbed will be repaired and/or replaced as needed during the monitoring period
and in the future under the long-term trustee management. All easement boundaries will be
visually assessed twice per year as part of the monitoring protocol. Any easement encroachment
or performed maintenance will be documented in the annual monitoring reports.
6.0 Financial Assurances
6.1 Performance and Maintenance Bonds
Following approval of the Britt & Hales Buffer Mitigation and Nutrient Offset Plan, the Sponsor
shall provide a Performance Bond from a surety that is rated no less than an "A-" as rated by A.M.
Best. The performance bond amount shall be 100 percent of the estimated cost for
implementation of the project as described in the Mitigation Plan, but not less than $150,000. In
lieu of posting the performance bond, the Sponsor may elect to construct the project prior to the
first credit release. Under the latter option, a performance bond is not necessary.

After completion of the restoration/construction, a separate Performance/Maintenance Bond will
be secured for 100 percent of the estimated cost to implement the maintenance and monitoring
plan for a 1-year term and will be extended annually for a minimum of five years. Upon NCDWR
approval, this may be lowered each year based on the adjusted cost to complete the monitoring.
Performance bonds for monitoring shall be renewed at least annually to cover the next year's
monitoring period, with confirmation of renewal provided to NCDWR with each annual
monitoring report (when applicable). NCDWR reserves the right to alter the credit release
schedule if monitoring reports are submitted without proof of bond renewals.
7.0 Determination of Credits and Credit Release
7.1 Credit Potential
The potential project credits are based on the top of bank of the three unnamed tributaries (UT1,
UT2 and UT3) and three agricultural ditches (Ditch Al, B1 and B2). All areas within 200-linear feet
landward of the top of bank will be planted and accounted as either riparian buffer credit or
nutrient offset credit. Refer to Figure 8 for a depiction of the proposed buffer credit areas and
Figure 9 for an illustration of the corresponding riparian buffer zones for the Parcel.
Of the 336,240 sf of riparian restoration on this Parcel, 336,240 sf is located adjacent to the streams
(UT1, UT2 and UT3) within the first 100 feet from the top of bank and can be used for either
Riparian Buffer Credits or Nutrient Offset Credits, but not both. Credits for this area can be
converted upon receiving written approval by NCDWR. 632,140 sf is located within the 101 to
200-foot offset from the stream top of bank and from the top of bank to 200 feet along the
ditches. This restoration area is viable for Nutrient Offset Credits and cannot be converted and
transferred into Riparian Buffer Credits in accordance with the MBI. Additionally, there is an 8,172-
sf preservation area adjacent to UT1 that will provide Riparian Buffer Credits. The Parcel will
generate a total of 337,656.784 credits from the 344,412 sf Riparian Buffer restoration and
preservation and 32,985.910 Nutrient Offset Credits from the 632,140 sf of Nutrient Offset
mitigation. The project's credit potential is summarized in Table 10.
In accordance with the MBI, any credit conversions will be calculated using the guidance provided
in the Clarified Procedures for Calculating Buffer Mitigation Credits and Nutrient Offset Credits letter
issued by the NCDWR
7.2 Credit Release
Upon submittal of the appropriate documentation by the Sponsor and subsequent approval by
NCDWR, the riparian buffer and nutrient credits associated with the Britt & Hales Buffer Mitigation
Bank Parcel will be released as described in the approved MBI.

On March 4, 2022, Shelton Sullivan of the Division of Water Resources (DWR) conducted an
on -site review of features located on the Britt & Hales Buffer Mitigation Site in Wayne County
to determine the applicability of features on the site to the Neuse River Basin Riparian Area
Protection Rules, Title 15A North Carolina Administrative Code 02B .0714.
The enclosed map(s) depict the feature(s) evaluated and this information is also summarized
in the table below. Streams were evaluated for being ephemeral, at least intermittent, and
for subjectivity to the Neuse River Basin Riparian Area Protection Rules. Streams that are
considered "Subject" have been located on the most recently published County NRCS Soil
Survey and/or the most recent copy of the USGS Topographic (at 1:24,000 scale) map(s),
have been located on the ground at the site, and possess characteristics that qualify them to
be at least intermittent streams. Features that are considered "Not Subject" have been
determined to not be at least intermittent, not present on the property, or not depicted on
the required maps.
This determination only addresses the applicability to the buffer rules within the
proposed easement and does not approve any activity within buffers or within waters
of the state. There may be other streams or features located on the property that
appear or do not appear on the maps referenced above. Any of the features on the site
may be considered jurisdictional according to the US Army Corps of Engineers and
subject to the Clean Water Act.
The following table addresses the features observed and rated during the DWR site visit. See
the attached site map for the labeled features.

On April 27, 2022, Katie Merritt, with the Division of Water Resources (DWR), received a request
from you on behalf of EcoTerra Partners, LLC (EcoTerra) for a site visit near the above -referenced
site in the Neuse River Basin within the 8-digit Hydrologic Unit Code 03020201. The site visit was
to determine the potential for riparian buffer mitigation and nutrient offset adjacent to features within
a proposed conservation easement boundary, which are more accurately depicted in the attached
maps labeled "Figure 1" and "Figure 2" prepared by EcoTerra and edited by DWR. The proposed
easement boundary includes all riparian areas intended to be proposed as part of the mitigation site.
On May 19, 2022, Ms. Merritt performed a site assessment of the subject site. Staff with EcoTerra
were also present.
Ms. Merritt's evaluation of the features onsite and their associated mitigation determination for the
riparian areas are provided in the table below. This evaluation was made from Top of Bank (TOB)
and landward 200' from each feature for buffer mitigation pursuant to 15A NCAC 02B .0295
(effective November 1, 2015) and for nutrient offset credits pursuant to 15A NCAC 02B .0703.

tops of channel banks when being measured perpendicular and landward from the banks, even if no credit is viable within that riparian
area.
6The area of the mitigation site on ephemeral channels shall comprise no more than 25 percent (25%) of the total area of buffer
mitigation per 15A NCAC 02B .0295 (o)(7).

Determinations provided in the table above were made using a proposed easement boundary showing
proposed mitigation areas and features shown in Figure 2 and Figure 1 respectively. The map
representing the proposal for the site is attached to this letter and initialed by Ms. Merritt on June 15,
2022. Substantial changes to the proposed easement boundary as well as any site constraints
identified in this letter, could affect the Site's potential to generate buffer mitigation and nutrient
offset credits.

This letter does not constitute an approval of this Site to generate buffer and nutrient offset credits.
Pursuant to 15A NCAC 02B .0295, a mitigation proposal and a mitigation plan shall be submitted to
DWR for written approval prior to conducting any mitigation activities in riparian areas and/or
surface waters for buffer mitigation credit. Pursuant to 15A NCAC 02B .0703, a proposal regarding a
proposed nutrient load -reducing measure for nutrient offset credit shall be submitted to DWR for
approval prior to any mitigation activities in riparian areas and/or surface waters.
All vegetative plantings, performance criteria and other mitigation requirements for riparian
restoration, enhancement and preservation must follow the requirements in 15A NCAC 02B .0295 to
be eligible for buffer and/or nutrient offset mitigation credits. For any areas depicted as not being
viable for nutrient offset credit above, one could propose a different measure, along with supporting
calculations and sufficient detail to support estimates of load reduction, for review by the DWR to
determine viability for nutrient offset in accordance with 15A NCAC 02B .0703.
This viability assessment will expire on June 15, 2024 or upon approval of a mitigation plan by
the DWR, whichever comes first. This letter should be provided in any nutrient offset, buffer,
stream or wetland mitigation plan for this Site.

utilize their authorities to carry out programs for the conservation of threatened and endangered

species and to determine whether projects may affect threatened and endangered species and/or
designated critical habitat.
A Biological Assessment is required for construction projects (or other undertakings having
similar physical impacts) that are major Federal actions significantly affecting the quality of the
human environment as defined in the National Environmental Policy Act (42 U.S.C. 4332(2)
(c)). For projects other than major construction activities, the Service suggests that a biological
evaluation similar to a Biological Assessment be prepared to determine whether the project may
affect listed or proposed species and/or designated or proposed critical habitat. Recommended
contents of a Biological Assessment are described at 50 CFR 402.12.
If a Federal agency determines, based on the Biological Assessment or biological evaluation, that
listed species and/or designated critical habitat may be affected by the proposed project, the
agency is required to consult with the Service pursuant to 50 CFR 402. In addition, the Service
recommends that candidate species, proposed species and proposed critical habitat be addressed

Migratory Birds: In addition to responsibilities to protect threatened and endangered species
under the Endangered Species Act (ESA), there are additional responsibilities under the
Migratory Bird Treaty Act (MBTA) and the Bald and Golden Eagle Protection Act (BGEPA) to
protect native birds from project -related impacts. Any activity, intentional or unintentional,
resulting in take of migratory birds, including eagles, is prohibited unless otherwise permitted by
the U.S. Fish and Wildlife Service (50 C.F.R. Sec. 10.12 and 16 U.S.C. Sec. 668(a)). For more
information regarding these Acts see https://www.fws.gov/birds/policies-and-regulations.php.
The MBTA has no provision for allowing take of migratory birds that may be unintentionally
killed or injured by otherwise lawful activities. It is the responsibility of the project proponent to
comply with these Acts by identifying potential impacts to migratory birds and eagles within
applicable NEPA documents (when there is a federal nexus) or a Bird/Eagle Conservation Plan
(when there is no federal nexus). Proponents should implement conservation measures to avoid
or minimize the production of project -related stressors or minimize the exposure of birds and

In addition to MBTA and BGEPA, Executive Order 13186: Responsibilities of Federal Agencies

The Britt and Hales Buffer Mitigation Site is located near Mount Olive,
NC, in the Upper Falling Creek watershed of the Neuse River Basin
(HUC 03020201). The proposed project will provide riparian buffer and
nutrient offset mitigation in the Neuse River Basin. The project involves
the restoration and preservation of riparian buffers along two unnamed
tributaries and three ditches that flow to Falling Creek. Land disturbing
activities include site preparation for planting trees to enhance the
vegetative buffer up to 200 feet from the streams and ditches within the
approximate 24.7-acre project easement. The project area and surrounding
areas are open agricultural land, primarily farmed for row crops.
Historical land use has been agriculture for the past 70 years according to
historical USDA aerials. The project site will be permanently protected
and preserved with a conservation easement that will ultimately be
transferred to a land trust for long-term stewardship.

Probability of Presence (■)
Each green bar represents the bird's relative probability of presence in the 10km grid cell(s) your
project overlaps during a particular week of the year. (A year is represented as 12 4-week
months.) A taller bar indicates a higher probability of species presence. The survey effort (see
below) can be used to establish a level of confidence in the presence score. One can have higher
confidence in the presence score if the corresponding survey effort is also high.
How is the probability of presence score calculated? The calculation is done in three steps:
1. The probability of presence for each week is calculated as the number of survey events in
the week where the species was detected divided by the total number of survey events for
that week. For example, if in week 12 there were 20 survey events and the Spotted Towhee
was found in 5 of them, the probability of presence of the Spotted Towhee in week 12 is
0.25.
2. To properly present the pattern of presence across the year, the relative probability of
presence is calculated. This is the probability of presence divided by the maximum
probability of presence across all weeks. For example, imagine the probability of presence
in week 20 for the Spotted Towhee is 0.05, and that the probability of presence at week 12
(0.25) is the maximum of any week of the year. The relative probability of presence on
week 12 is 0.25/0.25 = 1; at week 20 it is 0.05/0.25 = 0.2.
3. The relative probability of presence calculated in the previous step undergoes a statistical
conversion so that all possible values fall between 0 and 10, inclusive. This is the
probability of presence score.

its entire range. If there are no yellow bars shown for a bird, it does not breed in your project

Survey Effort (I)

surveys is expressed as a range, for example, 33 to 64 surveys.

Survey Timeframe
Surveys from only the last 10 years are used in order to ensure delivery of currently relevant

Nationwide Conservation Measures describes measures that can help avoid and minimize
impacts to all birds at any location year round. Implementation of these measures is particularly
important when birds are most likely to occur in the project area. When birds may be breeding in
the area, identifying the locations of any active nests and avoiding their destruction is a very
helpful impact minimization measure. To see when birds are most likely to occur and be breeding
in your project area, view the Probability of Presence Summary. Additional measures or permits
may be advisable depending on the type of activity you are conducting and the type of
infrastructure or bird species present on your project site.
What does IPaC use to generate the migratory birds potentially occurring in my specified
location?
The Migratory Bird Resource List is comprised of USFWS Birds of Conservation Concern
(BCC) and other species that may warrant special attention in your project location.
The migratory bird list generated for your project is derived from data provided by the Avian
Knowledge Network (AKN). The AKN data is based on a growing collection of survey, banding,
and citizen science datasets and is queried and filtered to return a list of those birds reported as
occurring in the 10km grid cell(s) which your project intersects, and that have been identified as
warranting special attention because they are a BCC species in that area, an eagle (Eagle Act
requirements may apply), or a species that has a particular vulnerability to offshore activities or
development.
Again, the Migratory Bird Resource list includes only a subset of birds that may occur in your

provided by the Avian Knowledge Network (AKN). This data is derived from a growing

Probability of presence data is continuously being updated as new and better information
becomes available. To learn more about how the probability of presence graphs are produced and
how to interpret them, go the Probability of Presence Summary and then click on the "Tell me

How do I know if a bird is breeding, wintering, migrating or present year-round in my
project area?
To see what part of a particular bird's range your project area falls within (i.e. breeding,
wintering, migrating or year-round), you may refer to the following resources: The Cornell Lab
of Ornithology All About Birds Bird Guide, or (if you are unsuccessful in locating the bird of
interest there), the Cornell Lab of Ornithology Neotropical Birds guide. If a bird on your
migratory bird species list has a breeding season associated with it, if that bird does occur in your
project area, there may be nests present at some point within the timeframe specified. If "Breeds
elsewhere" is indicated, then the bird likely does not breed in your project area.
What are the levels of concern for migratory birds?
Migratory birds delivered through IPaC fall into the following distinct categories of concern:
1. "BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern
throughout their range anywhere within the USA (including Hawaii, the Pacific Islands,
Puerto Rico, and the Virgin Islands);
2. "BCC - BCR" birds are BCCs that are of concern only in particular Bird Conservation
Regions (BCRs) in the continental USA; and
3. "Non -BCC - Vulnerable" birds are not BCC species in your project area, but appear on
your list either because of the Eagle Act requirements (for eagles) or (for non -eagles)
potential susceptibilities in offshore areas from certain types of development or activities
(e.g. offshore energy development or longline fishing).
Although it is important to try to avoid and minimize impacts to all birds, efforts should be made,
in particular, to avoid and minimize impacts to the birds on this list, especially eagles and BCC
species of rangewide concern. For more information on conservation measures you can
implement to help avoid and minimize migratory bird impacts and requirements for eagles,
please see the FAQs for these topics.
Details about birds that are potentially affected by offshore projects
For additional details about the relative occurrence and abundance of both individual bird species
and groups of bird species within your project area off the Atlantic Coast, please visit the

Bird tracking data can also provide additional details about occurrence and habitat use
throughout the year, including migration. Models relying on survey data may not include this

What if I have eagles on my list?
If your project has the potential to disturb or kill eagles, you may need to obtain a permit to avoid
violating the Eagle Act should such impacts occur.
Proper Interpretation and Use of Your Migratory Bird Report
The migratory bird list generated is not a list of all birds in your project area, only a subset of
birds of priority concern. To learn more about how your list is generated, and see options for
identifying what other birds may be in your project area, please see the FAQ "What does IPaC
use to generate the migratory birds potentially occurring in my specified location". Please be
aware this report provides the "probability of presence" of birds within the 10 km grid cell(s) that
overlap your project; not your exact project footprint. On the graphs provided, please also look
carefully at the survey effort (indicated by the black vertical bar) and for the existence of the "no
data" indicator (a red horizontal bar). A high survey effort is the key component. If the survey
effort is high, then the probability of presence score can be viewed as more dependable. In
contrast, a low survey effort bar or no data bar means a lack of data and, therefore, a lack of
certainty about presence of the species. This list is not perfect; it is simply a starting point for
identifying what birds of concern have the potential to be in your project area, when they might
be there, and if they might be breeding (which means nests might be present). The list helps you
know what to look for to confirm presence, and helps guide you in knowing when to implement

Falling Creek watershed of the Neuse River Basin (HUC 03020201). The proposed project
will provide riparian buffer and nutrient offset mitigation in the Neuse River Basin. The
project involves the restoration and preservation of riparian buffers along two unnamed
tributaries and three ditches that flow to Falling Creek. Land disturbing activities include
site preparation for planting trees to enhance the vegetative buffer up to 200 feet from
the streams and ditches within the approximate 24.7-acre project easement. The

project area and surrounding areas are open agricultural land, primarily farmed for row
crops. Historical land use has been agriculture for the past 70 years according to
historical USDA aerials. The project site will be permanently protected and preserved
with a conservation easement that will ultimately be transferred to a land trust for long-
term stewardship.
The NC State Historic Preservation Office's online mapping resource was reviewed to
determine the presence of known historic resources at or near the project site.
According to the database, there are no known historical resources within the project
site. The Littleton House (WY0384) is the closest resource which is located 2.3 miles
from the project site. The Littleton House is classified as a "Survey Only" site and will not
be disturbed for the proposed project.

US BROWNFIELDS: A Listing of Brownfields Sites
Brownfields are real property, the expansion, redevelopment, or reuse of which may be complicated by the presence
or potential presence of a hazardous substance, pollutant, or contaminant. Cleaning up and reinvesting in these
properties takes development pressures off of undeveloped, open land, and both improves and protects the environment.
Assessment, Cleanup and Redevelopment Exchange System (ACRES) stores information reported by EPA Brownfields
grant recipients on brownfields properties assessed or cleaned up with grant funding as well as information on

The EPA has set ambitious goals for the RCRA Corrective Action program by creating the 2020 Corrective Action
Universe. This RCRA cleanup baseline includes facilities expected to need corrective action. The 2020 universe
contains a wide variety of sites. Some properties are heavily contaminated while others were contaminated but

When Congress passed the Clean Air Act Amendments of 1990, it required EPA to publish regulations and guidance
for chemical accident prevention at facilities using extremely hazardous substances. The Risk Management Program
Rule (RMP Rule) was written to implement Section 112(r) of these amendments. The rule, which built upon existing
industry codes and standards, requires companies of all sizes that use certain flammable and toxic substances
to develop a Risk Management Program, which includes a(n): Hazard assessment that details the potential effects
of an accidental release, an accident history of the last five years, and an evaluation of worst -case and alternative
accidental releases; Prevention program that includes safety precautions and maintenance, monitoring, and employee
training measures; and Emergency response program that spells out emergency health care, employee training measures
and procedures for informing the public and response agencies (e.g the fire department) should an accident occur.

The EDR Proprietary Manufactured Gas Plant Database includes records of coal gas plants (manufactured gas plants)
compiled by EDR's researchers. Manufactured gas sites were used in the United States from the 1800's to 1950's
to produce a gas that could be distributed and used as fuel. These plants used whale oil, rosin, coal, or a mixture
of coal, oil, and water that also produced a significant amount of waste. Many of the byproducts of the gas production,
such as coal tar (oily waste containing volatile and non-volatile chemicals), sludges, oils and other compounds
are potentially hazardous to human health and the environment. The byproduct from this process was frequently
disposed of directly at the plant site and can remain or spread slowly, serving as a continuous source of soil
and groundwater contamination.

Groundwater flow direction for a particular site is best determined by a qualified environmental professional
using site -specific well data. If such data is not reasonably ascertainable, it may be necessary to rely on other
sources of information, such as surface topographic information, hydrologic information, hydrogeologic data
collected on nearby properties, and regional groundwater flow information (from deep aquifers).
TOPOGRAPHIC INFORMATION
