Thank you for your PCN, dated 8/29/2022, for the above referenced project. I have reviewed the information and need
clarification before proceeding with verifying the use of Regional General Permit (RGP) 50 (https://saw-
reg.usace.army.mil/RGP/RGP50.pdf). Please submit the requested information below (via e‐mail is fine) within 30 days
of receipt of this Notification, otherwise we may deny verification of the use of the RGP or consider your application
withdrawn and close the file:

1) Section G.5 of the PCN references “Small whorled pogonia habitat in the form of dry deciduous woods and moist
slopes are present on the site A review of NHP records on or updated January 22, 2019 indicates no known
occurrences within 1.0 mile of the study area. A survey was conducted, and no specimens were observed. This
project will have no effect on small whorled pogonia.”; however, no specific survey information or date is
provided in the PCN. Please provide this information to enable the Corps to either make a No Effect
determination or facilitate coordination with the USFWS for listed species in the Action Area.
Further, USFWS recommends a field surveys validity period of 2 years for Schweinitz’s sunflower and 1 year for
small whorled pogonia (https://www.fws.gov/story/2022-03/north-carolinas-federally-threatened-endangered-
and-risk-plant-species). Given the presence of potentially suitable habitat on-site for both of these species, have
the field surveys been updated to meet these durations?
2) To provide complete information pertaining to Section G.7 of the PCN, please provide NCDOT’s typical historic
properties and archeological resources survey (or no survey required) documents for this project. This
information is necessary for the Corps to either make a No Potential to Effect determination or document that
coordination with the SHPO is complete.
3) Site 1:
a. Please provide additional information pertaining to what activities are specifically proposed within East
Fork Deep River, including:
i. Is rip rap stabilization proposed on the banks only, or also within the stream bed?
ii. Are floodplain benches proposed along any portion of East Fork Deep River; if so, please provide
a detail showing their cross-section and materials;
b. Please provide a cross-section detail of the stream relocation and describe how the feature will be
stabilized.
