PROJECT SUMMARY. The applicant proposes to remove concrete, construct bulkhead, construct a pier with boatlift, catwalk and launch pier. John and Deborah Logelfo Beaufort County Project setting The project site is located off NC Highway 99 at 102 Carteret Street in the Town of Bath adjacent to Bath Creek in Beaufort County, North Carolina The lot is approximately 0.43 acres (18,774 ft) in size and has approximately 90 linear feet of shoreline along the Creek The landowner and applicant, Mr John Logelfo owns and operates a restaurant on the adjoining property. A crushed stone parking area is located on the subject property that is used for parking of restaurant patrons The elevation of the lot is approximately 4 0' above Normal Water Level The subject property is located in an approximately 90 degree corner of shoreline. The subject property faces due north with an east/west shoreline. In addition to the crushed stone parking area, the shoreline has been bulkheaded and a large area of approximately 3 50 ft2 of poured concrete is located on the waterside of the bulkhead The concrete extends approximately 10 ft waterward of the existing bulkhead The project site also has a concrete boatramp with remnant launch pier on the east side of the boat ramp The downstream (west side) property has the same orientation as the project site property. This property is undeveloped, however the shoreline is stabilized with broken concrete and riprap. The upstream property faces due west with a north/south shoreline. This property is an undeveloped bulkheaded lot Bath Creek is classified as SB NSW by the Environmental Management Commission at the project site Bath Creek is Inland Fishing waters and is classified as a Primary Nursery Area by the Wildlife Resources Commission Bath Creek is not open to shell fishing The project site is located within the Bath Historic District Project description The applicant proposes to remove the poured concrete on the waterside of the bulkhead. Once the concrete has been removed the applicant proposes to construct 72 linear feet of new bulkhead 2' waterward of the existing one Also the applicant proposes to construct a 4' wide by 21' long launch pier on the east side of the existing boat ramp A 4' wide by 33' long pier will be constructed on the west side of the boat ramp This pier will then turn slightly to the northwest for a distance of 25' and narrow to 3' in width. The angled pier is configured to fit within the pie shaped riparian corridor established by the Division of Coastal Management. The applicant also proposes an uncovered boatlift on the southern side of the angled section of pier. A 2' wide by 25' long finger pier will be located around the boat lift. The applicant proposes to remove the poured concrete on the waterside of the bulkhead. I have reviewed the proposed project with regard to rules found in Subchapter 7H concerning development in a Public Trust Area and Coastal Shoreline. It is staff's recommendation that the proposed project appears consistent with 15A NCAC 07H .0208 and 15A NCAC .0209 as described below. This office also feels the construction of the pier is consistent with 15A NCAC .0208(b)(6)(I) which states in part "Piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's areas of riparian access ". The applicant has designed the proposed pier such that all structures are greater than 15' from the adjacent riparian lines. Staff recommend the following conditions be included if the project is permitted. 1. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work 2. This permit authorizes only the structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 3. The bulkhead shall be constructed prior to any backfilling activities. 4 The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 5. The owners are trying to enhance their existing recreational access. They plan a pier 4' x 21' on the east side of the existing boat ramp and on the west side of the boat ramp, a pier 4' x 33' turning and continuing 3' x 25' with boat lift to allow access for a 22' sport fishing boat of the owners. The requested improvements will allow full utilization of the waterfront property. If the boat lift is approved, they would want a finger access 2' x 10' and 2' x 15' around the lift. The proposed pier will be 4' wide and 21' long ( 84 sq.ft. ) on the east side of the existing boat ramp. The proposed pier on the west side of the boat ramp will be 4' x 33' (132 sq.ft. ) turn northwest and narrow to a 3' x 25' pier 75 sq.ft. ) The boat lift will join alongside the 3' portion, with a finger pier 2' wide x 25' ( 50 sq.ft. ) to wrap around for access. The boat lift will be 15' wide (inside) by 22' long and include a hoist for lifting the boat. The owners plan about 72' of new bulkhead to add protection from storms. This is to be located along the old bulkhead and will remove several portions of old dumped concrete from years past. This will clean up the shoreline and improve the stabilization. T. j.'s Marine Construction is the contractor selected for this project. They will barge in a vibrating hammer and materials as needed.
