Based on my interpretation of the Neuse Buffer Rules, because this ditch does not appear as a stream on either of these maps it is NOT subject to the rules. Once it reaches the woods it DOES appear as a stream, so I wouldn't go any further than the treeline without first having an on -site determination completed by the NC Division of Water Resources or other individual approved to make stream determinations. As far as wetlands are concerned, based on past conversations with the US Army Corp of Engineers, it is our understanding that existing drainage ditches can be cleaned out to their original debth and spoil place on the original spoil pile without any issues. Weyerhaeuser should be very familiar with this issue since they clean out alot of existing ditches on their woodland now. Ditch #2 - DOES appear on the NRCS soil survey map as a stream and a portion appears on the USGS topo map as a stream. This means that this ditch MAY be subject to the Neuse Buffer rules and an onsite determination by the NC Division of Water Resources or other authorized person is recommended before any construction activities are completed. One other issue to consider is that the timber on this tract was ,.recently cut. It has been my experience that no reputable logger will cut timber along a potential stream t without having a stream determination completed prior to harvest. 1 would recommend that the individual you spoke to about the ditching speak to the Weyerhaeuser representative in charge of timber harvest r' "operations and see if this ditch has already had a stream determination completed. Potential wetland issues are the same as discussed above for ditch #1. Ditch #3 - DOES appear on the USGS topo map as a stream and may be subject to the Buffer Rule however, the timber on both sides of this ditch has also recently been clear cut meaning that it is likely that this ditch was previously determined to not be subject to the buffer rule. Also, this ditch is very straight which indicates that it is completely man -made. Man -made ditches are also not supossed to be subject of the buffer rule unless they are modified natural streams. This ditch does not appear to be a modified natural stream however I am not authorized to make that decision. Wetland issues are the same as discussed above for ditch 1 & 2. It appears to me that ditch #1 is free and clear to be cleaned out to the woods line however 1 recommend a closer look into #2 & 3 and that an on -site determination be completed before construction activities if one has not apready been done.
