Project Setting
The project site is home to a private historic waterfowl hunt club. The parcel ID is listed as
parcel # 006900000540000 Piney Island Road and can be accessed from SR 1142
(waterlily Road) Coinjock, Currituck County, and is adjacent to the Intracoastal Waterway
(ICW) in Coinjock Bay. The vast majority of the 925 acre parcel is undeveloped, made up of
several Coastal and non -coastal wetlands with areas of high ground. Man-made structures
on the lot consist of a clubhouse, boat sheds, outbuildings, impoundments, rock and
earthen roads, a boat basin, a boat ramp, and hunting blinds. Based on available
information, no archaeological sites are on or near this property. Both adjacent riparian
properties are undeveloped areas made up of coastal and non -Coastal Wetlands.
The proposed project area is a narrow strip of land that is approximately 715' in length
which parallels a non -coastal wetland area which is just south of the clubhouse. In this area
there is a path made up of timber mats which allows access for members from the
clubhouse area to travel to an existing impoundment and the peninsula of the property
adjacent to Piney Island Bay. In 1991, there was a settlement agreement between the Piney
Island Gun Club of Currituck and the North Carolina Division of Coastal Management which
allows for the continuing use of 83 timber mats, 16' in length by 10' wide, provided the
footprint remains constant (see attached settlement agreement). These mats can be seen
from aerial imagery. This agreement does not allow for any additional timber mats but does
allow for maintenance and repair to the existing mats. The elevation of this path is
approximately 3' above NWL.
The location of the proposed work is within Coinjock Bay which connects to the Currituck
Sound, is immediately adjacent to the Intracoastal Waterway (AIM) and is classified as
Joint waters by agreement with the Marine Fisheries Commission and Wildlife Resources
Commission. The Division of Environmental Management's water quality classification for
this area is SC and it is closed to shellfish taking. Water depths within the project site range
from -1' to -2' and average -1.5'. Submerged aquatic vegetation, as per DMF's definition,
was observed near the project area (See attached SAV Survey conducted on 6-1-2022).
Development Proposal
To prevent further erosion and to protect the timber mat path providing access to the
impoundment and the peninsula, the applicant proposes to reconfigure and add to the
height of an existing riprap shoreline. The proposed reconfiguration of the riprap will begin
on the shoreline immediately adjacent to an existing impoundment and travel north following
the shorelines alignment. To begin, the proposed design will start with a 170' long revetment
with a base 12' wide. The revetment will then leave a 5' gap before continuing for an
additional 253'. Please note: this section of the shoreline had a 74' section (near the
proposed gap area) that was not previously hardened. At this point the revetment base
widens from 12' to 16' for 234'. This 16' wide section of riprap will have a crest hight of 4.5'
above NWL and 1.5' above the existing riprap height. The revetment then narrows for the
last 42' back to a base width of 12'
Lastly, the applicant proposes to construct a 15 linear foot riprap sill which has a base 10'

wide positioned 5' waterward of the gap left in the proposed revetment alignment.
Anticipated Impacts
• The re -configuration of the riprap along the proposed alignment will result in the filling
9,324 ft2 of the PTA and EW AEC 699' of the shoreline along the ES AEC.
• The riprap sill will fill 150 ft2 within the PTA and EW AEC.

Background
On April 6, 2022, the United States Supreme Court issued an order staying a lower court's vacatur of the
Trump Administration's 2020 "Clean Water Act Section 401 Certification Rule" ("Federal Rule"). As a result of
the United States Supreme Court order, the Trump Administration's Federal Rule has sprung back into effect.
The Trump Administration's Federal Rule imposes additional procedural requirements on applicants for 401
Certifications and on DWR's processing of those applications. One requirement is that 401 applicants must
request a pre -filing meeting request at least 30 days prior to submitting their 401 application. [40 C.F.R.
§121.4] In turn, the Federal Rule requires that applicants include documentation of their pre -filing meeting
request in their 401 Certification application. [40 C.F.R §121.1; 40 C.F.R. §121.5]. Please refer to the Federal
Rule for more information.
Per 40 CFR §121 and §121.5, a 401 Certification application that does not include the required pre -filing
meeting request documentation does not constitute a "certification request." As a result of the reinstatement
of the Trump Administration's Federal Rule, all 401 applications received after April 6, 2022 that do not have
documentation that a pre -filing meeting request was submitted at least 30 days prior to submittal of a 401
Certification application will be returned as incomplete.

Piney Island Club is a private waterfowl hunt club located in Waterlily, Currituck County, NC.
This is an approximately 925-acre tract that is accessible from SR 1142 (Waterlily Road) and
fronts on Coinjock Bay (Currituck Sound). The shoreline is immediately adjacent to the Atlantic
Intracoastal Waterway (AIWW) which is utilized by vessels of all sizes, including power yachts
that generate large wakes that cause erosion to the shoreline of the Site, including coastal
wetland and upland areas. Sheet 1 of 4 in the CAMA Major Plan Set is an overview of the
entire Site. The property includes large expanses of coastal marsh, waterfowl impoundments,
upland areas (wooded and open), Section 404 non -coastal wetlands, a lodge, boat basin, the
clubhouse, outbuildings, boat storage shed and earthen roads. The most recent CAMA permit
is a CAMA Minor Permit (M22-18) that was for berm and water control structure repair in what is
referred to as their Southern Impoundment that is partially within the 75 ft estuarine AEC. Other
relatively recent CAMA Permits include CAMA General Permits (GPs) for shoreline stabilization
rock work (revetments).
Due to wind generated waves couple with the incessant boat wake from the AIWW, the
shoreline needs to be protected. Much of the existing shoreline has rock rip rap and there are
short timber groins along the shoreline than extends from the north side of the boat basin to the
north (approximately 500 ft). There are also timber mat paths that have been allowed to be
placed in a designated location to access the upland areas on the north side of the tract (along
the shoreline) and another on to the south of the lodge area to the Southern Impoundment.
There was a 1991 legal settlement agreement between NC Division of Coastal Management
(NCDCM) and Club that has allowed these timber mat roads or paths to remain in the estuarine
and coastal wetland AECs. That agreement does not allow additional timber mat roads, but
does allow maintenance and upkeep to ensure access to the northern and southern portions of
the Site along the shoreline.
There is a Section of the southern shoreline that is in immediate need of additional stabilization
for the erosion reasons indicated above and also due to sea level rise (and potentially
subsidence) that has affected the property. Sheet 2 includes existing conditions and Sheet 3
includes the proposed rock enhancement in this area. The reason that this requires a CAMA
Major Permit instead of a CAMA GP is due to the height of rock that is needed in the area
where the timber mats are very close to the Sound (which is also coastal wetlands). The rest of
the rock enhancement is not adjacent to coastal wetlands. The green shaded area is coastal
wetland and the red is Section 404 non -coastal. A GP only allows rock to be 0.5' above the
adjacent coastal wetland substrate and this has proven not to be sufficient due to waves, wake
and high wind tides in general that batter this shoreline. The timber mats frequently become
displaced in this area and there has been coastal wetland loss. The new rock would be in the
same general alignment of the rock that already exists, but the height and width would be
increased. Please refer to the second cross-section on Sheet 4 that depicts what this would
look like. The upper cross-section is what the rest of the proposed rock enhancement work
would look like.
In June, 2022, we performed an SAV and water depth survey by developing transects and
utilizing the Braun-Blaunquet (B-B) method of sampling by estimating coverages. There is no
SAV located in the footprint of the proposed rock. Our CAMA Plans show a line of the first
occurrence of any SAV along this stretch of shoreline. There are no beds of SAV within 10 ft of
the outer edge of the rock and only a few locations had minor SAV (B-B score of 1) within 10 ft

of any rock. A B-B score of 1 is less than 5% cover. One of the reasons for low SAV cover
close to shore is the silt -laden water close to shore due to wave/wake erosion. Another reason
is the very shallow depths. These areas are dry during extreme low wind tides events.

sill/revetment would enhance the shoreline protection to better portect the marsh, berm, and road. The new sill cap would be

That the said Party of the First f� t4 for and in consideration of the stun of TEN
DOLLARS ($10.00), and other good and v able consideration to it in hand paid, the
receipt of which is hereby acknowledged, has bined and sold and by these presents does
bargain, sell and convey unto the said Party of the Cecond Part. its successors and assigns,
all merchantable timber of whatever size, shape or dimension, subject to the hereinafter
stated conditions, lying or standing upon that certain trl of land situate in Currituck
County, North Carolina, and being more particularly describedSfollows:
That certain tract of land shown and delineated on that cerin sketch entitled
in part "PINEY ISLAND GUN CLUB TRACT", whit tOsaid sketch is
attached hereto and is incorporated herein by reference. The a delineated
as "Sale Area" on the attached sketch is the area within which a chantable
timber is hereby conveyed.
But this conveyance is made subject to and together with the fol1owyg conditions,
restrictions, and exceptions:
1. The Party of the Second Part, its agents, licensees and assigns, is hereanted
the full term of thirty-six (36) months from the date of the last Nobly Putslic's
acknowledgement appealing hereon during which to cut and remove the said timber from
the subject tract. All timber not cut and removed from the tract on or before the expiration

of the thirty-six (36) month cutting period, shall remain the property of the Party of the First
0 Part, its successors and assigns.
2. The timber sold hereby is to be cut commercial clearcut, with the exception of all
cola c trees, which are reserved by the Party of the First Part. Should an oak tree be damaged
durciphe logging process to a degree that mortality of the tree is in question, that tree
should b,ut and removed, but every effort should be made to avoid damaging the oak trees
located ore e tract. The Party of the Second Parties is encouraged to cut the timber as
thoroughly a4cleanly as possible, and the Party of the Second Part has the minimal
responsibility of� ng all trees (with the exception of oak trees) which measure 8 inches
d.b.h. or larger and which have 15 feet or more of usable length.
3. No red-painteroperty line or cutting boundary trees or pink -flagged trees are to
be cut, and no tops, slasl% other logging debris shall be left within any fields, across
property boundary lines, wit ny ditches, ponds or management waterways within or
adjoining the subject front tract(r across any cutting boundary lines. No decking or
skidding will be allowed within anareas, ponds or marsh areas within or adjoining
the subject tract.
4. Access to the timber will be frc Piney Island Road (NCSR 1145), and along
the excellent maintained road system of the Ut( Club. The Gun Club's road system must
be kept in a good condition at all times, and shat of be blocked by trucks or equipment
during the logging operation. The road system must be maintained in a smooth and unrutted
condition, free of all mats, boards, and the like, and saroad system must be left in a
condition which is equal to or better than its condition pro the commencement of the
logging operation. Following the completion of the logging ope $lion, the tract must be left
in a good condition with all trash, cans, tires, and other debris to bOe.noved from the tract
prior to the completion of the logging operation.
5. The Party of the Second Part, its agents, licensees, and assigns, e311 abide by the
Best Management Practice Guidelines concerning water quality, as outlin
the North
Carolina Forest Service. Further, the Party of the Second Part, its agents, li1sees and
assigns, shall comply with all pertinent statutes of the State of North Carolina, as" ) as
with all State regulations and with all Federal statutes and regulations.

6* 6. The Party of the Second Part shall contact Frazier Consulting Foresters, PC a
�c) minimum of twenty-four hours prior to the commencement of any logging operation.
r 7. By its acceptance of this Timber Deed. the Party of the Second Part agrees to
iernnify and hold harmless the Party of the First Part from and against any claims, losses,
date or expense to the Party of the First Part resulting from the actions or omissions of
the Parte the Second Part or its agents, assigns, or employees associated with the logging
of the tra? Further, the Party of the Second Part agrees to buy and maintain adequate
workman'sllcpensation and general liability insurance coverage.
TO HA r AND TO HOLD the said timber, lying or standing upon the lands
described herein, subject to the hereinabove stated conditions, together with all rights and
privileges hereinabove se�rout, to the Party of the Second Part, its successors and assigns, in
fee simple forever.
And the said Party of (First Part does covenant to and with the said Party of the
Second Part that it is seized of sci l timber and fee simple and has the right to convey the
sane, that said timber is free and of all encumbrances and that it will warrant and
defend the title herein conveyed against thr� awful claims of all persons whomsoever.

DEVELOPMENT PERMIT
The NC Department of Environmental Quality hereby gives public notice as required by
NCGS 113A-119(b) that application for a development permit in an AEC as designated
under the CAMA was received on 09/07/22. The Piney Island Gun Club of Currituck
proposes to reconfigure and add height to the existing low profile riprap shoreline and
construct a small riprap sill located at Parcel ID #006900000540000 Piney Island Road,
Coinjock in Currituck County.
A copy of the entire application may be reviewed at the office of the Division of Coastal
Management, located at 401 S Griffin St, Ste 300, Elizabeth City, NC, 252-264-3901
during normal business hours. Comments mailed to Braxton Davis, Director, DCM, 400
Commerce Avenue, Morehead City, NC 28557, prior to 10/01/22, will be considered in
making the permit decision. Later comments will be considered up to the time of permit
decision. Project modification may occur based on review & comment by the public, state
& federal agencies. Notice of the permit decision in this matter will be provided upon
written request.
