I am checking on the status of two permits WQ0019962 and WQ0019963. We have never used these Spray Irrigation Permits and wish not to renew them. We requested to rescind both permits by a letter sent to you dated November 21,2014. f . .- z An invoice "2015PR003111" vvd�.mailed to us June 23, 2015 that 06ntained an invoice date of April 7, 2015 and a due date of May 7, 2015. These dates are over two months and one month, respectively, earlier than the invoice was mailed. The invoice is for one of the permits that we are dropping WQ0019962. I contacted Kim Colson on 8/5/2015 and got no response and again on 8/7/2015 when he told me the permits were under review to check for grants. We have heard nothing. I contacted Mr. Colson on 3/22/2016 and have no response yet. We would like to know the status of these permits we have been trying to drop since 2014. There is no minimum irrigation requirement for this permit. NDMR's and NDAR's are submitted monthly showing no discharge to either site. Irrigation lines damaged at Berkley Field due to construction activity have not been repaired. Sprayheads damaged at Patton Park due to renovations have not been repaired. Both sites will require repairs before reuse effluent can be sprayed. The following issues should be addressed before irrigation begins: 1)Permit Condition 111.3. - A continuous recording flow meter should be installed to measure flow at the influent or effluent for the irrigation system. 2)Permit Condition 1.8. - Public access control during active site use - signs should be posted. CIU SRG 4 NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES RALEIGH RECLAIMED WATER UTILIZATION PERMIT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERIMISSION IS HERESY GRANTED TO City of Hendersonville Henderson County FOR THE construction and operation of a 17,460 GPD reclaimed water utilization system consisting of one (1) 75 GPM skid -mounted pumping unit with one (1) irrigation system having approximately one hundred eighteen (118) 6.5 GPM sprinklers, associated piping, valves and appurtenances located at Berkley Park; and a 21,725 GPD reclaimed water utilization system consisting of one (1) 75 GPM skid -mounted pumping unit with one (1) irrigation system having approximately ninety-nine (99) 6.5 GPM sprinklers, associated piping, valves and appurtenances located at Patton Park to serve the City of Hendersonville with no discharge of wastes to the surface water, pursuant to the application received May 1, 2001, and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until September 30, 2006, and shall be subject to the following specified'conditions and limitations: I. PERFORMANCE STANDARDS 1. Upon completion of constriction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting materials. If this project is to be completed in phases and partially certified, you shall retain the responsibility to track further constriction approved under the same permit, and shall provide a final certificate of completion once the entire project has been completed. Mail the Certification to the Non -Discharge Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617. 2. The Asheville Regional Office, Telephone number (828) 251-6208, shall be notified at least forty-eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be made. Such notification to the Regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m., Monday through Friday, excluding State holidays. 3. The reclaimed water utilization facilities shall be effectively maintained and operated at all times so that there is no discharge to the surface water, nor any contamination of groundwater which will render them unsatisfactory for normal use. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions or failure of the irrigation area to adequately assimilate the wastewater, the Permittee shall take immediate corrective actions including those actions that may be required by the Division of Water Quality, (Construction Grants & Loans Section), such as the constriction of additional or replacement wastewater treatment and disposal facilities. 4. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwater resulting from the operation of this facility. 5. The residuals generated from these treatment facilities must be disposed in accordance with General Statute 143-215.1 and in a manner approved by the Division. 6. Diversion or bypassing of the untreated wastewater from the treatment facilities is prohibited. 7. The following buffers shall be maintained: a) 100 feet between wetted areas and water supply wells, b) 100 feet between wetted areas and water classified as SA, c) 25 feet between wetted areas and surface water not classified as SA, d) 100 feet between wastewater treatment units and wells, e) 50 feet between reclaimed water storage/irrigation ponds and property lines, and f) 50 feet between wastewater treatment units and property lines. 8. Public access to the irrigation sites shall be controlled during active site use. Such controls may include the posting of signs showing the activities being conducted at each site. A sign shall be posted in plain sight showing these activities. II. OPERATION AND MAINTENANCE REQUIREMENTS 1. The facilities shall be properly maintained and operated at all times. 2. Upon classification of the facility by the Water Pollution Control System Operators Certification Commission (WPCSOCC), the Permittee shall employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the wastewater treatment facilities. The operator must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the wastewater treatment facilities by the WPCSOCC. The Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of 15A NCAC 8G .0202. The ORC of the facility must visit each Class I facility at least weekly, each Class II, III, and IV facility at least daily, excluding weekends and holidays, must properly manage and document daily operation and maintenance of the facility, and must comply with all other conditions of 15A NCAC 8G .0202. Once the facility is classified, the Permittee must submit a letter to the WPCSOCC, which designates the operator in responsible charge within thirty days (30) after the wastewater treatment facilities are 50% complete. 3. A suitable, year-round vegetative cover shall be maintained on the irrigation areas. 4. Irrigation shall not be performed during inclement weather or when the ground is in a condition that will cause runoff. 5. Adequate measures shall be taken to prevent wastewater runoff from the spray field. 6. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. 7. For Berkley Park, the annual application rate shall not exceed a cumulative loading of 45.7 inches over any twelve (12) month period. Wastewater shall be applied to spray zones 1 - 15 (totaling 5.0 acres), shall not exceed the maximum instantaneous irrigation loading rate of 0.25 inch/hour, and shall not exceed a maximum annual average loading rate of 0.9 inches/week. For Patton Park, the annual application rate shall not exceed a cumulative loading of 71.5 inches over any twelve (12) month period. Wastewater shall be applied to spray zones 1 - 10 (totaling 4.0 acres), shall not exceed the maximum instantaneous irrigation loading rate of 0.25 inch/hour, and shall not exceed a maximum annual average loading rate of 1.4 inches/week. 9. No type of wastewater other than that from the City of Hendersonville shall be sprayed onto the irrigation area. 10. All wastewater shall either be rerouted to the headworks of the Hendersonville wastewater treatment facility or discharged in strict accordance with the conditions of the facility's existing NPDES permit should the limit for fecal coliform (daily maximum concentration of 25 per 100 ml) or turbidity (instantaneous maximum of 10 NTU) be exceeded, until such time that the levels have stabilized below these maximum levels. III. MONITORING AND REPORTING REQUIREMENTS Any monitoring (including groundwater, surface water, soil or plant tissue analyses) deemed necessary by the Division to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 2. During the remainder of the year, these parameters shall be monitored monthly. ** Triannually sampling shall be conducted during March, July, and November. s If Groundwater sampling indicates or predicts problems with the compliance with Groundwater Standards, this permit will be modified to include additional and/or more restrictive limitations. 3. Adequate records shall be maintained by the Permittee tracking the amount of wastewater disposed. These records shall include, but are not necessarily limited to the following information: (a) date and time of irrigation, (b) volume of wastewater irrigated, (c) zone irrigated, (d) length of time zone is irrigated, (e) continuous weekly, monthly, and year-to-date hydraulic (inches/acre) loadings for each zone, f. weather conditions, and g. maintenance of cover crops. 4. Three (3) copies of all operation and disposal records (as specified in Condition III 2) on Form NDAR-1 and three (3) copies of all effluent monitoring data (as specified in Conditions I113 and III 4) on Form NDMR-1 shall be submitted on or before the last day of the following month. All information shall be submitted to the following address: NC Division of Water Quality Water Quality Section Non -Discharge Compliance/Enforcement Unit 1617 Mail Service Center Raleigh, North Carolina 27699-1617 A maintenance log shall be maintained at this facility including but not limited to the1-1 following items: (a) Daily sampling results including residual chlorine, settleable matter, and dissolved oxygen in the aeration basin and at the clarifier weir. (b) Visual observations of the plant and plant site. (c) .Record of preventative maintenance (changing of filters, adjusting belt tensions, alarm testing, diffuser inspections and cleanings, etc.). (d) Date of calibration of flow measurement device. (e) Date and results of power intemiption testing on alternate power supply. 6. Noncompliance Notification: The Permittee shall report by telephone to the Asheville Regional Office, Telephone number (828) 251-6208, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: (a) Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a sludge digester; the known passage of a slug of hazardous substance through the facility; or any other unusual circumstances. (b) Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. (c) Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving water without treatment of all or any portion of the influent to such station or facility. (d) Any time that self -monitoring information indicates that the facility has gone out of compliance with its permit limitations. Persons reporting such occurrences by telephone shall also file a written report in letter form within five (5) days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. IV. GROUNDWATER REQUIREMENTS 1. Groundwater monitoring wells not in use shall be properly sealed and capped according to 15A NCAC 2C .0113(a) in case they are put back into use in the future. 2. The compliance boundary and review boundary for wastewater disposal systems are specified by 15A NCAC 2L.. For systems utilizing reclaimed water, 15A NCAC 2H .0219(k) specifies that both the compliance boundary and review boundary shall be established at the property line. An exceedance of groundwater quality standards at or beyond the'compliance boundary is subject to immediate remediation action in addition to the penalty provisions under North Carolina General Statute §143-215.6A(a)(1). 3. Any groundwater quality monitoring, as deemed necessary by the Division, shall be provided. V. INSPECTIONS 1. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 2. The Permittee or his designee shall inspect the wastewater treatment and disposal facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, L and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Pennittee for a period of three (3) years from the date of the inspection and shall be made available upon request to the Division or other permitting authority. 3. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the disposal site or facility at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate. VI. GENERAL CONDITIONS This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. This permit is issued pursuant to T15A:2H:0219(p) for the construction and operation of a reclaimed water utilization facility without flow equalization. In the event that non-compliance with any permit limitation results from the absence of flow equalization, this permit may be administratively reopened, and a requirement for the construction of a flow equalization basin may be incorporated into the permit. 4. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 5. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. The issuance of this permit does not preclude the .Pennittee from complying with any and all statutes, riles, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 7. A set of approved plans and specifications for the subject project must be retained by the Permittee for the life of the project. 8. The annual administering and compliance fee must be paid by the Permittee within thirty days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205 (c)(4). 9. The Permittee, within 90 days following issuance of this permit, shall request modification of NPDES Permit No. NC0025534 issued to the City of Hendersonville wastewater treatment facility. The modification shall amend the existing NPDES permit to allow the conjunctive use of reclaimed water as provided for in this permit. 10. This permit in no way negates, precludes, or invalidates the most recent reissuance of NPDES Permit No. NC0025534, and the Permittee shall continue to comply with all conditions provided for therein. Both systems should be repaired as soon as possible so that irrigation can occur if the need arises. 2) A French drain has been installed at the Patton Park site. In order to ensure the proper operation and maintenance of these systems, this Rule requires that all facilities permitted for the spray irrigation of wastewater be classified as spray irrigation systems. As required by 15A NCAC 8G .0202(b) and the subject permit, a certified operator and back-up operator of the appropriate type must be designated for each classified system. The Water Pollution Control System Operators Certification Commission hereby classifies the subject facility as a Spray Irrigation System effective today, August 6, 2002. Conduct periodic inspections of the project; 2. Review change orders for necessity and reasonableness to determine eligibility for loan funding; 3. Purpose: a. To assure that the overall objectives of the grant, are realized; b. To assure that the grant and project will be administered in accordance with Federal Laws regulations; C. To advise and offer assistance to the Owner; d. To ensure contract compliance and constriction in accordance with the approved contract documents. CIU INSPECTIONS Prior notice will be given; however, unannounced inspections will also be conducted; 2. Inspections will be conducted in two phases: a. Loan Administration b. Project Construction 3. During inspections, CIU will usually review at the job site for completeness and accuracy all shop drawings, submittals, inspector's field reports, as -built drawings, revised construction schedules and records of testing of materials and equipment, and discuss pending or executed change orders. 4. All equipment and materials on job site are requested to be properly stored, stockpiled, and protected. The job site is to be maintained in an acceptable manner. Safe working conditions should be maintained at all times. The CIU will discuss safety violations which are potentially life endangering or threatening serious injury. If necessary, the CIU will take prompt action to notify State and OSHA Regional representatives of any noted conditions. 6. Results of the inspection will be discussed at the job site upon completion of the inspection. -2- 7. Formal copies of the inspection report will be sent to the Recipient, A/E and other parties, if so desired. In order to avoid the situation where the contractor has provided a final punch list of deficiencies by both the A/E and the CIU, the CIU will accompany the A/E on his final punch list inspection. CHANGE ORDERS 1. Recipient should notify DENR-DWQ prior to commencement of any change order work, except for emergency situations, that change the scope of the project. 2. Recipient must obtain prior DENR-DWQ approval for any change orders in excess of $100,000 or any change orders which would necessitate an increase in the amount. 3. Recipient should submit two (2) properly executed copies of change orders to DENR-DWQ. Change order forms should indicate the Federal project number, the correct change order number, name of contractor, contract number, and the date the change order was signed by all parties. 4. A complete detailed justification and clear description must be submitted with each change order to identify the need for the change. This submittal shall include justification and proper documentation for any requested time extensions. 5. Copies of new or revised contract drawings and/or specifications must be submitted with each change order. 6. Unless previously agreed unit prices are used, complete records of price negotiations shall be submitted with each change order. This should include such items as: a copy of the engineer's independent cost estimate, the construction contractor's cost breakdown, and the basis for the final negotiated settlement which would be a Memorandum of Negotiation. 7. Change orders will be disapproved until the above backup documentation is submitted. Work in place required by a non -State approved change order shall not be included in a contractor's partial payment request until the change order is approved. 8. Once the Recipient signs a change order, he obligates himself to the Contractor. The State is not obligated to approve the change order or reimburse the Recipient. The CIU will perform preliminary reviews of unexecuted change orders and provide preliminary eligibility determinations upon request'. 9. No reimbursements will be made for quantity overruns on unit price contract items until a change order which adds the quantities to the contract is approved. -3- RECIPIENT & A/E RES1- = JSIBILITY 1. The Recipient and A/E should become familiar with their responsibilities as defined by 40 CFR. 2. Loan conditions must be met and loan objectives achieved. RECIPIENT PAYMENT REQUEST Recipient should submit all payment requests (SF271) to the State with backup documentation when requested. 2. Recipient should be aware of the 1st, 90%, and final milestone payment requirements. Loan Agreement/Amendments and all conditions placed on them, if applicable, must be satisfied prior to loan payment. ENVIRONMENTAL PROTECTION The Recipient was advised that the protection of the environment is a loan requirement. It is necessary to comply with all environmental pollution control programs established by the city, State, and EPA. This includes, but is not limited to: 1. Protection of existing trees, shrubs, and grass. 2. Dust control of haul roads, excavation, work areas, and borrow areas. 3. Submitting an erosion control plan to the appropriate State agency. 4. Required treatment of Recipient's wastewater during construction. VARIOUS ITEMS The approved set of contract drawings should be furnished to the Recipient, A/E inspector, and to each contractor's supervisor or foreman. These drawings are to be marked up as authorized changes occur and are to be used in preparing as -built (record) drawings. These marked -up drawings shall be maintained and made available for State inspectors. 2. Prior to commencement of work, the A/E requested that the contractor submit a "Construction Progress Schedule" (i.e. Bargraph, CPM, etc.) showing a breakdown of the principal features of construction with the contract costs. The schedule shall be prepared in such a way that the percentage of work completed and the work scheduled for completion at any given date may be determined. This office is requesting copies of these submittals upon authorization of the Recipient's engineer. 3. The A/E's Project Representative stressed the importance of record as-builts and will be reviewing monthly with each contract to insure that they are being maintained. 4. Cooper Construction _-)mpany's Field Operation Manager a��_ - 4fety Director, Jeryld A. Young, Jr. was designated and emphasized their companies job safety. The A/E noted that the NCDOT Encroachment Agreement, Land Quality erosion control permit, and the railroad encroachment have been approved and copies of the approvals were issued to the contractor. All special conditions and permit provisions will need to be met. The owner recommended that the contractor contact the Parks and Recreation Department to ensure that there are no impacts with athletic programs with the proposed work. 6. The contractor noted they have submitted majority the shop drawings for approval. The A/E noted there were many incidental materials (ie.signage, and any equipment that was to be installed) will need to be submitted for review and approval. 7. The contractor noted they were to be utilizing several subcontractors on this project. They will be performing electrical work, irrigation installation and bore and jack crossings. This office requests a list of all subs to be utilized with their nature of work to be performed and dollar value of the work. 8. Formal monthly construction progress meetings will not be scheduled, but would be scheduled if necessary. This office requests that we be sent copies of minutes of all progress meetings. 9. The owner also recommended that the contractor contact Mr. James Lyda, Kimberly- Clark, prior to beginning operations on the plant's ball fields and other areas on their property. 10. Generally, this work consists of the construction of the 4.8 MGD City of Hendersonville WWTP and approximately 5,000 linear feet of 42-inch gravity sewer. Any conditions of the railroad encroachment agreement which affect construction must be added to the project through an approved addendum prior to the receipt of bids. Issuance of this approval letter does not imply availability of funding. You are encouraged not to advertise for bids until you have received the funding offer. Neither the State nor, Federal Government, nor any of their departments, agencies or employees are or w' be a party to the invitation to bids, addenda, any resulting contracts or contract negotiatid hanges. 1s In,accordance with the Federal Regulations, the Recipient is required to assure compliance with the OSHA safety regulations on the subject project. In complying with this regulatory responsibility, the Recipient should, by letter, invite the Training Officer, Standards Analysis and Publications Unit, NC OSHA Division, 4 W. Edenton Street, Raleigh, NC 27601, (telephone 919/807-2872), to participate in the Preconstruction Conference to assure that proper emphasis -is given on understanding and adhering to the OSHA regulations. It is the responsibility of the Recipient and the Consulting Engineer to insure that the project plan documents are in compliance with Amended N. C. G. S. 133-3 (ratified July 13, 1993). The administrative review and approval of these plans and specifications, -and any subsequent addenda or change order, does not imply approval of a restrictive specification for bidding purposes; nor is it an authorization for noncompetitive procurement actions. Any addenda to be issued for subject project plans and specifications must be submitted by the Recipient such that adequate time is allowed for review/approval action by the State, and for subsequent bidder action prior to receipt of bids. It is mandatory for project facilities to be constructed in accordance with the North Carolina Sedimentation Pollution Control Act, and, when applicable, the North Carolina Dam Safety Act. In addition, the specifications must clearly state what the contractors' responsibilities shall be in complying with these Acts. While rejection of all bids is possible, such action may be taken only with prior State concurrence, and only for good cause. The Recipient will comply with the utilization of minority businesses in accordance with GS 143-128. Attached is a form (Part B) which is to be completed within twenty-one (21) days after bids have been received, and submitted to the State for review. It must be accompanied by the documents indicated on the form. Upon review and approval of this information, the State will authorize the Recipient to make the proposed award. Prior to entering into any contract(s)' for construction, the Recipient must have obtained all applicable project permits from the State, including an Authorization, to Construct and/or Non -Discharge Permit. Two (2) copies of any change order must be promptly submitted by the Recipient to the State. If additional information is requested by the State, a response is required within two (2) weeks, or the change order will be returned without further or final action. One (1) set of the final approved plans and specifications will be forwarded to you. One (1) set of plans and specifications identical to the approved set must be available at the project site at all times. Upon completion of the project construction, the Recipient shall submit a letter confirming that the project has been constructed in accordance with the plans and specifications approved by the State. "As -built" plans will need to be submitted with any changes color -coded on the plans if the above confirmation cannot be made. The Berkley Park sites would be used in conjunction with the City's Patton Park property. On May 4, 2000 I sent you a memorandum presenting my observations relating to the use of the Patton Park site. Attached for your consideration is another copy of that memorandum. The four Berkley Park sites are all well established grassland. One is a ball park. They are off the road, somewhat isolated and to a degree surrounded by woods. I found them all suitable for reuse of wastewater. It is my recommendation that, upon the determination that the project conforms to the regulatory requirements of the North Carolina Environmental Management Commission, a permit be issued for .the construction and operation of the proposed Effluent Disposal System. The proposal would utilize a portion of Patton Park to spray irrigate approximately 250,000 gallons per week of treated wastewater from the City of Hendersonville's new wastewater treatment plant. The site is primarily grass land and would be suitable for development as a spray irrigation site. Having reviewed the application submitted by the City of Hendersonville I offer the following comments: 1) As good an effluent as I expect it to produce, I would doubt if the City'.s new wastewater treatment plant can produce an effluent having a monthly average suspended solids of less than 5 mg/1 as required by 15A NCAC 2H.0219 (k) (1) (B) (iii) (I) . 2) I did not find that the application mentions continuous on line turbidity monitoring and recording.
