All bridges cross streams that are Nutrient Sensitive Waters (NS W) of the State and are subject to the Jordan
[�3utler Rules. Riparian buffer impacts shall be avoided and minimized [o the grea[est extent possible pursuant
to 15A NCAC 2B .0367.
2. NCD WR is very concemed with sediment and erosion impacts that could result from this project. NCDWR
recommends tha[ highly protective sediment and erosion control BMPs be implemented ro reduce the risk of
nutrient runott. NCDW R requests that road design plans provide treatment of the storm water runoff through

3. Review of [he project reveals [he presence of surface waters classified as High Quality Wa[ers (HQW) of the
State in the project smdy area (Cane Creek). 'fhis is one of Che highest classifications for water quality. Given
Che potential for impacts to lhese resources during the project implementation, the NCDW R requests that DOT
strictly adhere to North Carolina regulations entitled "Design Standards in Sensitive Watersheds" (ISA NCAC
04B A l24) throughou[ design and conshuction of the project and that NCDOT's National Pollutant Discharge
Flimination Sys[em (NPDES) permitNCS000250 is strictly enforced along with the requirements of
Stormwater Discharge General Permit NCG010000 for Construction Activities.
4. Any an[icipated bank stabilization associated with culvert insYallations or extensions sllould be addressed in the
Categorical Exclusion (CE) document It is understood that final designs are not determined at the time the CE
is developed. However, [he CE should discuss the potential For bank stabilization necessary due ro culvert
installa[ion.
5. Any anticipated dewaterin� or access sh'uctures necessary for construction of bridges should be addressed in the
CE. It is understood that final designs are not determined at the time the CE is developed. However, the CE
should discuss the potential for dewatering and access measures necessary due to bridge construction.
6. If foundation test borings are necessary; it shall be noted in the documenC Geotechnical work is approved
under General 401 Certitication Number 3883/Nationwide Permit No. 6 Cor Survey Activities.
7. If a bridge is being replaced with a hydraulic conveyance other than another brid�e, the NCDWR believes the
use of a Nationwide Permit may be required. Please con[act the USACE to determine the required pernlit(s).
8. If the old bridge is removed, no discharge ofi brid�e material into surface waters is allowed unless otherwise
authorized by the USACE. Strict adherence to the USACE euidelines for bridge demolit�ion will be a condition
ofthe401 WaterQualityCertification.
9. Whenever possible, the NCDW R prefers spannin� structures. Spanning structures usually do not require work
within the stream or grubbing of the stream banks and do not require stream channel realignment The
horizontal and vertical clearances provided by bridges allow for human and wildlife passage beneath the
structure and do not block fish passa�e.
10. Bridee deck drains shall not dischar�e directly in[o the stream. S[ormwa[er shall be directed across [he brid�e
and pre-treated [hrou�h site-appropriate means (grassed swales, pre-formed scour holes, veeetated buffers, etc.)
before entering the stream. Please refer to the most current version of NCD W R S�ormirater Best Mnnngement

I L If concrete is used during constructioq a d�y work area shall be maintained to prevent direct contact between
cw�ing concre[e and stream water. Water [hat inadvertently contacts uncured concrete shall not be discharged to
surface waters due to the potential for elevated pH and possible aquatic life and fish kills.
12. Bridge supports (bents) shall not be placed in the stream when possible.
13. If temporary access roads or detours are constructed, the site shall be graded to i[s preconstruction contours and
elevations. Disturbed areas shall be seeded or mulched to stabilize [he soil and appropriate native woody
species shall be planted. When using temporary structures the area shall be cleared but not grubbed. Clearino
the area with chain saws, mowers, bush-hogs, or other mechanized equipment and leavina the stumps and root
mat intact allows the area to re-ve�etate naturally and minimizes soil disturbance.
14. Sedimen[ and erosion control measures sufficient to protecT water resources must be implemented and
maintained in accordance with the most recent version of Nonh Carolina Sediment and Erosion Control
Planning and Desi�n Manual abng with the most recent version of NCS000250; including [he requirements of
Stormwa[er Dischatge General Permit NCG010000 for Construclion Ac[ivities.
I5. AIl work in or adjacen[ to s[ream waters shall be conducted in a dry work area unless olherwise approved by the
NCDWR. Approved BMP measures from the most current version of NCDOT Construction and Maintena�ce
Activities mamial such as sandbags, rock benns, cofferdams and other diversion structures shall be used to
prevent excavation in flowin� water.
16. Heavy equipment shall be operated from die bank rather than in stream channels in order [o minimize
sedimentation and reduce the likelihood of introducin, other pollutants into streams. This equipment shall be
inspected daily and mainWined to prevent contamination of sw�face waters from leaking fuels, lubricants,
hydraulic fluids, or other toxic materials.
17. In most cases, the NCDWR prefers the replacement ofthe existin� structure a[ the same location wi[h road
closure. If road closure is not feasible, a[emporary detour shall be designed and located to avoid wetland
impacts, minimize the need for clearing and Co avoid destabilizing s[ream banks. If the structure will be on a
new alignment, the old structure shall be removed and the approach fills removed from the 100-year Floodplain.
Approach fills shall be removed and restored to the natural ground elevation. The area shall be stabilized with
grass and pla�ted with native tree species. Tall fescue shall not be used in riparian areas.
18. Placement of culverts and other structures in waters, streams, and wetlands shall be below the elevation of the
streambed by one foo[ for all colverts with a diameter greater than 48 inches, and 20 percent of the culvert
diameter for culverts having a diameter less than 48 inches, to allow low flow passage of water and aquatic life.
Design and placement of culverts and other structures includin� Cemporary erosion control measures shall not
be conducted in a manner that may result in dis-equilibrium of wedands or streambeds or banks, adjacent to or
upstream and downsh�eam of [he above structures. The applicant is required to provide evidence that the
equilibrium is being maintained if requested in writing by the NCDWR. ffthis condition is unable to be met
due to bedrock or other limiting features encountered during construction, please contact the NCDWR for
guidance on how to proceed and to detennine whether or not a perniit modification will bc required.
19. If multiple pipes or barrels are required, they shall be desi�ned to mimic natural stream cross section as closely
as possible includina pipes or barrels at Flood plain elevation and/or sills where appropriate. W idening the
stream channel shall be avoided. Stream channel widenin� at the inlet or outlet end of structures rypically
decreases water velocity causing sediment deposition that requires increased maintenance and disn�p[s aquatic
life passage.
20. Riprap shall no[ be placed in [he active thalweg ehannel or placed in the streambed in a manner that precludes
aquatic life passage. Bioengineerino boulders or structures shall be properly desi�ned, sized and installed.
The DOT is reminded that issuance of a 401 Water Quality Certification requires tha[ appropriate measures be
instituted [o ensurz tha[ water quality standards are met and designated uses are not degraded or lost. If you have any
