1.0 PROJECT DESCRIPTION

The project site is located in Brunswick County west of Southport on Fish Factory Road (Drawing A-1).
The site will be developed with 4 residential lots, designated as lots 33 through 36. The site is bordered
on the east by a proposed residential and commercial development, on the south by the Intracoastal
Waterway, on the west by a proposed residential subdivision, and on the north by wetlands. This project
will involve constructing residential dwellings within the upland areas on each of the four lots.
Construction will be confined to upland areas to prevent impact to CAMA/404 areas. Erosion control
measures will also be utilized to prevent sediment laden storm runoff from leaving the properties during
construction.
2.0 SITE DESCRIPTION
The existing landscape of the site is generally fine sands and flat (<2%). The site generally slopes to the
southern side of the development area. The northern and southern portions of the project boundaries
have been classified as wetlands, and will not be developed. Between, and to the sides of the two upland
tracts, surface drainage features empty to the Waterway through wetland channels. The proposed
development is located . where a minimum of wetlands (roadway between Lots 34 and 35) will be
impacted.
3.0 STORMWATER MANAGEMENT MEASURES
The proposed stormwater management measures for these lots include limiting built upon area to 25
percent or less (an average maximum of 4,035 square feet impervious building allowance per lot) and a
30 foot wide vegetated buffer around the lot boundaries to surface waters. Stormwater will be conveyed
off the property by overland sheet flow.
4.0 CONSTRUCTION SEQUENCE
Silt fence will be installed according to the erosion and sedimentation control specifications around the
perimeter of the individual lots and proposed roadway. Once these measures are in place, construction of
residential buildings and the roadway can begin. Barren areas will be permanently seeded immediately
upon construction completion.
5.0 MAINTENANCE PLAN
The majority of the development site will be exposed for the beginning of the project. The contractor
will be responsible for the installation of a construction entrance and silt fences prior to land disturbing
or clearing operations. The erosion and sediment control structures will be inspected by the contractor
on a weekly basis and after each significant rainfall during the active construction period. Results will be
reported to the owner. Measures found not performing the intended function shall be repaired or
replaced immediately. Sediment deposits must be removed from the upstream side of the silt fences
when they reach one-third the height of the fence. Deteriorated silt fabrics must be replaced
immediately. Bare or denuded areas will be reseeded. Permanent cover will be inspected and
maintained by South Harbour Village on a regular basis after the facility is completed.

The Wilmington Regional Office received a Stormwater Management Permit Application for South
Harbor Village - Lots 33-36 on January 11, 1999. A preliminary review of that information has determined
that the application is not complete. The following information is needed to continue the stormwater review:
1. Please provide original contours, proposed contours, and spot elevations on the plans.
2. Please provide a detail of the road.
3. The project has overall one drainage basin, in Section III number 6, the lots can all be

4. In Section III number 6, there was 1,300 square feet of the road between lots 34 and 35 not

5. Within the narrative under number 3.0 there is stated within parentheses that there will be a
maximum of 5,000 square feet of impervious building allowance per lot. By my calculations
there should only be on the average 3,711 square feet of BUA per lot. It is fine to have more
in one lot if there is. less in another, as long as all four lots average out to be 3,711 square feet

6. Again within the stormwater calculations submitted 5,000 square feet BUA per lot is used in
determining the percent impervious area allowed. With 3,711 square feet BUA average per
lot and 7,800 square feet of road for the 2.079 acres of total project area there will be 25
percent of impervious area within the project site.

Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to February 27, 1999, or the application will
be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including
the application fee. The Division is allowed 90 days from the receipt of a completed application to issue the
permit.

Dear Mr. Burnett:
On January 13, 1999, personnel of this office inspected a project located off NC Hwy 133
across from the airport in Brunswick County, North Carolina. This inspection was performed to
determine compliance with the North Carolina Sedimentation Pollution Control Act of 1973. The
inspection revealed a land -disturbing activity of approximately 3 acres being conducted.
It is our understanding that you are responsible for this land -disturbing activity. The purpose
of this letter is to inform you that this activity was found to be in violation of the Act, NCGS 113A-50
to 66, and Title 15A, North Carolina Administrative Code, Chapter 4. If you feel that you are not
responsible for the following violations, please notify this office immediately.
The violation that was found is:
1. Failure to file an erosion and sedimentation control plan with this office at least 30 days prior
to beginning a land -disturbing activity on a tract comprising more than one acre, when more
than one acre is to be uncovered, failure to secure this office's prior approval of the plan for
any land -disturbing prior to beginning the land -disturbing activity. NCAC 4B.0OO7(c).
An erosion and sedimentation control plan has not been submitted to this office for the
referenced project.
An acceptable erosion and sedimentation contro! plan must be filed with and approved by this
office and implemented on the site sufficient to prevent off -site sedimentation. Temporary
measures must be provided immediately to control erosion and prevent sedimentation damage.
Any additional land disturbing activities conducted without an approved erosion and
sedimentation control plan will constitute additional violations of the Act. We will notify you
following our review of the plan if additional measures are 'required.

To correct this violation, you must:
1. Submit an erosion and sedimentation control plan to this office for the referenced project.
Please be advised that if these violations are not corrected within 30 days of receipt of this
notice, the Director, Division of Land Resources, will be requested to take appropriate legal action
against you pursuant to NCGS 113A-64. That action could be the assessment of a civil penalty and
the amount may be up to $500 per day for each day of the violation. The penalty may be assessed
from the date of your receipt of this Notice of Violation. 0 5A NCAC 4C.0007). If these violations
are corrected within the time period specified for compliance, no further legal action will be pursued.
Please be advised that any new land -disturbing activity associated with this project must not
begin until the area presently disturbed is brought into compliance with the Act. When corrective
actions are complete, you should notify this office so the work can be inspected. You should not
assume that the property is in compliance with the Act until we have notified you. After installation,
all erosion control measures must be maintained in proper working order until development is complete
and the site is completely stabilized.
We solicit your cooperation, and would like to avoid taking further enforcement action. At the
same time, it is your responsibility to understand and comply with the requirements of the Act.
Copies of the relevant statute and administrative rules may be examined at this office or will be sent
to you upon request. Should you have questions concerning this Notice or the requirements of the
Act, please contact either Carol Miller or me at your earliest convenience.
