Your notification indicated that you intend to re-set the fill slope in the original location and stabilize the area with either rip rap and/or sheet piling up to 130 linear feet. Additionally the stream may be realign only as necessary by removing sandbar and stabilizing the resulting far bank with coir fiber matting and/or rip rap. The stream repair and de-watering will impact 130 linear feet of stream. Based on the information provided in your application, your work is authorized by Nationwide Permit (NWP) 3 for Maintenance Activities, and NWP 13 for Bank Stabilization, and does not require a pre-construction notification (PCN) provided it is accomplished in strict accordance with the attached conditions and your submitted description. Any violation of the attached conditions or deviation from your submitted description may subject the permittee to a stop work order, a restoration order and/or appropriate legal action. Attached is a copy of the NWP’s 3 and 13. and the applicable permit conditions. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the activity is completed within twelve months of the date of the nationwide permit’s expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend or revoke the authorization. The Action Identification Number for this project is SAW-2014- 01887. Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. NCDOT proposes to re-set the fill slope in the original location and stabilize the area with either rip rap and/or sheet piling up to 130 linear feet. Additionally the stream may be realign only as necessary by removing sandbar and stabilizing the resulting far bank with coir fiber matting and/or rip rap, see attached EC plan – permit drawing. The stream at this site is subject to the Neuse River Riparian Buffer Rules, but since activity will be within the inner banks of the stream and what would be riparian buffers is now roadway and a parking lot, a written buffer authorization would not be necessary. Although this area is mapped as having hydric inclusions, there are no wetlands within the proposed project limits. Additionally no habitat for any federally protected species exists at this location. Sequence of Repair -Dewater segment of stream next to the failed fill slope using sand bags and pump around set up. -Remove sandbar to allow for channel re-alignment and armor resulting far bank with coir fiber matting and/or rip rap. -Repair near slope by highway using rip rap and/or sheet piling. -Remove dewatering measures. I wasn’t sure if this activity would be covered by NWP 3 and NWP 13/WQC No. 3687 and WQC. No. 3689? If not and a NWP 14 and corresponding WQC is warranted, please use WBS to process this application, see attached PCN 5.209211A form. Pending approval, this work is scheduled to begin within the next several weeks. 2 Heather W.
