The Division of Water Resources (Division) has performed a preliminary review of a 401 Water Quality.
Certification application submitted for the above referenced project. The Division has determined that your
application is incomplete and cannot be processed. The application is on -hold until all of the following
information is received:
1.. The project proposes to restore a reach of stream located on a property owned by others not
included in the application documentation. Proof will be needed that the property owners
approve work to be completed on their property, as they will be responsible for the outcome of
the project and compliance with 401 Water Quality Certification conditions.
2. The project proposes the use of gabion baskets, which are not considered an approvable method
to utilize for stream restoration and the design creates an obstacle to aquatic passage, also not
approvable. I _
Provide stream restoration details based upon natural channel design principles.
If all of the requested information is not received in writing by due date, the Division will be unable to approve
the application and it will be returned. The return of this project will necessitate reapplication to the Division
for approval, including a complete application package and the appropriate fee.
Please respond in writing by November 14, 2014 by sending three copies of all of the above requested
information to the 401 & Buffer Permitting Unit:
