Subject: Comments on the Draft NPDES Permit for Dan River Combined Cycle Plant

Dear Dr. Chernikov:
Duke Energy Carolinas, LLC. (Duke Energy) submits the following comment on the draft National
Pollutant Discharge Elimination System ("NPDES") for Dan River Combined Cycle Station,
issued to public comment on July 26, 2022.
1. Duke Energy respectfully requests item "e" be removed from condition A. (6) based on the
assertion that "passage" is not applicable to the temperature mixing zone at Outfall 001.
The Outfall 001 mixing zone is downstream of a low -head dam structure in the Dan River.
The presence of the dam prevents passage of aquatic organisms regardless of the mixing
zone. The Fact Sheet for NPDES Permit Development states "The proposed mixing zone
was reviewed by the DWR biologists who concluded that impact on the aquatic organisms
to be negligible." It is Duke Energy's position that maintaining the current requirements
found under bullet item "e" for Condition A. (6.) of this draft permit would not provide
meaningful data due to the effects of the upstream low head dam.
