The undersigned, EBX-Neuse 1, LLC, the Sponsor of the Hatley Nutrient and Buffer Bank (the
"Bank") (DWQ #2011-0720v4) located in Person County, NC, hereby certifies the following:
1. City of Durham has deposited monies with the Sponsor sufficient to acquire 78,816,00
Buffer Credits (square feet) frown the Bank for use on its West Street Sewer Outfall
Repair project (DWQ Project #13 -0503) in Durham, NC,
2. The West Street Sewer Outfall Repair project requires a total of 78,816.0�O Riparian
Buffer Mitigation Credits in HUC 03020201 as part of its mitigation. Of this amount
78,816.00 Buffer Credits are being provided by the Hatley Nutrient and Buffer Bank Site,
3. The Sponsor has deducted 78,816.00 Buffer Credits from the Bank's credit ledger from
the Hatley Buffer Bank Site.
A copy of the Hatley Buffer Mitigation Site credit ledger reflecting the above transaction is
attached to this Affidavit.
