NA Enkronmrrtlral Qualify September 19, 2022 CERTIFIED MAIL # 7018 3090 0001 2323 0720 RETURN RECEIPT REQUESTED Mr. Larry Wright 1560 Tryon Courthouse Road Bessemer City, NC 28016 Subject: Compliance Evaluation Inspection Notice of Violation and Intent to Enforce NOV-2022-PC-0494 1560 Tryon Courthouse Road Certificate of Coverage No. NCG550260 Gaston County Dear Mr. Wright: As was indicated on a letter dated August 22, 2022, NCDEQ's inspector arrived at the subject address for an inspection of the subject NPDES permit on September 13, 2022, at about 1:00 PM. No communication was received in order to change the time or date of the inspection. The permitee was not present at the time inspection to discuss compliance with the conditions listed in the subject permit and no records were made available regarding effluent sampling and septic tank pumping dates. The permitee also failed to respond during the last attempt to complete an inspection (May 5, 2019) and you have not responded to the additional information request sent on June 11, 2019. During the last inspection the permitee was present, dating May 31, 2017, there were no records available for review, and you were instructed to better maintain records. Since the previous inspection the permitee has failed to pay the annual permit fees for the years 2018, 2019, 2021 and 2022 (invoices attached). Due to the annual permit fees not being paid the subject NPDES permit as not been renewed. In order for the permit to be restored you must pay these fees. If the fees are not paid and the permit is not renewed, the house will no longer have a permitted waste water system. As such, Gaston County Health Department will be notified that your wastewater permit is no longer in effect, which may impact your occupancy of the home. In order for the facility to reach compliance, you must complete the following items: 1. Pay any outstanding permit fees. 2. Provide a record that the septic tank was pumped in the last 5 years. Once pumped, provide a documentation that the septic was pumped. 3. Provide record of the last sampling event of the effluent discharge from the treatment system. This may not be applicable if the system is not discharging. A Notice of Violation and Notice of Recommendation for Enforcement, pursuant to G.S. 143-215.6A, may result in a civil penalty and may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215.1. You are requested to respond to this Notice in writing within thirty (30) days of receipt indicating your Plan of Action to ensure future compliance.
