Permits & Engineering Comments:
This is a permit renewal for an extended aeration treatment system, with additional limits for
increased flow. Files indicate that the facility has been in violation of permitted limits, especially
TSS, in 1996. The facility is experiencing problems with treatment during peak flow periods, and it was
suggested to the permittee that flow equalization be investigated and a flow recorder be installed. The
ammonia limit at 0.12 MGD was previously permitted as a year-round limit. No basis for a year-round
limit was outlined in the wla. Therefore, per current SOP for ammonia/tox. limits, the ammonia limit
has been set for the summer, and monitoring only is required for the winter. P&E recommends renewal of
permit with changes noted above. Region: Can we anticipate% facility going to class III at the

have not received application yet.
8/22 Called Tom Marsalona (704) 966-9266, about app. He said he spoke with Kerry Becker
and told her to call his accountant. He said he paid last winter.
Called Kerry Becker and the accountant, Kevitt & Lee, (704) 883-2920. Asked him what
the check # was and for a copy of the check.
8/26 Faxed accountant copies of letters from CF and application. The money they sent was for
annual fee.
9/2/97 Received application.
Kevitt & Lee, P.O. Box 1094, Brevard, NC 28712 would like to be cc'd on all future
correspondence, since they handle all the forms and money for the permittee.

In accordance with your application for discharge permit received on September 2, 1997,
1997 by the Division, we are forwarding herewith the subject permit to discharge under the subject
state - NPDES permit. This permit is issued pursuant to the requirements of North Carolina
General Statute 143-215 .1 and the Memorandum of Agreement between North Carolina and the
U.S. Environmental Protection Agency dated December 6, 1983 and as subsequently amended.
The following changes have been made to the above referenced permit. The monitoring
frequencies have been updated according to NCAC 2B.0500 regulations:
Flow recording has been changed from a weekly instantaneous measurement to continuous
recording measurement at the 0.010 MGD flow. The facility will have six (6)
months to install the recorder. Please submit an Authorization to Construct request
and the ATC fee of $150 as soon as possible to Mr. David Goodrich at the address below.
• BOD, Total Suspended Residue, and Fecal Coliform monitoring has been changed from
twice a month to weekly.
• NH3 as N monitoring has been changed from monthly to twice a month.
If any parts, measurement frequencies or sampling requirements contained in this permit
are unacceptable to you, you have the right to an adjudicatory hearing upon written request within
thirty (30) days following receipt of this letter. This request must be in the form of a written "
petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-
7447. Unless such demand is made, this decision shall be final and binding.
Please take notice that this permit is not transferable except after notice to the Division of
Water Quality. Part II, E.4. addresses the requirements to be followed in case of change in
ownership or control of this discharge. The Division of Water Quality may require modification or
revocation and reissuance of the permit.

required by the Division of Water Quality or permits required by the Division of Land Resources,
the Coastal Area Management Act or any other Federal or Local governmental permit that may be

is hereby authorized to discharge wastewater from a facility located at
Toxaway Falls
US Highway 64
west of Rosman
Transylvania County
to receiving waters designated as the Toxaway River in the Savannah River. Basin
in accordance with effluent limitations, monitoring requirements, and other conditions set forth in
Parts I, II, III, and IV hereof.
This permit shall become effective December 1, 1997.
This permit and authorization to discharge shall expire at midnight on August 31, 2002.

Toxaway Falls, Inc.

1. Continue to operate an extended aeration package treatment plant consisting of an equalization
basin, bar screen, aeration tank, clarifier, hypochlorinator, chlorine contact tank, and aerated
sludge holding tank located at Toxaway Falls, US Highway 64, west of Rosman, Transylvania
County (See Part III of this Permit), and
2. After receiving an Authorization to Construct from the Division of Water Quality, construct
additional facilities to treat up to 0.120 MGD.of wastewater, and
3. Discharge from said treatment works at the location specified on the attached map into Toxaway
River which is classified Class C waters in the Savannah River Basin.

If this facility is built in phases, plans and specifications for the next phase shall be submitted when
the flow to the existing units reaches 80% of the design capacity of the facilities on line. At no time
