Dear Mr. Dischinger;
The Division of Water Resources (Division) is in receipt of your response to a Continuing Notice of
Violation issued by this Division on August 3, 2022. The response indicates that the approved buffer
restoration plantings have been installed.
As previously indicated in the Buffer Restoration Plan approval issued by the Division on April 8, 2020:
the areas shall be visually monitored twice a year for three (3) years for buffer replanting
success. Tree vigor and survival shall be monitored and trees that do not survive shall be
replanted at the next appropriate planting season. The Division shall conduct a final inspection
of the restoration areas at the conclusion of the monitoring period and may require additional
planting or an extended monitoring period if the buffer restoration is unsuccessful.
Pursuant to G.S. 143-215.6A, the above -mentioned violations and any future violations are subject to a
civil penalty assessment of up to a maximum of $25,000.00 per day for each violation. Your above -
mentioned response to this correspondence will be considered in any further process that may occur.
