As with all IP projects, as long as the Corps deems the project as Incomplete---and has not
issued a Public Notice---the project's 401 application is thus also On Hold until these
issues are resolved. (For future reference, this project has been assigned DWR project
number 20140998.)

Review of the IP application for the B-5124 project has determined that the proposed
mitigation through NCEEP is unacceptable, and as such, the application is considered
incomplete until another mitigation plan can be provided.
The Corps agrees that the Gregory Site is located in the appropriate HUC for the proposed
impacts. However, the Gregory Site has not officially attained "closed out" status with the
Corps and is considered unavailable for debiting. Correspondence from Leilani Paugh has
indicated that it would be closed out in 2014, but I have no verification of that activity.
The NCEEP website indicates that it has been closed out, but that information is in conflict
with the Corps records.
As previously proposed and discussed, I am agreeable to using in-kind/adjacent HUC mitigation
for this specific project. The Grimesland Bridge Phase I and II sites would be acceptable
substitutes for the Gregory Site in this situation.
