This permit, issued on 12 Z23 l 9 9 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Basin Shoreline Stabilization
1) The bulkhead shall not extend waterward more than 2 feet from the existing bulkhead at any
point along its alignment at the time of construction.
2) The bulkhead must be constructed prior to any backfrlling activities.
3) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the
structure.
4) The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or
other suitable materials approved by department personnel.

This permit-action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the ermit expires on
December 31, 200pZ
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

ADDITIONAL CONDITIONS

5) The back'fill material will be clean and free of any pollutants except in trace quantities.
6) All back fill material will be obtained from a highgroundcsurce and confined behind the permitted
r1A bulkhead:
7) The level of the fill material behind the bulkhead must be lower than the bulkhead cap to prevent
sediment from washing into adjacent water.
Maintenance Excavation
8) Excavation will not exceed -4 feet below the mean low water level.
9) Excavation will be no deeper than the depth of connecting waters
10) No vegetated wetlands or marsh grass will be excavated or filled.
11) The temporary placement or double handling of excavated or fill materials within waters or
vegetated wetlands in not authorized.
12) All excavated materials will be confined above mean high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover
of solids into any marsh or surrounding waters.
13) The disposal area, as well as any and all bare areas, will be properly graded and provided a
ground cover sufficient to restrain erosion within 30 working days of project completion.
14) Spoil material must be placed in the designated spoil area until such time as dewatering occurs.
The contractor should call a representative of the Division of Coastal Management for an
inspection prior to removing material from the spoil disposal area.
Sedimentation and Erosion Control
15) Sedimentation and erosion control measures must be implemented to ensure that eroded
materials do not enter adjacent wetlands or waters.
16) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain
erosion within thirty days of project completion.

NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan
must be filed at least thirty (30) days prior to the beginning of any land disturbing
activity. Submit this plan to the Department of Environment and Natural Resources,
Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405.
General
17) No attempt will be made by the permittee to prevent the free and full use by the public of all
navigable waters at or adjacent to the authorized work. Use of the permitted activity must not
interfere with the public's right to free navigation on all navigable waters of the United States.
NOTE: The permittee is encouraged to contact the United States Coast Guard concerning
compliance with the attached list of regulations.
NOTE: This permit does not eliminate the need to obtain any additional permits, approvals or
authorizations that may be required.
NOTE: The permittee and /or his contractor is urged to meet with a representative of the Division
prior to project initiation.
NOTE: The N.C. Division of Water quality has authorized the proposed project under General
Water Quality Certification No. 3112 (DWQ Project No. 991035), which was issued on
11/2/99.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id.
No. 1 99901 61 1.
