Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 980634 dated December 17, 1998, for the construction of Eagle Point Golf Club. This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions and limitations as specified therein, and does not supercede any other agency permit that may be required. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 15013 of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. The Permit shall be effective from the date of issuance until rescinded and shall be subject to the following specific conditions and limitations: I. DESIGN STANDARDS 1. The total allowable built -upon area for the entire tract is 64.88 acres. This permit covers the construction of 18.11 acres (788,843 square feet) of built -upon area. 2. The overall tract built -upon area percentage for the project must be maintained at 25 %, as required by Section 1005 of the stormwater rules. 3. Approved plans and specifications for projects covered by this permit are incorporated by reference and are enforceable parts of the permit. 2 State Stormwater Management Systems Permit No. SW8 980634 4. Vegetated conveyances such as swales must have a minimum side slope of 3:1 (H: V) as defined in the stormwater rules and approved by the Division. 5. No piping is allowed except: a. That minimum amount necessary to direct runoff beneath an impervious surface such as a road. b. That minimum amount needed under driveways to provide access. C. That amount shown on the approved plans running under fairways, between ponds, and from low places within the tract to a pond or swale. 6. Within the 575' AEC, the proposed built -upon area is 184,695 square feet within the AEC (9.9%). 7. Within the AEC,. no collection of runoff may occur. Runoff must sheet flow. 8. A minimum 30' vegetated buffer is provided between built -upon areas and surface waters. H- SCHEDULE OF COMPLIANCE 1. Projects covered by this permit will maintain a minimum 30 foot wide vegetative buffer between all impervious areas and surface waters. 2. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. 3. The Engineer/Owner/Developer/Permittee must certify in writing that the project's stormwater controls, and impervious surfaces have been constructed within substantial intent of the approved plans and specifications. Any deviation from the approved plans must be noted on the Certification. 4. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 5. The maximum built -upon area is 64.88 acres square feet, inclusive of that portion of the right-of-way between the front lot line and the edge of the pavement, structures, pavement, walkways of brick, stone, slate, but not including wood decking. 6. This permit covers the construction of 18.11 acres (788,843 square feet) of impervious area. Construction of additional impervious area will require a permit modification. 7. Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with the development except for average driveway crossings, is strictly prohibited by any persons. Projects within CAMA's Area of Environmental Concern (AEC) are subject to a reduction of the permitted amount of built -upon area due to CAMA jurisdiction within the AEC. 9. Swales and other vegetated conveyances shall be constructed in their entirety, vegetated, and be operational for their intended use prior to the construction of any built -upon swrface except roads. 10 During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. 11. The following items will require a modification to the permit. Revised plans, specifications and calculations must be permitted prior to the permittee beginning construction on the modification: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision of the project area. f. Filling in, altering or piping any vegetative conveyance shown on the approved plan. 12. The Director may determine that other revisions to the project should require a modification to the permit. 13. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater management systems at optimum efficiency to include: a. Inspections b Sediment removal. C. Mowing, and revegetating of the side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. 14. The permittee shall submit the Engineer/Owner/Designer/Permittee Certification within 30 days of completion of the project. 15. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. III. GENERAL CONDITIONS 1. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Quality, in accordance with North Carolina General Statutes 143-215.6A to 143--215.6C. 2. The permit issued shall continue in force and effect until revoked or terminated. 4 State Stormwater Management Systems Permit No SW8 980634 3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance, or termination does not stay any permit condition. 4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws; rules, and regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2HA000; and North Carolina General Statute 143-215.1 et. al. 5. The permit is not transferable to any person except after notice to and approval by the Director. The Director may require modification or revocation and reissuance of the permit to change the name and incorporate such other requirements as may be necessary. A formal permit request must be submitted to the Division of Water Quality accompanied by the appropriate fee, documentation from both parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits, and may or may not be approved. 6. The permittee grants permission to DENR Staff to enter the property for the purpose of inspecting all components of the stormwater management facility. 7. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state and federal) which have jurisdiction. Deed Restriction Requirements The following statements must be recorded for all low density projects and for all projects that involve the subdivision and selling of lots or outparcels: 1. No more than square feet of any lot, including that portion of the right-of-way between the edge of pavement and the front lot line, shall be covered by impervious structures, including asphalt, gravel, concrete, brick, stone, slate or similar material but not including wood decking or the surface of swimming pools. This covenant is intended to insure continued compliance with the stormwater permit issued by the State of North Carolina. The covenant may not be changed or deleted without the consent of the State. 2. No one may fill in, pipe, or alter any roadside Swale except as necessary to provide a minimum driveway crossing. NOTE: If lot sizes vary significantly, the owner/developer must provide an attachment listing each lot number, size, and the allowable built -upon area for each lot. For commercial projects that have outparcels or future development the following statements must also be recorded. 3. The connection from the outparcel or future area into the stormwater system must be made into the forebay such that short -circulating of the system does not occur. 4. All built -upon area from the outparcel or future development must be directed into the permitted stormwater control system. 5. Built -upon area in excess of the permitted amount will require a permit modification prior to construction. Processing of the permit application, which was received by the Division of Coastal Management's Wilmington office on October 15, 1998 is nearing completion. However, it has been determined that additional information will be required prior to the Division taking final action on your application. This additional item is summarized below: 1) It is the policy of this Division that, prior to taking final action on a project of this nature, a stormwater management plan for the proposed development must be approved by the Division of Water Quality. It is our understanding that this approval has not yet been received four this project . Therefore, it is necessary that processing of your permit application be placed in abeyance until such time as a stormwater management plan certification for the proposed project is issued by the Division of Water Quality, and a copy of the approval supplied to this office. As required by T15A:07J.0204(d), during the pendency of any termination of processing, the permit processing period will not run. Upon receipt by this office of the requested information, the Division of Coastal Management will resume processing of the application at the point where it was terminated. The proposed club is located adjacent to Little Creek, which is an inland tidal creek, and Porters Neck Plantation. The site is located immediately southwest of the intersection of Porters Neck Road and Bald Eagle Lane in Harnett Township, New Hanover County. Current Conditions The 230-acre site is currently a large abandoned field and young woodland. The eastern portion of the site contains old man-made irrigation ponds. The ponds are connected by a wet weather drainage way. There are 8 separate wetland areas which include the existing ponds. Of the nearly 22 acres of on -site wetlands, the majority of these wetlands (approximatley19 acres) are located in one wetland area along the creek. Current vegetation consists of primarily grasses, scrub growth, and young trees. Subsurface soils in upland areas are generally well -drained. Heavy spring rains indicate the existing drainage has maintained groundwater levels at a reasonable depth so as not to preclude or interfere with proposed developments. Subsurface soils in freshwater ponds and wetlands are primarily poorly drained sands. Proposed Conditions The club will consist of an18-hole course accompanied a nine -hole short game. In addition, a clubhouse, four cottages, golf paths, maintenance yard, entry road and parking space are included in the project. The golf maintenance facility will be located off of Porter's Neck Road and will be screened from view. All amenities are for use by private members only. This low density development will be utilized by 200 to 250 members per year, and the members reside both inside and outside of North Carolina. No large promotional events are scheduled for the course. Proposed grading has been designed concurrently with stormwater management and sediment erosion control. More specifically, grassed lined water quality swales, sheet flow over dense grasses and natural ground cover, and on -site ponds will provide on -site runoff treatment including sediment control and nutrient take-up. At the property perimeter, various berms will create a screening effect from adjoining landowners. The new ridge lines will also ensure that stormwater runoff is retained on the interior of the site and any discharge from the site during major storm events will occur through one of two existing outfalls. In addition, the existing ponds will remain while the wet weather drainage way connecting these ponds will be expanded. Furthermore, two additional landscape ponds are to be created. Golf course operations will follow accepted industry standards and agricultural practices. Thus, all chemicals will be properly stored and handled to prevent spills, any spills will be properly contained and cleaned up, and only certified employees will apply registered chemicals. Wastewater is to be routed either into a septic system or county sewer. Potable water is to be provided either from on -site wells or the Porters Neck Plantation Water source. Irrigation water is to be supplied by on -site wells drawing water from the Castle Hayne aquifer. On -site testing has been performed to determine that efficient recycling will occur via percolation and recycling. 2- Aquifer flows will generally come from the west. Noticeable groundwater elevation drawdown at the property boundary will not be noticeable based on site studies. Only 1.32 acres of non jurisdictional, isolated wetlands will be impacted by the project. Mitigation, although not required for this impact, is proposed to consist of 2.46 acres of created freshwater marsh, a ratio of 1.76 acres of creation per acre of impact. 0.23 acres of the mitigation are for golf course impacts and 1.09 acres are for conversion of woody wetland to freshwater marsh. Current On -Site Study/Permit Status - The property has been designed to adhere to the following regulatory setbacks: 575' setback (AEC) from the Mean High Water. 75' setback from New Hanover County C.O.D. The plan was developed in association with a.CAMA major permit. Compensatory mitigation will consist of the creation of 2.46 acres of freshwater marsh; a ratio of 1.86 acres of creation per acre of impact. The created wetlands will be monitored for a period of five years. Even though the created wetlands will meet mitigation requirements, additional 5'-15' littoral shelves will be created around golf course lakes where topography and other concerns will allow. IMPACT ASSESSMENT The development plan (Figure 2) shows impacts to 1.32 acres of isolated, non - jurisdictional wetlands. Of these impacts, 0.23 acres are for golf course impacts and 1.09 acres are for conversion of woody wetland to fresh water marsh. Thus the majority of the impacts will merely shift the impacted wetlands from one classification to another. All impacts are to isolated wetlands, no impacts to jurisdictional wetlands are proposed. Therefore the wetland impacts will not impact wetland biogeochemical functions. MITIGATION Wetland mitigation will consist of freshwater marsh creation along the golf course. Three creation areas containing a total of 2.46 acres are shown in Figure 2. L The final mitigation ratio is 1.86:1. MITIGATION REQUIRED Since none of the proposed impacted wetlands are under Corps jurisdiction, DWQ mitigation ratios were utilized. DWQ mitigation criteria based on distances from surface water. Distances were measured from mean high water. Table 1 illustrates the process in which actual required acreage was determined. Total impacts of 1.32 acres were determined to require 2.33 acres of mitigation; a 1.76:1 ratio. HYDROLOGICAL CREATION The creation areas will be excavated to acceptable engineering grades to allow for marsh restoration. Strippings from the impacted areas will be saved and placed in the creation areas to allow for a more suitable organic substrate. VEGETATION CREATION The goal of vegetation establishment is the creation of homogeneous stands of vegetation along a water depth gradient with the deepest water occurring in the center of the marsh, with a gradual decrease in water depths leading up to the edge of the wetland. An example of this gradient is shown in Figure 3. Pontedaria cordata will be planted in the middle of the marsh, Scirpus robustus in shallower water and Spartina patens near the edge. illustrations of these species are shown in Figures 4-6. A five foot upland buffer will be established with Baccharis halmifolia and Mlyrica cerifera. 7 LITTORAL SHELVES Littoral shelves will be created where possible around golf course lakes. Shelf dimensions will be dictated by topographic and golf considerations. Wetland plants will be established at densities and compositions to be determined by the golf course architect and course superintendent. MONITORING PLAN All creation areas will be monitored for five years or until the project is deemed successful. Monitoring efforts will concentrate on hydrology and vegetation establishment. Annual monitoring reports will be submitted to concerned agencies. Each report will consist of a simple narrative with data analysis and reports on both success and problem areas. Photographs of each creation area will be included. Monitoring will be terminated once the project has been deemed successful. If the project is not deemed successful at the end of five years, a contingency plan will be implemented with the assistance of all concerned agencies. HYDROLOGY Three RDS WL-40 monitoring wells will be installed as shown in Figure 6 and will have one reading per day. The success goal of hydrology creation will be the establishment of a static water table at or within 12" of the soil surface for 5°%-12°% of the growing season during periods of normal precipitation. VEGETATION Three 30'x30' vegetation plots will be established adjacent to each monitoring well. The vegetative cover of each well will be monitored using the coverage system described by Daubenmire (1968). The success criteria will be a 70% survival rate, including volunteer species, as measured by ground cover. MITIGATION IMPLEMENTATION SCHEDULE Weather permitting, the excavation and grading work will completed prior to the end of the next growing season after the plan and permit have been approved. The plantings will occur in the following dormant season. SUMMARY The applicant proposes to mitigate for the loss of 1.32 acres of non jurisdictional 404 wetlands with the creation of 2.46 acres of wetlands on -site. In addition, littoral shelves will be created around golf course lakes where possible. All wetlands impacted are isolated and non jurisdictional. The major wetland impact is the conversion of a depressionai woody wetland into a fresh water marsh with herbaceous vegetation. The wetlands will be planted based on a water depth gradient.
