PROJECT SUMMARY: The homeowner's association of Forest Sound Subdivision are requesting to replace the existing bulkhead around the marina basin. Also, they are proposing the maintenance dredging of the existing basin and connecting channel to the AIWW. Forest Sound Marina Page 2 9. PROJECT DESCRIPTION Forest Sound is an existing subdivision located off of Highway 17 in Hampstead, NC, Pender County. Traveling from Hampstead towards Jacksonville on Highway 17, an individual should turn right at Anchor Bank. In June, 1982, CAMA Major Permit #81-82 was issued for the construction of a high ground marina basin with a connecting channel cut through coastal marsh providing boating access to the Atlantic Intracoastal Waterway. The project was constructed in 1985. The marina is used by the property owners within the subdivision. The basin is bulkheaded and has wooden free-standing groins in the location where the dredged channel went through the marsh. The boat basin provides dockage for 40 boats. There is an existing concrete boat ramp providing access into the basin. The existing bulkhead is failing and the applicant wishes to replace the entire wall immediately waterward of the existing structure. The replacement consists of approximately 700 linear feet of bulkhead wall. The type of material to be utilized has not yet been determined (concrete, vinyl, wood or steel). There is an existing concrete boat ramp that provides access to the boat basin. The homeowner's association may at later time wish to do some repair and maintenance on this structure. The applicant is requesting to perform maintenance dredging of the existing basin (110' wide by 270' long) and the connecting channel (660' long by 20' wide). Current soundings (low tide) have been provided by the applicant and are shown on sheets 8 and 9 of 13. Water depths currently range from F to 4' deep at low tide within the project area. The final project depth after dredging would be -4' at low tide in the basin and the channel. The applicant proposes to use a dragline and backhoe to perform the dredging work. Approximately 2100 cubic yards of materials are to be dredged. A 25,000 square foot spoil disposal area has been designated on the high ground portion of the common area adjacent to the boat basin (see sheet 10 of 13). Appropriate sediment control measures will be used to control sediment runoff from the spoil disposal site. Once the material dewaters and begins to dry, it is to be spread out on high ground around the site. Some minor grading work will be done on high ground adjacent to the marina basin. The work involves the removal of an existing 285' long retaining wall. The wall is short and will not be replaced. Instead, the surrounding land will be regraded to result in a stable seeded slope. This wall is separate from the bulkhead and does not have contact with the water. See sheets 11 and 12 of the project drawings. The waters of the Intracoastal Waterway in this area have been classified as SA Outstanding Resource Waters by the Division of Water Quality. They are designated as Primary Nursery Area by the Division of Marine Fisheries and are closed to shellfishing. Forest Sound Marina Page 3 10. ANTICIPATED E%VACTS The high ground spoil disposal and grading work will result in at least 32,000 square feet of land disturbance. More land may be disturbed as a result of the spreading and final grading of the spoil material once it has dried. The dredging operation will likely result in temporary turbidity and alteration of approximately 42,900 square feet of shallow bottom. Replacement of the bulkhead will result in a decrease of open water area inside the existing marina basin (1200 - 1400 sf). No federal or coastal wetlands are to be disturbed as a result of this work. The original depth and width of the channel will not be increased above what was authorized in 1982. Janet M. The development and marina are located in Hampstead, in Pender County. The marina, boat ramp and access channel were constructed in 1985, under Permit No. 81-82. Due to the passage of time and the effects of several hurricanes, including Fran (`96), the marina has deteriorated and is now in need of rehabilitation. FSHA plans to start the project by performing maintenance dredging of the access channel, which has suffered serious shoaling. The dredging will be done by clamshell bucket and barge. The dredged spoil will be transported to the spoil area by the dredging contractor. the spoil area is located on the FSHA Common Area. The spoil area will be surrounded by a silt fence and will be graded and seeded upon completion of the work. While the dredging is being done, FSHA will retain a Consulting Engineer to design the replacement bulkhead. As part of the bulkhead repair, a small retaining wall along the south property line will be removed and the adjacent lot regraded to relieve the surcharge loading on the bulkhead. The surcharge load has been a factor in two failures of the marina bulkhead. The bulkhead repair will involve the construction of a new wall immediately in front of the existing wall. The wall material chosen, whether timber, vinyl, concrete or steel, will depend on he recommendations of the Engineer. In the area where the bulkhead has failed, the existing wall will be removed to the extent necessary to maintain a straight alignment with the new wall. The bulkhead repair will also include the installation of a new anchorage system. As the bulkhead is being reconstructed, the slip areas will be dredged as appropriate. This dredging will also be done using a clamshell bucket and the spoil transported to the FSHA owned spoil area. The dredging of the access channel is expected to result in approximately 1000 cy. of spoil material. The regrading of the adjacent upland will result in approximately100 cy. of material. The dredging of the marina will result in approximately 1200 cy. of spoil. The channels are labeled as "N.B.P. #1 and N.B.P. #2" on the attached map initialed by me on December 22, 2006. Division of Water Quality (DWQ) Staff from the Raleigh Regional Office (Danny Smith) had previously conducted an on-site determination of the stream with a letter dated February 15, 1999. You had requested an appeal of their determination as provided within 15A NCAC 02B.0233(3)(a). At your request, I conducted an appeal of the determination as stated above. The DWQ has determined that the streams labeled as "N.B.P. #1 and N.B.P. #2" on the attached map are at least "intermittent" and are subject to the Neuse Buffer Rule. This map then depicts the extent of streams subject to the Neuse River Buffer rules on this property. My understanding is that I may have sent a letter after the site visit but that no one is able to locate the letter. Therefore, this determination shall replace the determination originally performed by the Regional Office. This stream and its associated buffers should be identified on any future plans for this property. The owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in any future correspondences concerning this property.
