SUBJECT: AARC Determination of September 15, 2022
On September 15, 2022, the Advance Acquisition Review Committee examined a request for
Protective Acquisition for HB-0001 in Dare County; two (2) requests for Early Acquisition for
R-2829 in Wake County; a request for Protective Acquisition for B-6051/U-6143 in
Mecklenburg/Gaston Counties; and, a Hardship Acquisition for I-2513B in Buncombe County.
The Committee made the following recommendations and I concur with the recommendations:

This request is from the Division 1 Division Engineer for the following reasons:
• The proposed Alligator River Bridge (HB-0001) has been deemed a "have to" project to replace
the existing swings pan (built on 1963)
• All indications are that the project will move forward, as the Department has submitted multiple
grant applications to help with the funding.
• The east end will touch down on the Carleno parcel, as shown in the documentation
• During preliminary design, a Geotechnical consultant entered the Carleno property and damaged
wetlands (see package)

• The Department received an NOV (notice of violation) for adverse wetland impacts.
• As part of the discussion with environmental agencies, it was determined that it would be easier
to resolve if the Department owned the parcel.
• The estimate cost of repairs for the NOV would be more than the tax value of the parcel.
• As such, it was determined that the best approach was to pursue advance acquisition.
Approve — The committee recommended APPROVAL as an protective acquisition.

for the following reasons:
This parcel is a mobile home park with more than a dozen relocations as well as a community
septic system and a pond that are being impacted. There is also a possibility that part of the
property could be used to relocate a cell tower.

for the following reasons:
This parcel is adjacent to parcel 057 (item 2 on the current agenda) and the advance acquisition
was requested by the property owner. It is a potential total take and is also a candidate for a cell
tower relocation, which makes it advantageous to have this parcel in hand in case it is needed for
the tower relocation (a long lead-time item)

This request is from the Division 13 Division Engineer for the following reasons:
This parcel is currently vacant, and the owner is unable to find a tenant or buyer due to the
imminent start of the project. As such, they are having to spend funds on upkeep, lighting, and
security to keep the property safe with limited opportunity to lease. Additionally, it is bordered
on either side by parcels we are currently pursing through advanced acquisition, one of which
will be on on -site resident engineer's office.
