Hancock, P.E., Manager Project Development and Environmental Analysis Unit 1598 Mail Service Center Raleigh,North Carolina 27699-1598 Dear Mr. Hancock: Reference the Department of the Army(DA) individual permit(1P) issued to you on September 27, 2013, to impact approximately 6.94 acres of Department of the Army(DA)jurisdictional wetlands and 851 linear feet of surface waters associated with NCDOT TIP No. R-3307; Gallants Channel Bridge, related approaches, and upgrades to US 70 located near the town of Beaufort, Carteret County,North Carolina. This office received permit modifications dated September 23, 2014 and October 1, 2014, affecting areas of the above referenced project. The modification requests are detailed as follows: 1). Due to a delay in the Duke Energy power line relocation, the contractor has identified the need to construct a temporary ramp to obtain access beyond the power lines to facilitate construction of the temporary work trestle. The temporary ramp will be completely enclosed by approximately 200 feet of temporary sheet pile within wetlands. The majority of the ramp will be constructed on a previously permitted area for excavation in coastal wetland; however, an additional 0.01 acre of temporary fill in coastal wetland will be required. Once the temporary access ramp in no longer required, it will be removed in its entirety and restored to preconstruction elevation. 2). A request for approval to remove a portion of rock jetty in Gallants Channel adjacent to bridge Bent 25 to construct the bent footing at that location. 3). A request to allow an increase in hand clearing from 0.23 acres to 1.06 acres for construction of the bridge, bridge approaches and temporary work bridge. 4.) A notification of revision to permit drawing sheet 5 (plan sheet 8,-1-Sta.63+43). The original permit drawings erroneously depicted the fill within the retaining wall at the approach. The revision corrects a calculation error resulting in a 0.01 acre impact increase to 404 wetlands at Site 2. These modification requests were discussed and coordinated with the appropriate State and Federal agencies at several on-site meetings and the coordination revealed no objections to this modification request. The proposed modifications for R-3307 as detailed above are hereby modified in accordance with the specific work activities described and depicted on the plan sheets, drawings and descriptions enclosed with the permit modification request package. A revised wetland permit impact summary sheet is attached and noted as Permit Drawing Sheet 34 of 34 and dated October 1, 2014. It is understood that all conditions of the original permit and applicable modifications remain valid. In addition, the permittee will comply with the additional special permit conditions as follows: a.) All work authorized by this permit modification must be performed in strict compliance with the submitted work plans, which are part of this permit. Any modification to the permit plans must be approved by US Army Corps of Engineers (Corps)prior to implementation. b.) The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit, and any authorized modifications. A copy of this permit, and any authorized modifications, including all conditions, shall be available at the project site during construction and maintenance of this project. c.) To offset the additional 0.01 acre of impact to coastal wetlands on Site 1 associated with this modification, compensatory mitigation is required and 0.01 acres (1:1 ratio)will be debited from the proposed onsite coastal marsh restoration site as described in the original mitigation plan submitted with the application for R-3307, dated November 9, 2011. If the area returns to pre- project elevations, contours and appropriate coastal marsh vegetation following the removal of the permitted fill; this compensatory mitigation requirement may be reviewed and/or modified after coordination and approval by the relevant regulatory agencies.
