The DCM has reviewed the information you provided on the proposed modification to the plans for
revised impacts associated with Site 38A on the US 70 Havelock Bypass Project (T.I.P. R-1015). We
have determined that the project remains consistent with the North Carolina Coastal Management
Program and this email will serve as official notification from the DCM authorizing the NCDOT to
proceed with the proposed revisions as detailed in your request. Please let me or Cathy Brittingham
know if we may be of further assistance with this project.

He is a revised permit drawing showing the area around the headwall. Basically, due to the angle of the Headwall
(permit sheet # 126, site 38A) in comparison to the fill slope, the contractor will have to excavate into the “mechanized
clearing” area by 0.006ac. The net impacts on this site did not change, but the type of impact was revised. The change
will get the slope and structure to match up better.

The contractor is getting ready to install a headwall for a 36” pipe on R-1015 (structure # 3410, permit site #38A). They
noticed that due to the angle of the HW in comparison to the fill slope that they will have to excavate into the
“mechanized clearing” area. It would be approximately 20 sq. ft. or less. And they would fill back in around the head
wall. There may be some fill behind the HW.
Since the excavation and/or fill will be an area already counted as permanent impact, with mitigation provided, can this
be handled as an email, or will you need a formal permit modification request?
Below is a screen shot of the area in question, the area is highlighted in purple:

I promise that we will eventually complete construction of this project, and there will be no further modifications to this
permit.
