(S &ME) is submitting this Preconstruction Notification Form for the above - referenced project as application for a U.S. Army Corps of Engineers ( USACE) Nationwide Permit Number 39 (NWP 39) Verification for commercial and institutional developments and concurrent North Carolina Department of Natural Resources (NC DENR) Division of Water Resources (DWR) Water Quality Certification Number 3890. BACKGROUND INFORMATION Walmart proposes to construct a Walmart Store (Store No. 6958 -00) west of the intersection of Brinkley Hill Lane and NC Highway 24 -87 in Spout Springs, North Carolina. Development of the site will include a 189,544 square foot building, parking, utilities, stormwater management facilities, lighting, and landscaping. The site is located in a rural area of Spout Springs and is partially developed with scattered residences. The following documents are provided in support of our request: • Pre - construction Notification (PCN); • Figures: USGS Topographic Map (Figure 1), USDA -NRCS Soil Survey Map (Figure 2), Color Aerial Map (Figure 3), Jurisdictional Wetland/ Stream Map (Figure 4), National Wetland Inventory Map (Figure 5); • Appendix I: Wetland Exhibit • Appendix II: Agent Authorization Letter • Appendix III: Grading Plan • Appendix IV: NC EEP Compensatory Mitigation Acceptance Letter • Appendix V: Routine Data Forms • Appendix VI: USACE Notification of Jurisdictional Determination Application for NWP 39 SWE Project No. 1054 -13 -340 Walmart Store- Spout Springs October 1, 2014 PROPOSED PROJECT IMPACT S &ME visited the site to delineate the jurisdictional wetlands and waters of the U.S. within the subject property to perform a jurisdictional delineation. S &ME delineated one perennial stream located along the northwestern property boundary and approximately 2.21 acres of riparian wetlands adjacent to the stream. S &ME conducted regulatory site meetings with the U.S. Army Corps of Engineers ( USACE) to confirm our findings on February 4, 2014. S &ME received a copy of the USACE Notification of Preliminary Jurisdictional Determination signed April 2, 2014, and this document is attached as Appendix VI. Plans for the site development and associated stormwater BMP do not include impacts to the jurisdictional stream, but will impact a jurisdictional wetland. This wetland impact will be limited to 0.478 acres of construction fill within the wetland as shown in Appendix I. The site plan has been designed to minimize impacts to the jurisdictional Waters of the U.S. by revising the development footprint to avoid impacts to the stream and by minimizing the proposed impervious surfaces and grading to the full extent practicable by utilizing retaining walls. Appropriate sediment and erosion control practices equaling those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" will be used.
